City Personnel. 5.1. It is understood and agreed that City employees are independent of the County. City’s assigned personnel shall not be entitled to any benefits payable to employees of the County. The County is not required to make any deductions or withholdings from the compensation payable to City personnel under the provisions of this agreement, City hereby indemnifies and holds the County harmless from any and all claims that may be made against County based upon any contention by any third party that an employer-employee relationship exists by reason of this agreement. 5.2. If, in the performance of this agreement, any third persons are employed by City, such person shall be entirely and exclusively under the direction, supervision, and control of City. All terms of employment, including hours, wages, working conditions, discipline, hiring, and discharging, or any other terms of employment or requirements of law, shall be determined by City, and the County shall have no right or authority over such persons or the terms of such employment. 5.3. It is further understood and agreed that as an independent contractor and not an employee of the County, neither the City nor City’s assigned personnel shall have any entitlement as a County employee, right to act on behalf of the County in any capacity whatsoever as agent, nor to bind the County to any obligation whatsoever. City’s assigned personnel shall not be covered by worker’s compensation; nor shall City’s assigned personnel providing services under this Agreement be entitled to compensated sick leave, vacation leave, retirement entitlement, participation in group health, dental, life and other insurance programs, or entitled to other fringe benefits payable by the County to employees of the County.
City Personnel. Permittee must provide and pay for City of Bethlehem Roster Duty Fire Department personnel and City of Bethlehem Department of Public Works personnel at all times during the Festival. The number of roster duty fire personnel required shall be determined by the City of Bethlehem Fire Department. The number of Public Works personnel required shall be determined by the City of Bethlehem Public Works Department. The preceding is amended and superseded with respect to fees, charges and payment obligations only by the single contribution payment under Section A, Paragraph 3.
City Personnel. City shall provide SROs for the Services required by this Agreement in accordance with City’s employment procedures and conditions. City, in its sole discretion, shall determine which SROs will be assigned to perform the Services.
City Personnel. Northwestern shall provide a calendar of known scheduled events by the first business day of each new year to the City where practicable. The City shall provide 1 Note to Draft: The Effective Date will be on or after the passage of the Approval Ordinances that are mutually agreeable to the City and Northwestern personnel, where practicable, in such quantities, at such locations, and during such hours as Northwestern may designate, upon oral or written notice delivered at least three (3) days prior to the date on which such personnel are requested to perform services (the “Event Date(s)”); provided, however, that the City, may, but shall not be obligated to provide any personnel unless Northwestern delivers written notice at least one (1) month prior to any Event Date and such notice describes: (i) the Event Date, (ii) an estimated number of personnel that the Northwestern might designate on the Event Date, and (iii) an estimated number of hours personnel may be requested to work. If the City is unable to provide the required minimum staffing, Northwestern will hire private security or private traffic management as approved by the City to ensure minimum staffing levels are maintained. Approval of the additional security will not be unreasonably withheld by the City.

City Personnel. The City will supply ALS level personnel from the Bozeman Fire Department to provide ALS support coverage or backup services with the ALS Unit. The City’s personnel will be licensed, certified and accredited in accordance with applicable federal, state or local laws. The City shall be solely responsible for all compensation and benefits to its personnel that provide ALS support coverage or backup services with the ALS Unit.
