Year 2000 Compliance Warranty. Vendor shall ensure the product(s) and service(s) furnished pursuant to this agreement (“product” shall include, without limitation, any piece of equipment, hardware, firmware, middleware, custom or commercial software, or internal components, subroutines, and interfaces therein) which perform any date and/or time data recognition function, calculation, or sequencing, will support a four digit year format, and will provide accurate date/time data and leap year calculations on and after December 31, 1999, at the same level of functionality for which originally acquired without additional cost to the user. This warranty shall survive termination or expiration of the agreement.

Year 2000 Compliance Warranty. Elekta further warrants that the equipment, software and use of data will be year 2000 compliant and accommodate a full year calculation in its software. Year 2000 Compliance Warranty. SELECTICA represents and warrants that the Software as delivered will operate prior to, during, and after, the calendar year 2000 A.D. without error relating to date data, specifically including but not limited to any error relating to calculations, sorting, interpretation, processing or acceptance of date data which represents or references different centuries or more than one century, provided that all hardware, firmware and other software used in conjunction with the Software properly exchanges accurate and properly formatted date data with the Software. The Year 2000 Compliance Warranty set forth in this Section shall begin as of the date of this Agreement and end on the date after January 1, 2000, subsequent to which the Software has operated without a breach of the Year 2000 Compliance Warranty for a consecutive six month period (the "Year 2000 Warranty Period"). If the Software fails to comply with the warranty set forth in this Section 12. SELECTICA will use reasonable commercial efforts to correct the noncompliance, provided that VAR notifies SELECTICA of the noncompliance within the Year 2000 Warranty Period, and SELECTICA is able to reproduce the noncompliance as communicated by VAR to SELECTICA. If after the expenditure of reasonable efforts, SELECTICA is unable to correct any such noncompliance, SELECTICA may refund to VAR all or an equitable portion of the license fee paid by VAR to SELECTICA for such Software in full satisfaction of VAR's claims relating to such noncompliance upon VAR's return of said Software.

Year 2000 Compliance Warranty. Seller represents and warrants the ("Year 2000 Warranty') that (a) all Calendar-Related processing by the Products and Special Products of Date Data or of any System Date will not cause the Products to cease to operate substantially in accordance with the Specifications, (b) all data fields for the Date Data contained in the Products are four-digit fields capable of indicating century and millennium, and (c) that Seller has verified through its testing procedures that no change in the System Date (including the changes from the year 1999 to the year 2000) will cause the Products or the Special Products to cease to operate substantially in accordance with their Specifications. Notwithstanding any provision to the contrary set forth in this Agreement, Seller makes no representation or warranty with respect to the Products or Special Products operating in conjunction with any computer software, computer firmware, computer hardware, or any combination of the foregoing supplied by third parties.

In addition to any other warranties and representations provided by Licensor to Licensee, whether pursuant to this Agreement, by law, equity, or otherwise, Licensor represents and warrants that (a) all Products and Services, without limitation, provided by Licensor or their agents or assignees hereunder, shall be Year 2000 Compliant at the time of delivery and at all times thereafter and in all subsequent updates or revisions of any kind, and (b) Licensor's supply of the Products and Services to Licensee shall not be interrupted, delayed, decreased, or otherwise affected by dates prior to, on, after or spanning January 1, 2000.

Year 2000 Compliance Warranty. (a) Until the later of December 31, 2002 or three (3) years after the delivery of any applicable Product, the Vendor represents and warrants that any Products delivered by the Vendor to the Owner under this Contract are designed to be used prior to, during, and after the calendar year 2000 A.D., and that such Products will operate during each such time period without any material performance affecting error relating to date data and date-dependent data, specifically including any material performance affecting error relating to, or the product of, date data which represents or references different centuries or more than one century. Notwithstanding anything contained herein to the contrary, the extension of the applicable Software warranties pursuant to the terms of subsection 17.1 will also extend the term of the Vendor's obligations under this subsection 17.11 with respect to any such Software, as to which any such subsection 17.1 Software warranty is so extended.
Year 2000 Compliance Warranty. 7.1.1 Company warrants and represents that the Products covered by this agreement, including all custom Products, individually and in combination, have been assessed and do achieve Year 2000 compliance. In order to be Year 2000 compliant, the Products must function accurately and without interruption before, during and after January 1, 2000, without any manual intervention in operations, and all date data information must be correct before, during and after that date. The Products, individually and in combination, shall provide correct results when moving forward or backward in time through and beyond January 1, 2000, and shall provide fault-free performance in processing dates and date-related data (including, but not limited to, calculating, comparing and sequencing). The warranties set forth above shall not be subject to any disclaimer or exclusion of warranties or to any limitation of Seller's/Licensor's liability under this agreement.
Year 2000 Compliance Warranty. Vendor warrants that the Software provided pursuant to this Contract is Year 2000 compliant. This warranty includes a representation that dates on and after the year 2000 do not cause computational problems nor do these dates diminish the functionality of the Software including, but not limited to, date data century recognition, calculations that accommodate same century and multi-century formulas and date values, year 2000 leap year calculations, and date data interface values that reflect the century. Failure to comply with Year 2000 requirements shall entitle Purchaser to a refund of three (3) times the initial license fee. Vendor has no liability for any failure to comply with this provision that is caused solely by failure of an interconnected third-party product to be Year 2000 compliant.
