Confidential Information. 4.1 Sämtliche von Eurotax bereitgestellten geschäftsbezogenen Informationen gelten als vertrauliche Informationen. Der Kunde ist unter der Maßgabe, dass ausschließlich die in der Bestellung festgelegte erlaubte Nutzung gestattet ist, verpflichtet, (i) die Produkte und sämtliche darin enthaltenen Informationen vertraulich zu behandeln und den Zugang zu den Produkten auf diejenigen Mitarbeiter, Beauftragten und Unterauftragnehmer zu beschränken, die Kenntnis von ihnen haben müssen, (ii) Eurotax unverzüglich zu benachrichtigen, wenn er Kenntnis von einer unbefugten Nutzung oder einem unbefugten Zugriff auf Produkte oder vertrauliche Informationen durch Dritte erlangt, (iii) sämtliche notwendigen Schritte zum Schutz der vertraulichen Informationen oder der geistigen Eigentumsrechte von Eurotax an den Produkten zu ergreifen und (iv) sämtliche Maßnahmen zu ergreifen, die erforderlich sind, um die Einhaltung der Bestimmungen dieser Ziffer 4 durch seine Mitarbeiter, Beauftragten und Unterauftragnehmer sicherzustellen. 4.1 Any and all business-related information provided by Eurotax shall be deemed to be confidential information. Subject only to the Permitted Use specified in the Order, Customer shall: (i) keep Products and any information contained therein confidential and limit access to Products to those of its employees, agents and sub-contractors who have a need to know; (ii) notify Eurotax immediately if it becomes aware of any unauthorised use of or access to any Products or confidential information by any third party; (iii) take all steps necessary to protect the confidential information or Intellectual Property Rights of Eurotax in Products; and (iv) take all such steps as are necessary to ensure compliance by its employees, agents and sub-contractors with the provisions of this clause 4.
Confidential Information. For WIKA transparent communication in the context of data protection legislation and boundaries in relation to confidentiality in busi- ness is important. At the same time, we com- mit ourselves to the upholding of operational and business secrets. As employees of the WIKA Group, we ensure that we never communicate confidential infor- mation and documents to third parties. The same applies to the forwarding of correspond- ing contents and/or documents to private e- mail accounts etc., and to their publication, e.g. on social networks or Internet portals, ex- cept where we have been expressly empow- ered to do so, or in cases where there is a purely service-related use that respects the provisions of data protection legislation.
Confidential Information. The student acknowledges that the training content (intellectual property), recommended training materials, training plans, advertising plans, intended structure, designs, formulas, documentation, software, know-how, information, observations, data, customer and supplier lists, costs, and other trade secrets and confidential information from Peak Pilates (collectively "confidential information") are valuable, special, and unique assets of Peak Pilates. The student shall not at any time, directly or indirectly, disseminate, use, or disclose "confidential information" to persons outside Peak Pilates. The aforementioned restrictions for students do not apply to the following types of information: (a) The information is in the public domain or otherwise publicly accessible, or becomes part of the public domain or publicly accessible through no fault of the student; (b) is provided to the student by an independent third party who has no confidentiality obligation with Peak Pilates; (c) the information was in the possession of the student before their association with Peak Pilates or was known to them before their association with Peak Pilates; or (d) the information must be disclosed by law or court order.

Confidential Information. For purposes of this agreement, the term “Confidential Information” shall include (i) all information (whether prepared by Schering or otherwise) furnished to the Recipient by or on behalf of Schering, its Affiliates or Schering’s advisors, regardless of whether such information is furnished in writing, orally, in electronic form or otherwise, and (ii) all analyses, compilations, studies or other documents (regardless of the form in which any such analyses, compilations, studies or other documents are maintained) prepared by the Recipient or any of Recipient’s affiliates, officers, directors, employees or financial or legal advisors which contain or otherwise reflect any information as referred to in (i). In particular, Confidential Information shall include without limitation all information about the business, business processes, products, R&D activities, etc. of Schering and Xxxxxxxx’x Affiliates.
Confidential Information. 13.3.1 All information exchanged or obtained within the business relationship between the contracting parties is considered proprietary information and must be treated as confidential, unless the information is made publicly avail- able by a contracting party or otherwise agreed between the contracting parties. 13.3.2 The following shall be deemed expressly confidential within the business relationship between the customer and esz AG a) Information and documents that are designated or la- belled as confidential b) Information and documents related to requirements, their concretisation or implementation of standards, in par- ticular DIN EN ISO/IEC 17025, DIN EN ISO 14001 or DIN EN ISO/IEC 17043, c) Information and documents relating to the quality man- agement system, personnel, contracts, premises, facilities, processes or procedures, d) Information and documents relating to customers, au- thorities, orders, subject matter of the order, order results or external third par ties, e) Documents and information that are deemed to be confi- dential. 13.3.3 Information and documents are considered non- con- fidential if they a) are generally known and freely available, b) are lawfully known to the contractual partner and are not subject to a confidentiality agreement to the contrary, c) originate from a legitimate source and are not subject to a confidentiality agreement to the contrary, d) were demonstrably derived independently, e) of which the contracting parties have informe d each other in advance by way of disclosure or making available.
