Remedy Musterklauseln

Remedy. 5.1 If the Customer breaches any provision of this Agreement ASK4 shall have the right to suspend supply of the Service and Additional Services to the Customer at ASK4’s absolute discretion or in the case of a serious or material breach or persistent breaches to terminate this Agreement by immediate notice. A breach of the User Policy attached as Appendix 2 will be treated as a serious breach of this Agreement. 5.2 If the Customer (or the Owner on the Customer’s behalf) fails to pay the Service Fee or any other monies due under this Agreement ASK4 shall have the right to suspend access by the Customer to the Service and/or Additional Services till the Customer pays the outstanding monies. 5.3 Such specific rights of remedy are in addition to any other rights that ASK4 may have arising from the Customer’s breach of this Agreement. 5.4 ASK4 shall have the right to suspend access by the Customer to the Service and Additional Services in accordance with the other provisions herein contained if so requested by the Owner of the Residency where the Owner has the right to request such suspension.
Remedy. If, after ▇▇▇▇ has conducted appropriate tests and inspections as determined by Simi - at their sole discretion - the Product(s) or a part thereof is found to have defects that fall within this Warranty, exclusive remedy shall be made, at the sole option and discretion of Simi, by either repairing the defects or faults, or by supplying the respective correct Product or part of the Product to the Customer. Either Simi or Simi US Motion or the Customer or a third party shall perform repairs, at Simi’s sole discretion.
Remedy. (a) Service Provider remedies software defects at its option by providing a new version of Platform or by indicating reasonable ways to avoid the effects of the defect. (b) Defects must be notified in writing or via e-mail with a comprehensible description of the error symptoms, as far as possible evidenced by written recordings, hard copies or other documents demonstrating the defects. (c) The notification of the defect should enable Service Provider to reproduce the error. (d) Service Provider may refuse to remedy defects until Customer has paid the agreed fees to Service Provider less an amount that corresponds to the economic value of the defect.
Remedy. 7.3 Abhilfe. (a) the correction of the deficient Cloud Service, and (a) die Wiedererbringung des mangelhaften Cloud-Service, und (b) if Qualtrics fails to correct the deficient Cloud Service, Customer may terminate its subscription for the affected Cloud Service and receive a refund as set forth in Section 6.3. Any termination must occur within three months after Qualtrics’ failure to correct the deficient Cloud Service.
