Chronic Outage definition

Chronic Outage means a series of three (3) or more Service Outages affecting the same Service on the same circuit during a given calendar month, each of which has an actual time to restore “TTR” in excess of WAVE’s targeted MTTR.
Chronic Outage means and refer to the occurrence of two (2) or more Separate/Independent Interruptions of Landlord’s Essential Services within a six (6) consecutive month period, each of which continues for eight (8) or more consecutive hours, regardless of whether or not such Interruption of Landlord’s Essential Services was caused by Force Majeure or any other event, other than the fault of Tenant, or anyone claiming by, through or under Tenant.
Chronic Outage means the level and frequency of repeated incidents of complete network unavailability described in Section 12.3(i) that gives rise Customer’s right to terminate service without penalty. Claim has the meaning provided in Section 16.1.

Examples of Chronic Outage in a sentence

  • If Customer’s claim for an SLA-related credit or Chronic Outage remedy is rejected, the notification will specify the basis for the rejection.

  • If Customer experiences a Chronic Outage with respect to a Service, Customer shall have the right to elect either of the following remedies, which must be claimed as described in this SLA: (i) substitute a different Service or a different path for the Service that experienced the Chronic Outage without incurring any Termination Charge or installation fees; or (ii) terminate the affected Service for the path that experienced the Chronic Outage without incurring any Termination Charge.

  • Tenant’s failure to timely deliver Tenant’s Chronic Outage Termination Notice shall automatically extinguish Tenant’s right to terminate this Lease with respect to that particular Chronic Outage.

  • To be eligible for any SLA-related Service credit or Chronic Outage remedy, Customer must be current in its financial obligations to GRANDE.

  • In the event of a Chronic Outage, Tenant may terminate this Lease by timely delivery of the Chronic Outage Termination Notice to Landlord.


More Definitions of Chronic Outage

Chronic Outage means and refer to the occurrence of three (3) or more Qualifying Chronic Outages within a twelve (12) consecutive month period.
