BT EQUIPMENT. 5.1. To enable the installation and use of BT Equipment on Site, the Customer will, at its own expense, if necessary: 5.1.1. obtain all necessary consents, permissions and approvals including consents for any necessary alterations to buildings; 5.1.2. provide suitable accommodation, foundations and environment for the equipment including all necessary trunking, conduits and cable trays in accordance with relevant installation and use standards; 5.1.3. make such internal building alterations as BT advises are necessary and carry out afterwards any making good or decorator’s work required; 5.1.4. provide all necessary support for the Service to include but not limited to electricity supply; 5.1.5. provide BT with a detailed map marking the location of BT Equipment on Site and verify that such equipment does not damage or interfere with either the equipment or services of the Customer or any third party; and/or 5.1.6. provide BT with such co-operation and assistance as it requires. 5.2. The Customer is responsible for any BT Equipment on Site and must not add to, modify or in any way interfere with BT Equipment. The Customer will be liable to BT for any loss of or damage to BT Equipment on Site, except where such loss or damage is due to fair wear and tear or is caused by the negligent or wilful act or omission of BT, its agents, employees or subcontractors. 5.3. Title to BT Equipment on Site shall at all times remain with and belong to BT.

BT EQUIPMENT. 5.1 BT Equipment remains the property of BT at all times. 5.2 Except for PCP Only connection variants, the Communications Provider will take reasonable steps to ensure End Customers will: (a) prepare the Site and provide a suitable place, conditions, connection points and electricity for BT Equipment at the Site in accordance with BT’s reasonable instructions, if any; (b) in relation to the Site and any third party premises or land on which the Site is situated, obtain all necessary consents, including for example, consents for any necessary alterations to buildings, permission to cross other people’s land or permission to put BT Equipment on their property; and (c) provide a suitable place and conditions for BT Equipment including connection points required by BT and electricity. 5.3 The Communications Provider is responsible for BT Equipment at an End Customer Site and agrees to take reasonable steps to ensure that nobody (other than someone authorised by BT) adds to, modifies or in any way interferes with it. The Communications Provider will be liable to BT for any loss of or damage to BT Equipment, except where such loss or damage is due to fair wear and tear or is caused by BT, or anyone acting on BT’s behalf. The Communication Provider’s liability under this sub-clause 5.3 is limited to the replacement value of the BT Equipment together with any associated costs of replacement.
BT EQUIPMENT. 9.1 BT is exclusively responsible for the provision, installation, configuration, monitoring and maintenance of any BT Equipment used in connection with the Service. BT shall ensure that any the BT Equipment connected to or used with Service is connected and used in accordance with any instructions and safety and security procedures applicable to the use of that BT Equipment. 9.2 BT shall ensure that any BT Equipment connected (directly or indirectly) to the Service is technically compatible with the Service and approved for that purpose under any applicable law or regulation.
BT EQUIPMENT. 4.1 If BT needs to install BT Equipment at a Site to enable BT to provide the Service the Customer will prior to installation: (a) prepare the Site in accordance with BT’s reasonable instructions, if any; (b) make available a suitable place and conditions for the BT Equipment; and (c) provide at no charge to BT sufficient electricity to power the BT Equipment. After installation is completed it is the Customer’s responsibility to restore the condition of the Site including any re-decorating that may be required. However, subject to paragraph 14.3 BT will be responsible for the reasonable costs of any work to restore the Site to its original condition and which is required as a direct result of BT’s negligence. 4.2 The Customer is responsible for the BT Equipment and must not add to, modify or in any way interfere with, nor allow anyone else (other than someone authorised by BT) to do so. The Customer will be liable to BT for any loss of or damage to the BT Equipment whilst it is in the Customer’s possession, custody or control except where such loss or damage is due to fair wear and tear or is caused by BT or anyone acting on BT’s behalf.
BT EQUIPMENT. 3.1 The BT Equipment remains the property of BT at all times. 3.2 If the Supplier (or Gamma on behalf of the Supplier) needs to install BT Equipment at a Site to enable the Supplier to procure the provision of a Line Rental Service, the Customer will, prior to installation: a) prepare the Site in accordance with the Supplier’s reasonable instructions, if any; b) make available a suitable place and conditions for the BT equipment; c) provide, at no charge to the Supplier or BT, power connection points and sufficient electricity to power the BT Equipment; d) agree to restore the condition of the Site including any re- decorating that may be required after installation is completed; and e) obtain all necessary consents, including for example, consents for any necessary alterations to buildings, permission to cross other people’s land or permission to put BT Equipment on their property. 3.3 The Customer is responsible for the BT Equipment and must not add to, modify, carry out any maintenance on or in any way interfere with the BT Equipment nor allow anyone else, (other than someone authorised by BT) to do so. The Customer will be liable to the Supplier for any loss of or damage to the BT Equipment, except where such loss or damage is due to fair wear and tear or is caused by BT, or anyone acting on BT’s behalf. 3.4 Following termination of any service, the Supplier (or Gamma, acting on its behalf) may arrange for BT to visit the Customer’s Site during working hours to recover any BT Equipment. The Supplier shall use reasonable efforts to co- ordinate such visits with the Customer.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties. This paragraph shall apply to all new types of equipment including office and clerical equipment. In the event an agreement cannot be reached within sixty (60) days after the date such equipment is put into use, the matter may shall be submitted to the National Grievance Committee for final disposition. Rates agreed upon or awarded shall be effective as of the date equipment is put to use

  • Leased Equipment The risk of loss or damage to leased equipment, goods or property shall not transfer to the University except as provided in §680.219, Florida Statutes. Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Life support equipment (a) If a person living or intending to live at your premises requires life support equipment, you must: (i) register the premises with your retailer or with us; and (ii) provide medical confirmation for the premises. (b) Subject to satisfying the requirements in the Rules, your premises may cease to be registered as having life support equipment if medical confirmation is not provided to us or your retailer.

  • Capital Equipment Collaborator’s commitment, if any, to provide ICD with capital equipment to enable the research and development activities under the Research Plan appears in Appendix B. If Collaborator transfers to ICD the capital equipment or provides funds for ICD to purchase it, then ICD will own the equipment. If Collaborator loans capital equipment to ICD for use during the CRADA, Collaborator will be responsible for paying all costs and fees associated with the transport, installation, maintenance, repair, removal, or disposal of the equipment, and ICD will not be liable for any damage to the equipment.

  • Additional Equipment Additional Equipment may from time to time be added as the subject matter of this Agreement as agreed on by the parties. Any additional property will be added in an amendment describing the property, the monthly rental, security deposit, and stipulated loss value of the additional Equipment. All amendments must be in writing and signed by both parties. Other than by this amendment procedure, this Agreement may not be amended, modified, or altered in any manner except in writing signed by both parties.

  • Office Equipment The Client must not install any cabling, IT or telecom connections without the Provider’s consent, which the Provider may refuse at its absolute discretion.

  • Required Equipment Employees are expected to be at their individual work stations with required equipment in operable condition at the scheduled shift starting time.

  • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.

  • Equipment The Fund shall obtain and maintain at its own cost and expense all equipment and services, including but not limited to communications services, necessary for it to utilize the Software and obtain access to the System, and Custodian shall not be responsible for the reliability or availability of any such equipment or services.

  • Equipment Use Lessee agrees that the Equipment will be operated by competent, qualified personnel in connection with Lessee's business for the purpose for which the Equipment was designed and in accordance with applicable operating instructions, laws, and government regulations, and that Lessee shall use all reasonable precautions to prevent loss or damage to the Equipment from fire and other hazards. Lessee shall procure and maintain in effect all orders, licenses, certificates, permits, approvals, and consents required by federal, state, or local laws or by any governmental body, agency, or authority in connection with the delivery, installation, use, and operation of the Equipment.
