Discrimination based on sex means every direct or indirect discrimination, including sexual harassment or harassment and any less favourable treatment based on a person’s rejection of, or submission to such conduct, as well as any less favourable treatment of a woman related to pregnancy, childbirth, nursing, maternity, or sickness due to pregnancy or childbirth, but not including positive actions, whereas any instruction or order to discriminate against persons, on grounds of sex, shall be discrimination based on sex
