Highways Agreement means an agreement to under specific works within the public highway under Section 278 of the Highways Act 1980

The development hereby approved shall not be brought into use until a Section 278 Highways Agreement has been entered into in order to secure the necessary works to the public highway, as indicated on the approved plans.
The purpose of the list is to distinguish between those types of infrastructure that the council intends to fund through CIL and those areas where a Section 106 Planning Agreement or S278 Highways Agreement will be sought.
The development shall not be occupied or brought into use until a Section 278 Highways Agreement has been entered into in order to secure the necessary works to the public highway.

Highways Agreement means an agreement under s38 and/or s278 of the 1980 Act or such other provisions as may be necessary to authorise the carrying out and subsequent adoption of all links connecting the Development and the Bridge to the public highway as shown on the approved plans and including without limitation the Kew Bridge Station Underpass;
