Net Rentable Area of the Premises definition

Net Rentable Area of the Premises means the gross area within the inside surface of the outer glass or other material comprising the exterior walls of the Premises to the mid point of any walls separating portions of the Premises from those of adjacent tenants and to the Common Areas or Service Areas side of walls separating the Premises from Common Areas and Service Areas, subject to the following: (1) Net Rentable Area of the Premises shall not include any Service Areas.
Net Rentable Area of the Premises means a total of eighty-two thousand six hundred thirty-two (82,632) rentable square feet as follows:
Net Rentable Area of the Premises means the gross area within the inside surface of the outer glass or other material comprising the exterior walls of the Premises to the mid-point of any walls separating portions of the Premises from those of adjacent tenants and to the Common Areas or Service Areas side of walls separating the Premises from Common Areas and Service Areas, subject to the following: (1) Net Rentable Area of the Premises shall not include any Service Areas and shall not include Exterior Common Areas. (2) Net Rentable Area of the Premises shall include a pro rata part of the Building Common Areas plus a pro rata part of the Single Floor Common Areas on the floor on which the Premises are located, such prorations based upon an allocation to each floor of the Building of Building Common Areas (based upon the Net Rentable Area of each floor and the Net Rentable Area of the Building, exclusive of Building Common Areas) and upon the ratio of the Net Rentable Area of the Premises to the total Net Rentable Area of such floor. (3) Net Rentable Area of the Premises shall include any columns and/or projection(s), which protrude into the Premises and/or the Common Areas.

Examples of Net Rentable Area of the Premises in a sentence

  • The Landlord may from time to time re-measure the Net Rentable Area of the Premises or re-calculate the Rentable Area of the Premises and may re-adjust the Net Rent and/or the Tenant's Proportionate Share of Additional Rent accordingly.

  • Tenant shall, when Landlord so requires, during the Lease Term pay as an adjustment to Base Rental hereunder an amount (per each square foot of Net Rentable Area of the Premises, including those portions of Common Areas allocated to the Premises from time to time) equal to the excess ("Excess") from time to time of actual Basic Costs per square foot of Net Rentable Area in the Building over the amount of the Expense Stop.

  • Effective on any change in the Net Rentable Area of the Premises or the Building in accordance with this Lease, the calculation of the Base Rent Adjustment will change accordingly.

More Definitions of Net Rentable Area of the Premises

Net Rentable Area of the Premises. Notwithstanding any provision contained herein to the contrary, Lessor and Lessee hereby agree that the Net Rentable Area of the Premises is 5,663 square feet as of the date hereof, subject to recalculation pursuant to Section 20 below.
Net Rentable Area of the Premises means approximately thirty four thousand five hundred eighty five (34,585) rentable square feet in the Premises (inclusive of the Additional Expansion Space), consisting of approximately thirteen thousand nine hundred sixty six (13,966) rentable square feet in Suite 600; approximately thirteen thousand nine hundred sixty six (13,966) rentable square feet in Suite 500; and approximately six thousand six hundred sixty three (6,653) rentable square feet in Suite 450, all of which Landlord and Tenant have stipulated as the Net Rentable Area of the Premises, all in accordance with the current BOMA standard. Tenant acknowledges the following: (i) prior to the Date of Turnover of Possession, Tenant had the opportunity to measure the Premises (including the Additional Expansion Space) and verify the accuracy of the foregoing square footage number; and (b) the Net Rentable Area of the Premises includes the usable area without deduction for columns or projections, multiplied by an add-on load factor to reflect a share of certain areas, which may include lobbies, corridors, mechanical, utility, janitorial, boiler and service rooms and closets, restrooms and other public, common and service areas of the Building, all in accordance with the current BOMA standard.
Net Rentable Area of the Premises means the square footage computed based on the gross area of the horizontal plans enclosed by the interior surface of the exterior walls of the Building, the midpoint of any walls separating portions of the Premises from adjacent tenants, the slab penetration line of all walls separating the Premises from service areas, and the interior corridor side of walls separating the Premises from the interior common areas, which shall include corridors, lobbies and other core and common areas. In computing Net Rentable Area of the Premises, no deduction shall be made for columns or projections necessary to the Building.
Net Rentable Area of the Premises shall be the number of square feet of the Premises described in this Lease.
Net Rentable Area of the Premises means the agreed to and stipulated amount of 23,400 square feet. Within thirty (30) days following the Commencement Date, Tenant and its representatives may measure the floor area of the Premises. In the event Tenant determines that the Net Rentable Area of the Premises (measured in accordance with BOMA Standard ANSI Z65.1-1996 and using the Building common area add-on factor) is less than 23,400 square feet, then Tenant shall notify Landlord within said thirty day period. In the event Landlord and Tenant do not agree upon the actual Net Rentable Area of the Premises within thirty (30) days following Tenant’s notification to Landlord concerning the Net Rentable Area of the Premises, said determination shall be submitted to an arbitrator to be selected in accordance with the rules of the American Arbitration Association, and the amount of the Base Rent and Additional Rent payable under this Lease and based upon the Net Rentable Area of the Premises shall be adjusted accordingly based upon the actual Net Rentable Area of the Premises determined by the arbitrator or as agreed upon by the parties, whichever is applicable.

Related to Net Rentable Area of the Premises

  • Rentable Area of the Premises The amount of square footage set forth in Section 1.01(10).

  • Net Rentable Area means with respect to any Project, the floor area of any buildings, structures or improvements available for leasing to tenants (excluding storage lockers and parking spaces), as reasonably determined by the Administrative Agent, the manner of such determination to be consistent for all Projects unless otherwise approved by the Administrative Agent.

  • Rentable Area of Premises on Page 1 of the Lease shall be deleted in their entirety and replaced with the following:

  • Rentable Area when applied to the Premises, is that area equal to the usable area of the Premises, plus an equitable allocation of Rentable Area within the Building that is not then utilized or expected to be utilized as usable area, including that portion of the Building devoted to corridors, equipment rooms, restrooms, elevator lobby, atrium and mailroom.

  • Building Area means the only area upon which the erection and use of buildings and structures shall be permitted but may include areas of Landscaped Open Space.

  • Square Footage means the total gross horizontal areas of all floors, including usable basement and cellars, below the roof and within the outer surface of the main walls of buildings (or the center lines of party walls separating such buildings or portions thereof) or within lines drawn parallel to and two feet within the roof line of any building or portion thereof without walls (which includes, notwithstanding paragraph 3 below, the square footage of all porches), and including pedestrian access walkways or corridors, but excluding the following:

  • Expansion Space means any space in the Building which, at any time during the Lease Term, is occupied by a Person other than Landlord under a written lease with Landlord, and the term “Tenant’s Expansion Space” means Expansion Space which Tenant has elected to lease as provided in this paragraph. Landlord agrees to notify Tenant promptly after Landlord learns that any Expansion Space is or will become available. Subject to the prior rights of other tenants to whom Landlord has granted substantially similar rights, Tenant has the option to lease any Expansion Space which Landlord notifies Tenant is or will become available. If Tenant gives Landlord notice of its exercise of this option within thirty (30) days after notification from Landlord of the availability of the Expansion Space and if no Event of Default exists when Tenant’s notice is given, this Lease will be deemed to be amended to include Tenant’s Expansion Space as part of the Premises for the remainder of the Lease Term upon all of the same terms contained in this Lease except that (i) the Rentable Area of the Premises will be amended to include Tenant’s Expansion Space; (ii) Tenant’s Share will be increased to include the rentable area of Tenant’s Expansion Space; (iii) the Term Commencement Date with respect to Tenant’s Expansion Space will be the earlier of sixty (60) days after the date on which Tenant’s Expansion Space becomes vacant and ready for occupancy (provided that date is at least sixty (60) days after Tenant exercises its option to lease the Expansion Space), or the date on which the Expansion Space is first occupied by Tenant; (iv) if Tenant’s Expansion Space contains a rentable area of 10,000 square feet or more, and if there are less than three (3) Lease Years remaining in the Lease Term, the Lease Term will be extended to include three (3) full years from the Term Commencement Date with respect to Tenant’s Expansion Space; and (v) subject to adjustment during each Fixed Rental Period as provided in Exhibit E, Basic Rent for each year of the remaining Lease Term (as it may be extended) will be the greater of (a) the Basic Rent last paid by the Person most recently occupying Tenant’s Expansion Space or (b) Market Rent determined as provided in the Rent Rider attached as Exhibit E. If Tenant exercises this option, Tenant’s Expansion Space will be leased to Tenant in its “as is” condition and Tenant will, at its expense and in compliance with the provisions of Section 7.06, design and construct all Improvements desired by Tenant for its use and occupancy. Landlord and Tenant agree to execute such amendments to this Lease and other instruments as either of them considers necessary or desirable to reflect Tenant’s exercise of this option.

  • Usable Area or "usable square feet" shall be calculated by Landlord provided, however, that in any case the Rentable Area of the Building (and the applicable buildings of the Project) shall include all of, and, with respect to the Building, the Rentable Area of the Premises shall include a portion of, the square footage of the ground floor common areas located within the Building and the other applicable building(s) of the Project, respectively, and the common area and occupied space of the portion of the Project dedicated to the service of the Building or such other building(s) of the Project, as the case may be. "Common Areas" shall mean the lobby, plaza and sidewalk areas, accessways, Parking Facilities, and the area on individual floors in the Building or other building(s) of the Project, as applicable, whether indoor or outdoor, devoted to corridors, fire vestibules, elevators, foyers, lobbies, electric and telephone closets, restrooms, mechanical rooms, janitor's closets, and other similar facilities for the benefit of all tenants and invitees and shall also mean those areas of the Building or other building(s) of the Project, as applicable, devoted to mechanical and service rooms servicing the Building or other building(s) of the Project, as applicable. Tenant acknowledges that it has reviewed the detail of the Rentable Area and Usable Area of the Premises prior to execution of this Lease and understands and agrees to the methodology. The Common Areas shall be subject to the exclusive management and control of Landlord, and Tenant shall comply with all Rules and Regulations pertaining to the Common Areas. Landlord shall have the right from time to time to designate, and in its reasonable discretion, relocate and limit the use of particular areas or portions of the Common Areas; provided Landlord shall use commercially reasonable efforts to notify Tenant at least five (5) calendar days in advance of any such material relocation or limitation. Landlord shall also have the right, in its reasonable discretion, to close all or any portion of the Common Areas as may, in the reasonable discretion of Landlord, be necessary to prevent a dedication thereof or the accrual of any rights in any person, provided Landlord shall use commercially reasonable efforts to notify Tenant at least five (5) calendar days in advance of any such material closure. Notwithstanding anything to the contrary in this Section 2.01, any such relocation or limitation of use of any Common Areas shall not: (a) have a material adverse effect upon the access to and/or use by Tenant, or Tenant’s suppliers, employees, agents and customers (collectively, “Tenant’s Invitees”) of the Premises or vehicular and/or pedestrian access to the Premises, (b) be materially inconsistent with the rights and obligations of Landlord and Tenant under this Lease; and/or (c) materially increase Tenant’s cost of operating its business in the Premises. 4823-6605-5163.8 2 FLIGHT AT TUSTIN LEGACY ChromaDex

  • Footage means still images, video, audio and other data captured by the Flock Hardware or Customer Hardware in the course of and provided via the Flock Services.

  • Subleased Premises means such portions of the Leased Premises being particularly identified on Schedule B, which the parties agree, for the purposes of this Sublease and any square footage calculations pursuant hereto, is approximately 42,244 square feet of office (21,068 square feet on the third floor and 21,176 square feet on the seventh floor) and approximately 9.4312% of common space (building rentable area is 447,917 square feet).

  • Net Rent means all rental Landlord actually receives from any reletting of all or any part of the Premises, less any indebtedness from Tenant to Landlord other than Rent (which indebtedness is paid first to Landlord) and less the Re-entry Costs (which costs are paid second to Landlord).

  • Building Square Footage or "BSF" means the square footage of assessable internal living space of a Unit, exclusive of any carports, walkways, garages, overhangs, patios, enclosed patios, detached accessory structure, other structures not used as living space, or any other square footage excluded under Government Code Section 65995 as determined by reference to the Building Permit for such Unit.

  • Leased Premises means the Leased Premises as defined in Paragraph 1.

  • Common Area Operating Expenses are defined, for purposes of this Lease, as all costs incurred by Lessor relating to the ownership and operation of the Industrial Center, including, but not limited to, the following: (i) The operation, repair and maintenance, in neat, clean, good order and condition, of the following:

  • Leased space means the individual storage space at the self-service facility which is rented to an occupant pursuant to a rental agreement.

  • Building Common Areas means with respect to the Tower, the areas, facilities and amenities specified in Schedule [E] which are to be used and enjoyed in common with all the other Apartment Acquirers of the Units in the Building; and

  • Building Operating Expenses means the portion of “Operating Expenses,” as that term is defined in Section 4.2.7 below, allocated to the tenants of the Building pursuant to the terms of Section 4.3.1 below.

  • Premises Building Total Destruction means if the Building of which the Premises are a part is damaged or destroyed to the extent that the cost to repair is fifty percent (50%) or more of the then Replacement Cost of the Building.

  • Lease Area means the Lease Area as more particularly described in SCHEDULE C.

  • Storage Space means a space where goods of non-hazardous nature are stored and includes cold storage and banking safe vaults;

  • Parking Space The County shall attempt to provide adequate free parking facilities for employees within a reasonable distance of their work locations.

  • bicycle parking space – occupant means an area that is equipped with a bicycle rack or locker for the purpose of parking and securing bicycles, and:

  • the Premises means the building or part of the building booked and referred to in the contract

  • ILUA Area means the geographical area in relation to which the Framework ILUA applies, as specified in Schedule 2 of the Framework ILUA;

  • School premises means either of the following:

  • Rentable Square Feet as used in the Lease will be deemed to include: (a) with respect to the Premises, the usable area of the Premises determined in accordance with the Method for Measuring Floor Area in Office Buildings, ANSI Z65.1-1996 (the "BOMA Standard"), plus a pro rata portion of the main lobby area on the ground floor and all elevator machine rooms, electrical and telephone equipment rooms and mail delivery facilities and other areas used by all tenants of the Building, if any, plus (i) for single tenancy floors, all the area covered by the elevator lobbies, corridors, special stairways, restrooms, mechanical rooms, electrical rooms and telephone closets on such floors, or (ii) for multiple tenancy floors, a pro-rata portion of all of the area covered by the elevator lobbies, corridors, special stairways, restrooms, mechanical rooms, electrical rooms and telephone closets on such floor; and (b) with respect to the Building, the total rentable area for all floors in the Building computed in accordance with the provisions of Subparagraph 1(a) above. In calculating the "Rentable Square Feet" of the Premises or the Building, the area contained within the exterior walls of the Building stairs, fire towers, vertical ducts, elevator shafts, flues, vents, stacks and major pipe shafts will be excluded.
