Pursuant to a Partial Consent Decree for Past Costs, entered by the 8 Court on October 20, 2000, the United States and DTSC recovered $5,125,000 as 9 reimbursement and settlement of claims for specified past response costs.
The Parties agree to and hereby do waive, release, covenant not to sue and forever discharge each other with respect to any and all claims for Past Costs, as well as any damages, claims, penalties and causes of action and/or allegations of liability, whether asserted or unasserted, that the Parties ever had, now have, or may have in the future arising out of or relating in any way to Past Costs, Prior Environmental Investigations or GE Response Activities.
The Past Costs Consent Decree also resolved, subject to AR’s reservations found in Paragraph 20 of the Past Costs Consent Decree, all counterclaims and most defenses asserted by AR against the United States in this action, and addressed related covenants and reservations for the “Remaining Sites” as defined in that Consent Decree.
Paragraph 20 of the Past Costs Consent Decree reserved certain specific counterclaims and defenses for AR relating to the BPSOU.
As to DOI’s Past Costs, Settling Defendants shall send a check in the amount of $30,000 payable to “United States Treasury” and delivered to the U.S. Attorney's Office, Eastern District of New York.
