Supplementary Labour definition

Supplementary Labour means the situation where a client hires Employees from the Employer to work under client direction and control to genuinely supplement or replace client Employees temporarily absent through authorised paid leave. This supplementary labour will be paid in accordance with the wage level for the classification requested by the client as contained in Appendix A, clause 2.3 of this Agreement.
Supplementary Labour means any contractor, labour hire agency employee, group training employee and/or any other person or entity who/which is not a direct employee of the Company; which will do, or does, work that would be covered by this Agreement if it was performed by the Employees.
Supplementary Labour is temporary ‘top up’ labour designed to meet short-term situations such as absences due to sick leave, annual leave, and short-term work peaks. The Employer will not contravene the sham contracting provisions of the Act. Where a labour hire employee or an employee of a sub-contractor subsequently commences employment with the Employer, the time worked for the contractor or labour hire firm shall count as time served in relation to the probationary period for the Employee, where the time is continuous. Where the Employer makes a definite decision that it intends to engage a 3rd party to perform work covered by this Agreement, the Employer shall notify the relevant Union Delegates and the Union within a reasonable time, of the: 22.7.1 name of the proposed 3rd party; 22.7.2 type of work proposed to be performed by the 3rd party; 22.7.3 likely commencement date of the proposed 3rd party;

  • Wages and conditions for Supplementary Labour will be regulated by the appropriate industrial instrument that is in place between the employer and its employees provided that the Company will ensure that persons engaged as Supplementary Labour receive wages and conditions that are no less than those provided by the applicable modern award.

  • The Company will consult and keep Workplace Representatives Delegates appropriately informed of work to be performed by Supplementary Labour.

  • There shall be not less than seventy percent directly engaged permanent (including full-time and part-time or fixed term) employees to thirty percent comprising of direct casual employees and indirectly engaged Supplementary Labour, when averaged over a three (3) month period across all Victorian sites and calculated on a ‘head count’ basis.
