SUSPENSION OF SUPPLIER'S APPOINTMENT. 31.1 If the Authority is entitled to terminate this Framework Agreement pursuant to Clause 30 (Authority Termination Rights), the Authority may instead elect in its sole discretion to suspend the Supplier's ability to accept Orders under this Framework Agreement by giving notice in writing to the Supplier, and the Supplier agrees that it shall not be entitled to enter into any new Call Off Agreement during the period specified in the Authority’s notice.
31.2 Any suspension under Clause 31.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Authority.
31.3 The Parties acknowledge that suspension shall not affect the Supplier's obligation to perform any existing Call Off Agreements concluded prior to the suspension notice.
31.4 If the Authority provides notice to the Supplier in accordance with this Clause 31.1, the Supplier's appointment under this Framework Agreement shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time.
31.5 For the avoidance of doubt, no period of suspension under this Clause 31 shall result in an extension of the Framework Period.
SUSPENSION OF SUPPLIER'S APPOINTMENT. 27.1 Without prejudice to the Authority's rights to terminate this Framework Agreement as set out in Clause 26 (Termination), or if the Authority reasonably believes that a Consistent Failure has occurred, the Authority may suspend the Supplier's appointment to provide Services to Contracting Bodies under this Framework Agreement by giving notice in writing to the Supplier which notice shall take immediate effect from the date specified in such notice and the Supplier agrees that it shall not be entitled to enter into any new Order during such suspension period.
27.2 Without in any way limiting the circumstances under which the Authority may suspend the Supplier’s appointment pursuant to Clause 27.1, the Authority shall be entitled to suspend the Supplier’s appointment to provide Services to Contracting Bodies under this Framework Agreement in any or all of the following instances:
27.2.1 The Supplier’s failure to provide the Authority within seven (7) Days of the Commencement Date, evidence that from the Commencement Date it has complied with Clause 30 (Insurance) of the Framework Agreement and has affected, with a reputable insurance company, the required public liability insurance, employer’s liability insurance and professional indemnity insurance (to a minimum limit of five (5) million pounds sterling (£5,000,000)) from the Commencement Date and shall maintain these insurances throughout the duration of the Framework Agreement; AND/OR
27.2.2 The Supplier’s failure to provide the Authority within seven (7) Days of the Commencement Date, evidence that from the Commencement Date it has complied in all respects with the Code of Practice for the International Recruitment of Healthcare Workers and shall maintain adherence throughout duration of the Framework Agreement
27.2.3 Where the Supplier’s failure to keep their supplier profile (as provided by the Authority to Contracting Bodies as a separate Schedule to the Framework Agreement) from the Commencement Date accurate at all times; AND/OR
27.2.4 Where the Supplier charges or attempts to charge prices above the Framework Price under any Call-Off Contract; AND/OR
27.2.5 Where the Supplier fails to comply with Clause 17.10 above.

24.2. Any suspension under Clause 24.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Authority.
24.3. The Parties acknowledge that suspension shall not affect the Supplier's obligation to perform any existing Call Off Agreements concluded prior to the suspension notice.

Any suspension under Clause 27.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Authority. The Parties acknowledge that suspension shall not affect the Supplier's obligation to perform any existing Call-off Agreements concluded prior to the suspension notice. If the Authority is entitled to terminate this Panel Agreement pursuant to Clause 33 (Authority Termination Rights), the Authority may instead elect in its sole discretion to suspend the Supplier’s ability to accept new Orders under this Panel Agreement by giving notice in writing to the Supplier, and the Supplier agrees that it shall not be entitled to enter into any new Legal Services Contract during the period specified in the Authority’s notice. Any suspension under Clause 34.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Authority. The Parties acknowledge that suspension shall not affect the Supplier’s obligation to perform any existing Legal Services Contracts concluded prior to the suspension notice. If the Authority serves notice to the Supplier in accordance with this Clause 34.1, the Supplier’s appointment under this Panel Agreement shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time. For the avoidance of doubt, no period of suspension under this Clause 34 shall result in an extension of the Panel Period.
SUSPENSION OF SUPPLIER'S APPOINTMENT. Without prejudice to the Authority's rights to terminate this Framework Agreement as set out in Clause 27 (Termination), if a right to terminate this Framework Agreement arises in accordance with Clause 27 (Termination), or if the Authority reasonably believes that a Consistent Failure has occurred, the Authority may suspend the Supplier’s appointment to provide Available Goods and Services to Contracting Bodies under this Framework Agreement by giving notice in writing to the Supplier. If the Authority provides notice to the Supplier in accordance with this Clause 28, the Supplier's appointment under this Framework Agreement shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time.
SUSPENSION OF SUPPLIER'S APPOINTMENT. Without prejudice to the Authority's rights to terminate this Framework Agreement, if a right for the Authority to terminate this Framework Agreement arises (irrespective of whether the circumstances leading to such right are capable of remedy) in accordance with Clause 25 of this Schedule 2, the Authority may suspend the Supplier's appointment to receive new Orders under this Framework Agreement by giving notice in writing to the Supplier and all Participating Authorities. If the Authority provides notice to the Supplier in accordance with Clause 27.1 of this Schedule 2, the Supplier's appointment shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time provided that such suspension shall be lifted where: the circumstances leading to the Authority’s right to terminate this Framework Agreement have been remedied; the Authority has satisfied itself that the risk and/or impact of the circumstances giving rise to the Authority’s right to terminate this Framework Agreement no longer requires such suspension; or the Authority exercises its rights to terminate this Framework Agreement in accordance with Clause 25 of this Schedule 2.
SUSPENSION OF SUPPLIER'S APPOINTMENT. 24.1 Without prejudice to the Authority's rights to terminate the Framework Agreement in Clause 23 above, if a right to terminate this Framework Agreement arises in accordance with Clause 23, the Authority may suspend the Supplier's appointment to supply Services to Contracting by giving notice in writing to the Supplier. If the Authority provides notice to the Supplier in accordance with this Clause 24, the Supplier's appointment shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time.
SUSPENSION OF SUPPLIER'S APPOINTMENT. 34.1 If the Authority is entitled to terminate this Dynamic Purchasing System Agreement pursuant to Clause 33 (Authority Termination Rights), the Authority may instead elect in its sole discretion to suspend the Supplier's ability to accept Orders under this Dynamic Purchasing System Agreement by giving notice in writing to the Supplier, and the Supplier agrees that it shall not be entitled to enter into any new Contract during the period specified in the Authority’s notice.
34.2 Any suspension under Clause 34.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Authority.
34.3 The Parties acknowledge that suspension shall not affect the Supplier's obligation to perform any existing Contracts concluded prior to the suspension notice.
34.4 If the Authority provides notice to the Supplier in accordance with this Clause 34.1, the Supplier's appointment under this Dynamic Purchasing System Agreement shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Authority in writing from time to time.
34.5 For the avoidance of doubt, no period of suspension under this Clause 34 shall result in an extension of the Dynamic Purchasing System Period.

If the Fund is entitled to terminate this Framework Agreement pursuant to Clause 288 (Authority Termination Rights), the Fund may instead elect in its sole discretion to suspend the Supplier's ability to accept Orders under this Framework Agreement by giving notice in writing to the Supplier, and the Supplier agrees that it shall not be entitled to enter into any new Call Off Agreement during the period specified in the Fund’s notice. Any suspension under Clause 29.1 shall be without prejudice to any right of termination which has already accrued, or subsequently accrues, to the Fund. The Parties acknowledge that suspension shall not affect the Supplier's obligation to perform any existing Call Off Agreements concluded prior to the suspension notice. If the Fund provides notice to the Supplier in accordance with this Clause 29.1, the Supplier's appointment under this Framework Agreement shall be suspended for the period set out in the notice or such other period notified to the Supplier by the Fund in writing from time to time.
