Advertising and Sponsorships. For all Club Home Games and for Special Events, Club shall have the exclusive right to sell and display advertising and sponsorship signage in and about the Ballpark and about the Premises. Club also shall have the exclusive right to sell all program and publication advertising for Club Home Games and Special Events. Club shall bear all expenses associated with advertising and sponsorships sold and displayed by or on behalf of Club including, without limitation, the cost of erection, maintenance, repair and replacement of all advertising and sponsorship signs and devices. Club shall have the right to install advertising and sponsorship signage throughout the Ballpark, provided, however, that all advertising and sponsorship signage sold or displayed shall be in good taste and consistent with the industry standards of minor league baseball and the goals of the City and Club to provide wholesome family entertainment through Club Home Games and Other Events held at the Ballpark.
Advertising and Sponsorships. A. Without the prior written approval of Licensor, which approval may be withheld in Licensor’s sole discretion, Licensee shall not permit any commercial banner (interior or exterior), signage, advertisement or promotional announcement to be posted or made within the Coliseum or adjacent grounds. Licensee shall not permit or contract for and sponsorship with or on behalf of any competitor or United States Cellular Corporation, Pepsi, or Coliseum exclusive partners.
B. Subject to the other provisions of this Section 8, Licensee shall have the right to sell Hockey and On-Ice Advertising for the Games. All revenues generated from the sale by Licensee of such Hockey and On-Ice Advertising shall be retained by Licensee, provided that all such sales shall be subject to the prior written approval of Licensor, with the exception of the U.S. Cellular Coliseum logo to be presented on the ice and on the video board. Licensor hereby retains the right to sell Hockey and On-Ice Advertising for the Home Games, for which Licensor shall receive a commission of ten percent (10%) on gross sales revenues from such sales. All remaining revenues shall be paid to Licensee at the time of settlement in accordance with Section 11 herein.
C. Licensee shall not sell or receive any sales proceeds from the sale of Coliseum Advertising.
D. Licensee understands that United States Cellular Corporation (“U.S. Cellular”) is the “Official Wireless Provider” of the Coliseum, and hereby agrees that Licensee May 23, 2011 119 shall not sell and Licensor expressly prohibits the sale of any advertising or sponsorship or co-sponsorship to any manufacturer, seller, distributor, or dealer of telecommunications services or telecommunications equipment, other than U.S. Cellular.
E. Licensee understands that Pepsi-Cola General Bottlers, Inc., d/b/a Pepsi Americas (“Pepsi”) is the “Official Soft Drink” provider of the Coliseum, and hereby agrees that Licensee shall not sell and Licensor expressly prohibits the sale of any advertising or sponsorship or co-sponsorship to any manufacturer, seller, distributor, or dealer of any non-alcoholic beverages, other than Pepsi.
F. All sponsorships of the Games presented pursuant to the provisions of this Agreement (including but not limited to, all advertising, publicity material, promotions material, press releases, posters, flyers, handbills and radio and television commercials) shall be submitted by Licensee to Licensor for its prior approval before use, which ap...
Advertising and Sponsorships. Customer acknowledges and accepts that BidPal owns and controls all the available Advertising Inventory as defined in Section (3)(g) and that BidPal has the right to display the logos and/or appropriate advertising on behalf of its National Advertisers as defined in Section (3)(h), and that no remuneration is due to Customer for display of such logos and advertising. BidPal grants to the Customer the right to sell a portion of the available Advertising Inventory to Advertising Sponsors. As defined in Section (3)(i), any such proceeds from sales to Advertising Sponsors is NOT considered part of BidPal Generated Proceeds and no fee will be due to BidPal from such transactions. Customer has the right to reject any National Advertiser if said National Advertiser is a competitor or is otherwise in conflict with an Advertising Sponsor.
Advertising and Sponsorships. Subject to Landlord’s right of rejection and cancellation set forth in Section 4.3 of this Lease, Tenant may sell or allow advertising and sponsorships inside the Stadium. The revenue from such advertising and sponsorships sold by Tenant shall be retained by Tenant. All costs related to installation of such advertising or construction of improvements to accommodate such advertising shall be borne by Tenant.
Advertising and Sponsorships. (a) InteliHealth may not sell advertising and sponsorships in connection with the Content distributed on the Customer Web Site. Customer may sell advertising and sponsorships in connection with the Content and will be solely responsible for managing and serving all advertising inventory.
(b) Customer agrees that all advertising and sponsorships (i) will comply with InteliHealth's standard advertising guidelines (Exhibit C) and (ii) that no advertising or sponsorships may be sold to companies which produce or distribute pornography, tobacco, firearms or alcohol.
(c) The parties agree to negotiate in good faith to reach a further agreement on appropriate advertising and sponsorship royalty split, if any. The failure to obtain such an agreement in the future shall not invalidate any part of this Agreement nor the parties' respective rights hereunder.
(d) Solely in connection with the good faith discussions between the parties set forth in Section 3(c) above, Customer agrees to provide InteliHealth usage information at least quarterly regarding pageviews and revenue information associated with the Content. The failure to provide such information shall not constitute a material breach of this Agreement.

Licensee will not permit any commercial banner, signage, advertisement, promotional announcement, or inflatables to cover or obscure any fixed permanent signage currently displayed outside or inside the Arena. Licensee will not permit the sale or distribution of helium balloons or other inflatable items, bumper stickers or any other items with adhesive surfaces at, in or near the Arena.
(2) Subject to the provisions of Subsection 5B (1) above, Licensee shall have the right to sell sponsorship for the Event. All revenues generated from the sale by Licensee of such sponsorship shall be retained by Licensee, provided that all such sales shall be subject to the prior written approval of Licensor.
(3) Licensor hereby retains the right to sell sponsorships for the Event (in addition to Licensee), for which Licensor shall receive a commission of twenty percent (20.0%) on gross sales revenues from such sales. All remaining revenues shall be paid to Licensee at the time of settlement in accordance with Subsection 6.C.
