Applications Software. As an individual, you are granted a world-wide non-exclusive license, which includes only the right to install, use, access, display, run, or otherwise interact with ("RUN") one copy of the SOFTWARE PRODUCT, or any prior version for the same operating system, on a single computer. If you are an entity, you are granted the right to designate one individual within your organization to have the right to use the SOFTWARE PRODUCT in the manner provided above.
Applications Software. ACE and the Eligible Recipients shall maintain Software currency for Applications Software or other Software for which ACE is financially responsible under this Agreement. Applications Software. The SOFTWARE PRODUCT may be used only by you, or be included in your product and delivered as a solution to your end users. You may install and use one copy of the SOFTWARE PRODUCT, or any prior version thereof for the same operating system, on a single computer but only for use in the number of written language(s) that you selected at time of first installation and in which you have acquired rights; provided that such use complies with all applicable laws. Applications Software. During the Term, OTI will be responsible for selecting or defining requirements for all Applications Software. IBM agrees to operate the Applications Software selected by OTI, provided such Applications Software conforms to the Operating Environment specified in Schedule K. OTI will also retain responsibility for maintenance, support and all license and related charges for Applications Software. OTI will be responsible to audit, control and approve new Applications Software prior to its promotion into production.

IBM represents and warrants that each Deliverable produced by Applications Software development projects undertaken by IBM, or for which IBM otherwise has responsibility for the successful completion as part of the Services, shall conform to the specifications or to such other criteria as agreed to by the parties (i.e., acceptance criteria).
