ARTICLE 4 - MANAGEMENT RIGHTS. The right to manage and conduct the business of the Board is vested exclusively with the Board and its administration save and except to the extent specifically modified by a provision of this agreement.
ARTICLE 4 - MANAGEMENT RIGHTS. The conduct of school administration, management and operation of its properties and facilities, and the direction of its working force are vested exclusively in the College. All functions, powers and authority, which the College has not specifically abridged or modified, by this Agreement, are retained by the College.
ARTICLE 4 - MANAGEMENT RIGHTS. The Union acknowledges that it is the right of the Company to hire, promote, demote, transfer, classify and suspend employees, and also the right of the Company to discipline or discharge any employee for cause, provided that a claim by an employee, who has acquired seniority, that he has been discharged or disciplined without reasonable cause shall be the subject of a grievance and dealt with as hereinafter provided.
ARTICLE 4 - MANAGEMENT RIGHTS. The Union recognizes that it is the function of the Employer to exercise all the regular and customary functions of management including direction of the working forces of the Employer, subject to the terms of this Agreement.
ARTICLE 4 - MANAGEMENT RIGHTS. 4.1 The Association recognizes that, subject to the provisions of the Police Services Act, the Comprehensive Ontario Police Services Act or the Community Safety and Policing Xxx 0000 as the case may be and the Regulations made thereunder by the Lieutenant Governor in Council, it is the exclusive function of the Board to:
4.1.1 Maintain order, discipline and efficiency;
4.1.2 Hire, discharge, direct, classify, transfer, promote, demote or suspend, or otherwise discipline any police member.
4.2 The Board agrees that no police member will be dealt with adversely without reasonable cause, and that it will exercise the functions outlined in Article 4.1.2 without discrimination and in a manner consistent with this Agreement, the Police Services Act, the Comprehensive Ontario Police Services Act or the Community Safety and Policing Xxx 0000 as the case may be and the Regulations made thereunder by the Lieutenant Governor in Council.
4.3 If a police member claims that the Board has exercised any of the functions outlined in Article 4.1 in violation of this Agreement, then such a claim may be the subject of a grievance under the provisions of the grievance procedure outlined in this Agreement, or the arbitration procedure set out in the Police Services Act, the Comprehensive Ontario Police Services Act or the Community Safety and Policing Xxx 0000 as the case may be, or dealt with under the procedures within the exclusive jurisdiction of the Ontario Civilian Police Commission as prescribed in the Police Services Act or the Comprehensive Ontario Police Services Act, as the case may be.
ARTICLE 4 - MANAGEMENT RIGHTS. The Union recognizes the Employer has the exclusive right to manage the business and to exercise all the customary prerogatives of management subject to the terms of this Agreement.
ARTICLE 4 - MANAGEMENT RIGHTS. The Union acknowledges that all Management rights are vested exclusively with the Company except as specifically limited by the provisions of the Agreement and, without limiting the generality of the foregoing it is the exclusive function of the Company:

ARTICLE 4 - MANAGEMENT RIGHTS. All rights, powers, and authority the Employer had prior to entering the collective bargaining agreement are retained by the Employer, except as expressly and specifically abridged, by the expressed provisions of this Agreement. The following rights of the Employer are not all- inclusive but, indicate some of the matters or rights, which belong to and are inherent to the Employer in its capacity as management.
ARTICLE 4 - MANAGEMENT RIGHTS. 401 The Union recognizes that the Employer has the duty and right to manage its facilities and to direct the working forces. This includes, for example, the right to hire, transfer, promote, demote, layoff, discipline and discharge Employees, subject to the terms of this Agreement and the grievance procedure.
