ARTICLE 4 - MANAGEMENT RIGHTS. 4.1 It is understood and agreed that the District retains all of its powers and authority to direct and control to the full extent of the law. Determine the times and hours of operation, including instructional times, determine the kinds and levels of services to be provided, and the methods and means of providing them, establish its educational programs, policies, goals and objectives. Insure the rights and educational opportunities of students, determine the curriculum, determine staffing patterns, determine assignments and reassignments, determine the number and kinds of personnel, maintain the efficiency of District operations, build, move, or modify facilities, establish budget procedures and determine budgetary allocation and determine methods of raising revenue. The District retains the right to establish and modify the instructional calendar for students. The District retains the right to schedule, reschedule, and cancel any and all classes and instructional programs and activities. The District retains the right to increase instructional minutes to meet state requirements. The District also retains the right to hire, classify, assign, direct, transfer, evaluate, promote, demote, layoff, recall, terminate and discipline employees, and to establish and modify policies and procedures for the conduct of employees. Nothing herein is to be construed as limiting the rights employees have under this agreement and the EERA.
