ASSAULT PAY. All employees in the titles of Bus Operator, Train Operator and Conductor shall be entitled to assault pay (“run pay”) for up to two years for injuries incurred on duty as a result of physical assaults. The assault pay consist of a differential payment which shall be sufficient to comprise, together with any Workers’ Compensation payable to him/her under the provision of the Workers’ Compensation Law the amount, after taxes, equal to his/her after tax wages for his/her scheduled working time at the time of the accident.

ASSAULT PAY. The parties agree that an employee required to lose time due to injuries received while in an unprovoked assault while on duty and engaged in the performance of his/her work shall receive the same pay that he/she would have received had he/she been regularly employed for the first one (I) to five (5) days of absence. Assault pay shall be determined by the employee's regularly scheduled assignment.
ASSAULT PAY. Whenever any operator of a bus covered by this Agreement becomes unable to perform his regular duties, through no fault of his own, by reason of injury intentionally inflicted upon him and arising out of, and in the course of his employment with the Agency, compensable under the Worker’s Compensation Law, the Agency will pay such employee a supplemental benefit equal to the difference between his normal weekly wage and the disability benefits to which he is entitled under said law, for a period of absence from work due to the same injury not exceeding fifty- two (52) weeks. Payments herein provided for shall be prorated when absence from work due to such injury is for partial weeks. The foregoing obligation of the Agency to pay such employee for absence from work due to such injury the foregoing supplemental benefits shall not be deemed to be the payment of wages to said employee within the meaning of Paragraph 3, Section 287.160 (Revised Statutes of Missouri, 1959) of the said Workers’ Compensation Law, and the Agency hereby waives and forgoes any right it may have under said law to claim credit therefore against any of the various disability benefit liabilities imposed upon it by said law in favor of such employee. The provisions of the Supplemental Agreement between the parties dated December, 1983, detailing the handling of sick leave and Workers’ Compensation claims shall be incorporated into this Agreement by reference and shall be applicable as if fully set forth herein.

  • Assault Leave Notwithstanding the provision of Section 3319.141 of the Ohio Revised Code, the employer will grant assault leave to cover employee absence due to disability resulting from assault under the following conditions. Any certified teacher who must be absent from his or her duties due to disability resulting from an assault which occurs in the course of an employee's Board employment, on or off school premises before, during or after school hours will be paid his or her full scheduled compensation for a maximum period of thirty (30) days. If permanently disabled, the teacher must apply for disability retirement and no assault leave shall be granted after such retirement has been approved. The period of such absence, as defined in this provision, shall be termed "assault leave." Before assault leave can be approved, the teacher shall furnish to the superintendent a written, signed statement describing the circumstances and events surrounding the assault, and the cause thereof, including the location and time of the assault, name and address of victims and witnesses and a description of the injuries sustained by each victim of the assault, unless physically impossible to do so. If medical attention is required or sought, the teacher shall also furnish to the Superintendent a statement of the nature of the disability and its duration, which has been signed by a physician licensed in the State of Ohio. Falsification of either the written, signed statement of the events or circumstances surrounding the assault, or the physician's statement shall be grounds for suspension or termination of employment under 3319.16 O.R.C. Assault leave, which is approved by the Superintendent, shall not be charged against sick leave earned or earnable by the teacher on leave granted under regulations adopted by the Board, pursuant to 3319.08 O.R.C. or any other leave to which the teacher is entitled. Assault leave benefits shall not be paid if Workers' Compensation benefits are paid to the teacher.

  • Thirty Day Payments Upon receipt of a billing statement that complies with all invoice requirements set forth in this Article, the State shall make a good faith effort to pay the amount which is due and payable within thirty (30) days.

  • Assault Any case of assault upon a teacher which occurs in the line of duty shall promptly be 20 rights and obligations with respect to such assault, and its legal assistance to the teacher in 21 connection with handling of the incident by law enforcement and judicial authorities. In such 22 event, the following shall apply:

  • Longer/Shorter Length of Coverage If none of the above rules determine the order of benefits, the benefits of the plan that covered a member or subscriber longer are determined before those of the plan that covered that person for the shorter term.

  • Bilingual Differential Pay Bilingual Differential Pay applies to those positions designated by the Department of Personnel Administration as eligible to receive bilingual pay according to the following standards:

  • Holiday Premium Pay A Nurse working on a recognized Holiday is entitled to the following compensation for any hours worked on the calendar date of the recognized Holiday:

  • Parental Leave Beyond Thirty Seven (37)

  • Shift Differential Pay A. An employee shall receive additional compensation at the rate of seventy five cents (75¢) per hour for all hours worked on a shift when the majority of hours worked on the shift are between 5:30 p.m. and 7:30 a.m. and in locations where these classes are regularly assigned shift work.

  • Weekend Premium Pay Any nurse who works on a weekend shall receive four dollars ($4.00) per hour premium pay for each hour worked on the weekend in addition to the nurse’s regular rate of pay. Weekend premium pay shall not be included in the nurse’s regular rate of pay for overtime pay calculations, unless required by the Fair Labor Standards Act. The weekend shall be defined as all hours between 11:00 p.m. Friday and 11:00 p. m. Sunday.

  • Overtime Premium Pay Time and one-half (1 1/2) the employee's straight time rate of pay shall be paid for all hours actually worked in excess of forty (40) hours in any one workweek.
