Authorized Use of Products. Customer acknowledges that the authorized use for each Software product set forth in this Section 12.0 is a form of Licensed Capacity. If Customer’s access and use of the Software exceeds its Licensed Capacity, Customer will be required to purchase additional licenses and Maintenance at Serena’s then-current list price.
Authorized Use of Products. Customer, the Institutions (if applicable) and Authorized Users may use the Products for Educational Purposes as follows: Analysis. Authorized Users shall be permitted to extract or use information contained in the Products for Educational Purposes, including, but not limited to, text and data mining, extraction and manipulation of information for the purposes of illustration, explanation, example, comment, criticism, teaching, research, or analysis. Course Packs. Customer, the Institutions and Authorized Users may use a Reasonable Amount of the Products in the preparation of course packs or other educational materials. Digital Copy. Customer, the Institutions and Authorized Users may download and digitally copy a Reasonable Amount of the Products. Display. Customer, the Institutions and Authorized Users shall have the right to electronically display the Products to the extent necessary to further the intent and purpose of this Agreement.
Authorized Use of Products. Products sold by Seller are intended solely for the use(s) specified by the manufacturer and are not to be used for any other purposes including, but not limited to, unauthorized commercial purposes. Buyer warrants and represents that it will properly test, use, qualify, and/or validate each Product for intended use, and, to the extent authorized, manufacture and market any final articles made from Seller’s Products in accordance with the practices of a reasonable person who is an expert in the field, and in strict compliance with all applicable national, state and local laws and regulations. Buyer acknowledges and understands that the purchase of Products only conveys to Buyer the non-transferable right for only the Buyer to use the Products purchased in compliance with the applicable manufacturer's Published Restricted User Statement, Limited User Statement, Limited License, if any. All such statements or licenses are incorporated by reference herein and in any Order as if set forth therein in their entirety. Buyer is solely responsible for conducting any research necessary to learn the hazards involved for any of its intended uses of the Products purchased from Seller and to properly warn its customers, employees and other personnel who may be exposed to such Products of any risks involved in using or handling the Products.
Authorized Use of Products. Except as expressly set forth in Section 11 in the case of Miltenyi OEM Reagents, the purchase of Products only conveys to Customer the non-transferable right to use the quantity of Products purchased solely for Customer’s internal research purposes and in compliance with any applicable intended use statement, limited use statement or limited label license specific to such Products. Except as expressly set forth in Section 11, no right to resell the Products, or any portion of them (including as components of other products), is conveyed.
