When any architects, engineers, construction managers or other professional consultants perform work in connection with this Agreement, Professional Liability Insurance covering damages caused by an error, omission or any negligent act must be maintained with limits of not less than $2,000,000 each occurrence and $2,000,000 general aggregate. Contractor must furnish to HPTE original Certificates of Insurance, or such similar evidence, to be in force on the Commencement Date, and Renewal Certificates of Insurance, or such similar evidence, if the coverages have an expiration or renewal date occurring during the term of this Agreement. Contractor must submit evidence of insurance prior to the execution of this Agreement. The receipt of any certificate does not constitute agreement by HPTE that the insurance requirements in this Agreement have been fully met or that the insurance policies indicated on the certificate are in compliance with all requirements of this Agreement. The failure of HPTE to obtain certificates or other insurance evidence from Contractor is not a waiver by HPTE of any requirements for Contractor to obtain and maintain the specified coverages.
