Availability Controls. Following processes are part of Data archiving
(a) Daily, weekly and monthly incremental backups are taken to avoid loss of data.
(b) 24×7×365 days of uninterrupted power supply is available at iDC.
(c) Data is protected against virus, Trojans, spywares and other malwares through host based antivirus and network based unified threat machine (@ Perimeter level).
(d) Emergency response plan is in place at iDC.
(e) Disaster recovery and Business continuity plans are in place.
Availability Controls. Our products are designed to ensure redundancy and seamless failover. The server instances that support the products are also architected with a goal to prevent single points of failure. This design assists our operations in maintaining and updating the product applications and backend while limiting downtime.
Availability Controls. Verint will maintain contingency planning policies and procedures defining roles and responsibilities on proper handling of contingency events. This shall include a business continuity and disaster recovery plan intended to facilitate the restoration of critical operations and processes which would allow for Verint’s continued performance of its obligations hereunder. Such plan shall be periodically reviewed, updated and tested by Verint.
Availability Controls. 7.9.1. Availability of the Service will be monitored based on specific Availability Tests performed by XXXX. The Availability Tests procedure is described in Annex 9 and takes into account the last received version of BSP’s nominations, and any unavailability resulting from a Forced Outage as per method described in Annex 17.
7.9.2. XXXX will verify that the power supplied (Psup_test) in reaction to an Availability Test requested by XXXX is at minimum equal to the BSP’s FCR Nominated Power for the Providing Group(s) and Service Types concerned. If this proves not to be the case according to calculations made as per Annex 9 XXXX will reduce the BSP’s remuneration as foreseen in Art. 9.1, taking into account the dispute resolutions mechanisms described in Art.10.4 & 10.3 and without prejudice to any liability of the BSP for the non-fulfillment of his obligations under Art. 4 of the General Conditions.
7.9.3. XXXX can request a Capacity Availability Test maximally 2 times per Delivery Period, Providing Group and Service Type. However, if results of one of the 2 Capacity Availability Tests are negative XXXX has the right to request another one.
7.9.4. XXXX can request an Energy Availability Test for each Providing Group and Service Type maximally:
Availability Controls. With respect to Hosted Subscription Services: • Cognyte shall maintain business continuity and disaster recovery plans specific to its Hosted Subscription Services, and shall include data center failover configurations. • Cognyte shall maintain a backup of all Customer Data that Cognyte is required to retain as a part of the Hosted Subscription Services. In the event Customer Data becomes destroyed or corrupt, Cognyte shall use commercially reasonable efforts to restore all available data from backup, and remediate and recover such corrupt data.

1.1 In the event Zapier receives an order from any government authority for compelled disclosure of Personal Information relating to your customers as part of Zapier’s provision of the Service under the Agreement, Zapier shall:
1.1.1 use every reasonable effort to redirect the government authority to request data directly from you;
1.1.2 promptly notify you of the request, unless prohibited under the law applicable to the requesting government authority or Zapier (and, if prohibited from notifying you, use reasonable lawful efforts to obtain the right to waive the prohibition in order to communicate as much information to you) as soon as possible; and
1.1.3 use reasonable lawful efforts to challenge the order for disclosure on the basis of any legal deficiencies under the laws of the requesting party or any relevant conflicts with the law of the European Union or applicable Member State law.
1.2 For purposes of paragraph 1.1 of this Exhibit, lawful efforts means exercising the degree of skill and care, diligence, prudence and foresight which would reasonably and ordinarily be expected from a provider engaged in a similar type of undertaking under the same or similar circumstances and shall not include actions that would result in civil or criminal penalty such as contempt of court under the laws of the relevant jurisdiction.
