BASIS FOR APPROVAL. The Committee shall have the right to disapprove an Application submitted to it in the event any part of the Application: (a) is not in accordance with this Declaration, the Sign Plan and any Design Guidelines or other requirements adopted by the Committee; or (b) is incomplete; or (c) is not in compliance with the applicable governmental approvals and regulations for the Center; or (d) is deemed by the Committee to be contrary to the best interests of the Center or the Owners; or (e) any combination of the foregoing. The Committee shall not unreasonably withhold its approval of an Application submitted to it, but may condition its approval on the satisfaction of one or more conditions set forth in writing. In this regard, the Committee may base its approval or disapproval on criteria which may include, but are not limited to, the following: (i) the adequacy of the building locations and dimensions on the Parcel; (ii) the adequacy of the parking to be provided; (iii) conformity and harmony of external design with neighboring structures; (iv) effect of location and proposed use of proposed Improvements on neighboring Parcels and the types of operations and uses thereof; (v) relation of topography, grade and finish ground elevation of the Parcel being improved to that of neighboring Parcels; (vi) proper facing of main elevation with respect to nearby streets and other buildings; (vii) adequacy of screening trash facilities and mechanical, air conditioning or other rooftop installations; (viii) adequacy of landscaping; and (ix) conformity of the Application to the purpose and general plan and intent of this Declaration. No Application shall be approved which does not provide for the underground installation of all utility services. The Committee may condition its approval of an Application on such changes therein as it deems appropriate such as, and without limitation, the approval of such Improvements by a holder of an easement which may be impaired thereby or upon approval of any such Improvements by the appropriate governmental entity. Any Committee approval conditioned upon the approval by a governmental entity shall not imply the Association is enforcing any government codes or regulations, nor shall the failure to make such conditional approval imply that any such governmental entity approval is not required.

BASIS FOR APPROVAL. The Approving Agent shall have the right to disapprove any plans and specifications submitted hereunder for any reason (provided that such approval shall not be unreasonably withheld), including but not limited to any of the following: A. Failure to comply with any of the Restrictions; B. Failure to include information in such plans and specifications as may have been reasonably requested by the Approving Agent; C. Objection to the exterior design of the proposed structures or the appearance of materials to be used in the construction of any proposed structure which are found by the Approving Agent to be incompatible with existing structures in the Oak Creek Business Park; D. Objections based upon the inadequacy of the number of onsite parking spaces considering (1) the contemplated use or future possible use of the structures proposed and (2) the availability of additional parking offsite. E. Objection to the location of any proposed structure upon any lot as it relates to other lots within the Oak Creek Business Park; F. Objection to the grading plan for any lot; G. Objection to the color scheme, finish, proportions, style or architecture, height, bulk or appropriateness of any structure as they relate to other structures within the Oak Creek Business Park; H. Objection to the landscaping materials as they relate to other landscaping materials then used or contemplated for use within the Oak Creek Business Park; I. Any other matter which, in the judgment of the Approving Agent, would render the proposed structure or structures or use inharmonious with the general plan for improvement of the Oak Creek Business Park or with structures or landscaping then located upon or proposed to be located upon other lots or other properties within the Oak Creek Business Park. 3.4 Approval: Upon approval by the Approving Agent of any plans and specifications submitted hereunder, a copy of such plans and specifications as approved shall be deposited for permanent record with the Approving Agent, and a copy of such plans and specifications bearing such approval, in writing, shall be returned to the applicant submitting the same.
BASIS FOR APPROVAL. Architectural Guidelines as may be amended from time to time to assist in the design and development of an individual Site within Valencia Industrial Center shall be made available from Declarant. Approval by Declarant of Plans and Specifications shall be based, among other things on Site plot plan dimensions, landscaped areas, and building design in conformity and harmony of external design with neighboring structures; effect of location and use of proposed improvements on neighboring Sites; the nature of improvements on neighboring Sites and the types of operations and uses thereof; relation of topography, grade and finish ground elevation of the Site being approved to that of neighboring Sites; proper facing of main elevation with respect to nearby streets and conformity of the plans and specifications to the purpose and general plan and intent of this DECLARATION. DECLARANT shall not arbitrarily or unreasonably withhold its approval of such plans and specifications.
BASIS FOR APPROVAL. Review and approval by the Committee must be based upon the standards set forth in this Declaration and in the Development Guidelines. The Committee shall consider not only the quality of the specific proposal but also its effect and impact upon neighboring Lots, the Entire Property, and the surrounding residential neighborhoods.
BASIS FOR APPROVAL. Approval shall be based, among other things, on adequacy of site dimensions, adequacy of structural design, conformity and harmony of external design with neighboring structures, effect of location and use of proposed improvements on neighboring sites, proper facing of main elevation with respect to nearby streets, adequacy of screening of mechanical air conditioning or other roof top installations, and conformity of the plans and specifications to the purpose and general plan and intent of this Declaration. No plans will be approve which do not provide for the underground installation of power, electrical, telephone and other utility lines from the property line to buildings. No plans will be approved which provide for buildings covering more than fifty percent (50%) of the lot areas. Grantor shall not arbitrarily or unreasonably withhold its approval of such plans and specifications. Grantor shall have the right to disapprove any plans and specifications submitted hereunder, including but not limited to any of the following: (1) Failure to comply with any of the Restrictions; (2) Failure to include information in such plans and specifications as may have been reasonably requested by Grantor; (3) Objection to the exterior design, appearance of materials of any proposed structure; (4) Objection on the ground of incompatibility of any proposed structure or use with existing structures or uses upon other lots or other properties in the vicinity; (5) Objection to the location of any proposed structure upon any lot with reference to other lots in the vicinity; (6) Objection to the grading plan for any lot; (7) Objection to the color scheme, finish, proportions, style or architecture, height, bulk or appropriateness of any structure; (8) Objection to the number or size of parking spaces, or to the design of the parking area; (9) Any other matter, which in the judgment of the Grantor, would render the proposed structure or structures or use inharmonious with the general plan for improvement of the property or with structures located upon other lots or other properties in the vicinity.

Based on the review of the Building 774 Final Safety Analysis Report (FSAR) and RFF0 reviews of documents listed In the AB Document List (ABDL) for Building 774. the DOE, RFFO concludes that the Building 774 AB adequately documents the operating safety basis and contains a control set that, when implemented, provides reasonable assurance that the work activities described in the Building 774 AB can be conducted by the Contractor without endangering the environment or the health and safety of the workers or public

Based on the Building 664 Final Safety Analysis Report (FSAR) Safety Evaluation Report approved on August 3,1995, the DOE, RFFO concludes that the Building 664 FSAR adequately documents the operating safety basis and contains a control set, that when implemented, provides reasonable assurance that the work activities described in the Building 664 FSAR can be conducted by the Contractor without endangering the environment or the health and safety of the workers or public.
