ARCHITECTURAL GUIDELINES. The Building Contractor undertakes that throughout the construction/erection of the improvements, he will not knowingly deviate from the provisions of the Guidelines or any further controls or instructions, which may be introduced, by the HOA or the Building Control Contractor and/or the panel of architects referred to in the Guidelines. Wherever the provisions of the Guidelines and/or this Agreement are contradictory and/or in conflict with the building contract concluded or to be concluded between the Owner and the Building Contractor for the construction/erection of the improvements, then the provisions of the Guidelines and/or this Agreement (as the case may be) shall prevail.

ARCHITECTURAL GUIDELINES. The CONTRACTOR undertakes that throughout the construction/erection of the IMPROVEMENTS he will not knowingly deviate from the provisions of the GUIDE or any further controls or instructions which may be introduced by the HOA and/or the committee referred to in the GUIDE. Wheresoever the provisions of the GUIDE and/or this AGREEMENT are contradictory and/or in conflict with the building contract concluded or to be concluded between the OWNER and the CONTRACTOR for the construction/erection of the IMPROVEMENTS, then the provisions of the GUIDE and/or this AGREEMENT (as the case may be) shall prevail.
ARCHITECTURAL GUIDELINES. The City acknowledges that the Owner/Developer has the exclusive right of architectural review regarding improvements and building upon the Property, which may be modified in the future at the discretion of Owner/Developer to meet market conditions. Any architectural guidelines must meet minimum standards set forth in the MZSO for architectural review. Owner/Developer shall be responsible for assuring such guidelines are in compliance with the Zoning Regulations.
ARCHITECTURAL GUIDELINES. The City acknowledges that the Owner, Developer, or a Secondary Developer has or will have an internal set of architectural guidelines and employs an architectural review board, which are to be adopted as provided in the PDD Standards. These architectural guidelines must meet the minimum standards set forth in the MZDO for architectural review. Owner, Developer and/or Secondary Developer shall be responsible for assuring such architectural guidelines are in compliance with the Zoning Regulations.

ARCHITECTURAL GUIDELINES. A. The multi-family elevations for the apartments, the clubhouse and the related accessory structures to be constructed on the Territory on Parcels 1, 2 and 6, and the permitted building materials, are attached hereto as EXHIBIT I (“Elevations”). The Village hereby approves said Elevations. Building permits for the apartments, the clubhouse and the related accessory structures to be constructed shall be issued without further zoning or hearing requirements. Incidental changes to the approved Elevations for the apartments are subject to review and approval by the Village’s Community Development Director and shall not require an amendment to the Final PUD Site Plan or hearing before the Plan Commission or Village Board or an amendment of this Amendment, provided said changes are consistent with the approved character and quality of the Elevations. If the Village Community Development Director finds that changes to the Final PUD Site Plan: (i) increase density; (ii) change circulation; (iii) change the mixture of dwelling types; (iv) change grading or utility provisions; (v) change the mixture of land uses; (vi) reduce the amount of common open space, landscaping or buffering; (vii) change the Elevations to alter rooflines, building materials, approved color schemes, or architectural style; or (viii) result in changes of similar scale, proportion or use not otherwise incidental, the Village Community Development Director shall so notify Owner in writing within thirty-five (35) days of its finding that changes are not considered incidental and designate such changes as either minor or major changes to a planned unit development as contemplated by the Zoning Ordinance. Minor changes to the Final PUD Site Plan shall be approved by the Village Board in accordance with the Zoning Ordinance without the review and recommendation of the Plan Commission. Major changes to the Final PUD Site Plan shall require a public hearing during a Plan Commission followed by Village approval, approval with conditions, or denial of the major change.
ARCHITECTURAL GUIDELINES. Owner hereby agrees that the primary siding material for all dwelling units and the clubhouse to be constructed within the development shall consist of hardy siding or similar product. Other exterior features or accents such as windows, door, shutters, gutters, downspouts, soffits, and the like may be constructed of wood, vinyl, aluminum, masonry or similar materials. The Village hereby approves the package of materials titled “Building Floor Plans and Elevationsa copy of which is attached hereto as EXHIBIT “K”. The Building Floor Plans and Elevations may be updated, modified or supplemented at Owner’s discretion provided that: (a) any changes to the approved Building Floor Plans and Elevations or any new floor plans and elevations that are consistent with the approved building materials and the character of the approved elevations may be approved by Village staff; or (b) any changes to approved Building Floor Plans and Elevations or any new floor plans and elevations which deviate from the building material standards set forth herein or which are not consistent with the character of the approved elevations shall require approval of the Village Board. The Village’s Development Services Director shall determine whether any change or new elevation (a) deviates from the approved Building Floor Plans and Elevations; and (b) is consistent with the character of the approved Building Floor Plans and Elevations.

ARCHITECTURAL GUIDELINES. Owners shall comply with the following architectural guidelines: The single-family elevations and permitted building materials are attached hereto as EXHIBIT L (“Elevations”). The Village hereby approves said Elevations. Permitted exterior materials, include, but are not limited to, masonry, vinyl siding, and aluminum soffit and facia. Additionally, should Owner propose any changes to said Elevations or seek to add additional permitted elevations at any time in the future, said additional elevations are subject to review and approval by Village’s community development director, provided said additional elevations are of a consistent character to the approved Elevations, and which approval shall not be unreasonably denied. Changes to the approved Elevations and approval of additional elevations shall not require an amendment to the Final Plans of PUD, amendment of this Agreement, or Planning and Zoning Commission or Village Board approval. In the event that such additional elevations are not approved by the Village’s community development director, then the approval of such additional elevations shall be undertaken by Owner as a minor change to the PUD with no public hearing requirement.

Wherever the provisions of the GUIDELINES and/or this AGREEMENT are contradictory and/or in conflict with the building contract concluded or to be concluded between the OWNER and the BUILDING CONTRACTOR for the construction/erection of the IMPROVEMENTS, then the provisions of the GUIDELINES and/or this AGREEMENT (as the case may be) shall prevail.
