Bidders Responsibility. Bidders shall assume all responsibility for conditions that may exist at the site of the proposed Work and adjacent premises, including approach and access to the sites, and shall assume all responsibility for delivering and handling of materials at the site, and for all difficulties involved in the completion of all Work ordered under this Contract in accordance with its requirements. Bidders shall examine the Contract Documents and shall exercise their own judgment as to the nature and amount of the whole of the Work to be done, and for the bid prices must assume all risk by variance, by whomsoever made, in any computation or statement of amounts or quantities necessary to fully complete the Work in strict compliance with the Contract Documents. No plea of ignorance of conditions that exist or that may hereafter exist, or of conditions or difficulties that may be encountered in the execution of the Work under this Contract will be accepted as an excuse for any failure or omission on the part of the Contractor to fulfill, in every detail, all of the requirements of the Contract documents, or will be accepted as a basis for any claims whatsoever for extra compensation or for an extension of time. The Bidder is expected to fully acquaint themselves with the conditions, requirements and specifications of the Gauteng Department of Education before submitting a completed response. Failure to do so will be at the Bidder’s own risk and the Bidder cannot secure relief on the grounds of any mistake. • The selected Bidder will be required to enter into a written agreement with Gauteng Department of Education. This RFP or any part thereof may be incorporated into and made part of such an agreement. No pleas of ignorance relating to any data, conditions or requirements that exist or that may be encountered under this contract will be accepted as a result of failure or omission on the part of the FSMC to fulfill in every respect all the requirements, nor will the same be accepted as a basis for any claim whatsoever for extra charges for food services.

Prior to the submission of Bids, each Bidder will have inspected the Town site of the proposed work, all road and traffic conditions, and adjacent areas and with due consideration to seasonal and extraordinary weather conditions, and to have read and to be thoroughly familiar with the Contract Documents. The failure or omission of any Bidder to receive or examine any form, instrument or document, shall in no way relieve any Bidder from any obligation in respect to his Bid. In particular Bidder understands that some or all of the areas and residents within the District including those serviced by Homeowners Association's may not be provided services at some or all times during the Term of the Contract, and any option or renewal Terms. The Town Board's decision will be based upon whether or not and to the extent the Homeowners Association contract with its present hauler is a valid and enforceable contract and shall include consideration of whether or not such contract has been entered into or renewed after the date of the resolution establishing and public announcement of mandatory residential services within the District, and/or whether any such contract can be legally terminated or may be enforceable as against or subject such Homeowners Association to a legally enforceable claim for damages, it however being the intent of the Town to mandate District provided service to all residential Units within one to three family homes in the District and to preempt, supersede and/or nullify any such contract that as a matter of law or otherwise is or can be so preempted, superseded or nullified.
Bidders Responsibility. 2.1 Each bidder shall become familiar with the certifications and Form of Bid in the Bid Factors page located on the ebusiness system, the attached advertisement, instructions, specification, drawings, bond and agreement, hereinafter referred to as "bid documents," as each bidder will be held responsible to fully comply therewith. By electronically submitting a bid, the bidder acknowledges that it has carefully examined the bid documents and the worksite and satisfied itself as to the conditions affecting the work.

Each bidder shall be solely responsible to ascertain that the bid was successfully transmitted to the Port Authority at or before the advertised time for submission of bids. Confirmation of successful bid transmission will be in the form of electronic mail sent automatically to the contractor upon successful completion of the bid on the Port Authority’s ebusiness website.
2.3 Port Authority is exempt from Federal Excise Tax and Pennsylvania Sales Tax. Exemption certificates will be submitted upon request to the successful bidder.

2.5 Execution of bid:
1) In lieu of a traditional hand written signature for execution of the Form of Bid and the required certifications, each Bidder shall electronically indicate a response and corresponding acknowledgment to the Bid Factors which can be found in the Sourcing Module of the ebusiness system located at the following web address: ▇▇▇▇://▇▇▇▇▇▇▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇. These questions shall be found in the “Event Questions” section which is under “Step One” of the Events Details screen. By completing the required fields and corresponding acknowledgments and certifications, each Bidder shall be deemed to have electronically signed the bid documents in accordance with the applicable provisions of the Electronic Signatures in Global Commerce and National Commerce Act (E-SIGN Act), 15 U.S.C. §§ 7001-7006.
