Handling of Materials. Materials of NJNG reviewed by Marketer in the course of the audit, shall be deemed confidential and shall be treated in accordance with the provisions of Article VIII of this Agreement. The use of audit materials by Marketer shall be limited to the conduct of the audit and the preparation of a report for appropriate distribution by Marketer to those within its organization who need to know the results of the audit and who are contractually obligated to treat such report and the information it contains confidential.

Handling of Materials. 14.1 No lead is payable on water for works done under any section of DSR or for the work done under any Non Scheduled Item (NSI) Rate.
14.2 If foodgrains/ goods stored in the Warehouse are lost, stolen or damaged during execution of construction work by the contractor or his labourers, the cost of the same @ twice of the prevailing market rate will be recovered from the Contractor's dues and Contractor will have no claim whatsoever on this account.
14.3 During execution of work, if CWC materials(i.e., cables and pipelines, drains etc, are damaged then same will be set right by contractor at his cost within a reasonable time as decided by the Engineer-in- charge. In case contractor fails to rectify the damages caused during construction/ under their custody, the cost of the damaged material shall be recovered from the contractor @twice of prevailing market from the contractor dues/ bills and contractor will not have any claim whatsoever on this account.
14.4 The contractor shall consult the Engineer-in-Charge in writing regarding collection and stacking of materials required for the work. He should not stack materials at any places other than those approved by the Engineer-in-Charge. No excavated earth or building material shall be stacked on area where other buildings roads, services or compound wall are to be constructed.
Handling of Materials. A. All materials shall be properly protected so that no damage or deterioration will occur during a prolonged delay from time of initial work until the project is completed.

15.3 The prefabrication of all bends with a nominal diameter of two and one-half (2-1/2) inches or less; the attaching and assembling of all pipe fittings and valves, whether welded, screwed, flanged or any other method of joining, shall be performed in the field or U.A. Shop subject to the following paragraphs:
15.4 There shall be no restriction on the use of machinery, tools or appliances used in connection with the installation of work coming under the jurisdiction of the United Association, provided that, if power pipe cutting and threading machines are used on the job or in the shop of a Union Employer, all pipe sizes shall be cut and threaded on the job or in the shop of a U.A. signatory Employer. All power pipe machines shall be operated by journeypersons or apprentice members of the Union., unless the Union Business Representative has cleared the work to be fabricated at some other designated place under the direct supervision of a member of the United Association.
15.5 The prefabrication of pipe formations two and one-half (2-1/2) inches and over in diameter, all lap joint work and refacing of flanges may be performed at the site of the job or in the plant of the Employer employing Building Trades Journeyperson members of the United Association at the prevailing building construction wage rates in effect wherever the Employer's plant may be situated. Pipe formations two (2) inches and under shall be fabricated by Building Trades Journeypersons of Local 170, except where such pipe formations are part of a module or package unit and such module or package unit is U.A. made or as agreed by the Joint Conference Board.

Handling of Materials. Operator shall arrange for the proper ---------------------- collection, removal and disposal of any Hazardous Materials furnished, used, applied, generated or stored at the Site by Operator or Subcontractor(s) or emanating from the Site as a result of Work at the Site, including MEA and other process chemicals used in the Facility's carbon dioxide recovery process and used oils, greases, and solvents from flushing and cleaning processes performed under this Agreement. All activities in connection with the foregoing shall be performed in accordance with all Governmental Requirements. All costs associated with the transporting and disposing of Hazardous Materials introduced on the Site by Operator during performance of the Work shall be paid by Operator pursuant to the provisions of Article 3.4, subject to the reimbursement of costs with respect to the same provided in Article 5.
Handling of Materials. The Company and the Partnership have generated, transported, stored, handled, disposed of or contracted for the disposal of hazardous materials only in accordance with all Environmental and Safety Requirements. To the Knowledge of the Company, no employee of the Company has, in the course and scope of employment with the Company or the Partnership, been exposed to any hazardous materials in such a manner as to be materially harmed thereby (whether such harm is now known to exist or will be discovered in the future). The Company and the Partnership are not listed as a potentially responsible party under CERCLA or any comparable or similar federal or state statute, and neither the Company nor any of its Affiliates has received notice of such listing and no Knowledge of any facts or circumstances which could give rise to such a listing. As used in this Section 3.12, "hazardous materials" means the storage, transportation, disposal or treatment of hazardous materials, as defined and regulated by applicable Environmental and Safety Requirements.
Handling of Materials. The Contractor shall make their own arrangements for the handling of materials. The Owner will not accept deliveries for or sign for Contractor's equipment. This will be the sole responsibility of the Contractor. The Contractor shall make arrangements for unloading equipment delivered to the site as purchased by the Owner for installation by this Contractor. The Contractor shall accept and sign for deliveries of all Owner-purchased, Contractor-installed equipment.
Handling of Materials. Contractor and City acknowledge the importance of substantial improvement in the rate of diversion by commercial/industrial customers. To address this issue, Contractor agrees to do the following: • Establish a recycling system to sort recyclable materials at the customer's site or sort, either through its own facilities or through a third- party processor, commercial waste generated within the City; and • Establish a system to sort for recycling diversion, either through its own facilities or a third-party processor, construction and demolition debris generated within the city and handled by Contractor. This system shall include, but not be limited to, providing generators with the ability to sort their debris on the construction site and for materials not separated at the site but handled by Contractor to be sorted for recyclable content after collection. Upon agreement by both parties, such programs may be modified from time to time to reflect changes in solid waste regulations, market conditions and technologies. City and grantee agree to negotiate in good faith all rates for C&D and commercial waste processing costs. Both of these systems are to be operational by July 1, 2022
