Common use of Call Back/Call In Clause in Contracts

Call Back/Call In. (a) Where employees are called back to work after having completed a regular shift and prior to the commencement of their next regular shift they shall receive a minimum of four (4) hours of work or four (4) hours pay at the rate of time and one-half their regular earnings. Where call back is immediately prior to the commencement of their regular shift the call back will only apply to the point of commencement of a regular shift at the rate of time and one-half after which they shall revert back to the regular shift. (b) Call back pay shall cover all calls within the minimum four (4) hour period provided for under (a). If a second call takes place after four (4) hours have elapsed from the time of the first call, it shall be subject to a second call back premium, but in no case shall an employee collect two call back premiums within one such four (4) hour period, and to the extent that a call back overlaps and extends into the hours of his/her regular shift, (a) shall apply. (c) Notwithstanding the foregoing an employee who has worked his/her full shift on a holiday and is called back shall receive the greater of 2-1/2 times his/her regular straight time hourly rate for all hours worked on such call-back or four (4) hours pay at time and one-half his straight time hourly rate, subject to the other provisions set out above.
