Chemical Waste. For those processes which generate chemical waste, it may be possible to find alternatives which generate reduced quantities or even no chemical waste, or less dangerous types of chemical waste. Moreover, the Contractor should register with EPD as a Chemical Waste Producer. Chemical waste that is produced should be handled in accordance with the Code of Practice on the Packaging, Labelling and Storage of Chemical Wastes as follows: ⚫ Containers used for the storage of chemical waste should: - Be suitable for the substance they are holding, resistant to corrosion, maintained in good condition, and securely closed; - Have a capacity of less than 450 litres unless the specifications have been approved by the EPD; and; - Display a label in English and Chinese in accordance with instructions prescribed in Schedule 2 of the Regulation ⚫ The storage area for chemical waste should: - Be clearly labelled and used solely for the storage of chemical waste; - Be enclosed on at least 3 sides; - Have an impermeable floor and bunding, of capacity to accommodate 110% of the volume of the largest container or 20% by volume of the chemical waste stored in that area, whichever is the greatest; - Have adequate ventilation; - Be covered to prevent rainfall entering (water collected within the bund must be tested and disposed as chemical waste if necessary); and - Be arranged so that incompatible materials are adequately separated. ⚫ Disposal of chemical waste should: - Be via a licensed waste collector; and - Be a facility licensed to receive chemical waste, such as the Chemical Waste Treatment Facility which also offers a chemical waste collection service and can supply the necessary storage containers; or - Be to a re-user of the waste, under approval from the EPD. 14 5.1 5.1 5.1 General Refuse General refuse should be stored in enclosed bins or compaction units separate from chemical wastes. A reputable waste collector should be employed by the contractor to remove general refuse from the site, on a daily or every second day basis to minimize odour, pest and litter impacts. Chemical Waste. Chemical waste shall be stored in corrosion resistant containers, removed from the Site, and disposed of not less frequently than monthly unless more frequently required by Laws, including without limitation hazardous materials laws, or by the Supplementary General Conditions or Specifications. Disposal of chemical waste shall be performed in accordance with requirements of the U.S. Environmental Protection Agency (EPA) and the Massachusetts Department of Environmental Protection (DEP). Fueling and lubricating of vehicles and equipment shall be conducted in a manner that affords the maximum protection against spills and evaporation. Lubricants shall be disposed of in accordance with procedures meeting all applicable Laws. The Contractor shall immediately notify the Designer of any hazardous materials release large enough to require reporting under applicable Laws. The Contractor shall be responsible for immediately cleaning up in accordance with Laws any oil or hazardous materials releases resulting from its operations. Any costs incurred in cleaning up any such releases shall be borne by the Contractor.

Chemical Waste. Tenant agrees that Tenant shall not pour or otherwise dispose of any chemical, chemical waste, chemical by-products, or other such material, through the drainage (plumbing) system of the Demised Premises other than customary cleaning fluids. This covenant by Tenant is a material inducement to Landlord to enter into this Lease, and without such inducement, Tenant acknowledges that Landlord would not have entered into this Lease agreement. Accordingly, Tenant’s breach of this agreement shall be deemed a material default under this Lease, entitling Landlord to exercise any and all of its rights for Tenant’s default.

Should chemical wastes be produced at the construction site, the Contractor would be required to register with EPD as a Chemical Waste Producer and to follow the guidelines stated in the Code of Practice on the Packaging, Labelling and Storage of Chemical Wastes. Good quality containers compatible with the chemical wastes should be used, and incompatible chemicals should be stored separately. Appropriate labels should be securely attached on each chemical waste container indicating the corresponding chemical characteristics of the chemical waste (such as explosive, flammable, oxidizing, irritant, toxic, harmful, or corrosive). The Contractor should employ a licensed collector to transport and dispose of the chemical wastes, to either the CWTC in Tsing Yi, or any other licensed facilities, in accordance with the Waste Disposal (Chemical Waste) (General) Regulation.
