City Equipment. Tenant shall have the non-exclusive right to use the “City Equipment” as provided in this Agreement, meaning equipment that City provides for washing cars in the Car Wash License Area. City reserves the right to add additional City-owned common use systems or equipment to the City Equipment (or to delete any of the same) upon delivering written notice of such addition or deletion to Tenant and to charge a fee in connection with any such additional equipment. Tenant shall comply with all City requirements in connection with the City Equipment.
City Equipment. Manager shall exercise general supervision and responsibility for the proper use and care of all equipment and furniture owned by City located in the clubhouse. Such property shall be maintained specifically for the use and convenience of all public users of the clubhouse. An inventory of this property, as taken by a representative of each of the parties, is marked Exhibit "A" and attached hereto and made a part hereof
City Equipment. At the time of layoff and prior to final payment, all records, assets, and other items of City property in the employee's custody shall be transferred to the Fire Chief and certification to this effect shall be executed by the Fire Chief. Any amount due the City because of a shortage in the above as a result of a loan or advance for compatible computer equipment or other city/employee participation program shall be withheld from the employee's final compensation unless collected through other appropriate action, such as a pre-arranged method of payment.
City Equipment. City equipment or resources shall not be used in outside employment, and a member cannot be a contractor or subcontractor on City projects, unless an exception is granted by the City.
City Equipment. City owned equipment, if acquired during the Term of this Agreement, shall be used only for City purposes in performance of this Agreement, and shall not be used for any purely corporate, non-governmental Contractor business or personal purposes. City shall maintain required insurance for the City owned equipment.
City Equipment. The Municipality shall supply furniture, fixtures, and equipment for all City Hall offices and full-time office-based Consultant Personnel. Equipment includes those items customarily supplied to office staff such as chairs, computers, phones and office supplies (“City Equipment”). If the Municipality’s failure to provide or maintain equipment impacts the Consultant’s ability to deliver the Services, the Municipality shall grant relief from the performance targets associated with Key Performance Indicators and Performance Measures directly impacted by the Municipality’s failure provided that notice of Municipality’s failure is provided to the City Manager and a reasonable time to cure the failure is provided. For purposes of this section, “reasonable time” shall be fifteen (15) business days except when the failure affects the public health, safety or welfare, in which case reasonable time may be less than fifteen (15) business days. 9.4.1. All City Equipment shall be used only for Municipality purposes in performance of this Agreement and pursuant to City policies, and shall not be used for any purely corporate, other municipality Consultant business, non-governmental Consultant business, or personal purpose. All City Equipment utilized by Consultant Personnel shall be kept clean, free of damages, and in safe operating condition.

Any amount due because of a shortage in the above shall be collected through appropriate legal action if not voluntarily paid by the employee.
City Equipment. The CITY, or its agent, may provide, install, maintain, repair, operate and control the CITY’s equipment including but not limited to fiber, conduit, manholes, hand holes, ducts, electrical and optical equipment (“CITY’s Equipment”). CITY’s Equipment shall remain the sole and exclusive property of the CITY, and nothing contained herein shall give or convey to Customer, or any other person, any right, title, or interest whatsoever in the CITY’s Equipment, notwithstanding that it may be, or become, attached to, or embedded in, realty. Customer shall not tamper with, remove, or conceal any identifying plates, tags or labels identifying the CITYS’s ownership interest in the CITY’s Equipment. Customer shall not adjust, align, attempt to repair, relocate, or remove the CITY’s Equipment, except as expressly authorized in writing by the CITY. Customer shall be liable for any loss of or damage to the CITY’s Equipment caused by Customer’s negligence, intentional acts, or unauthorized maintenance and shall reimburse the CITY for the same, within thirty (30) days after receipt by ▇▇▇▇▇▇▇▇ of a request for reimbursement.

If Consultant Personnel requires a phone, smart device, tablet, etc. in order to accomplish the Services of this Agreement, the Consultant is expected to provide such equipment to the Consultant Personnel directly. The Consultant is required to comply with all open records and Information Technology Department security requirements associated with data and usage of such equipment.
City Equipment. Notwithstanding the foregoing, all equipment located at the Premises as of December 31, 2009 which is owned by the City (“City Equipment”) shall be available to the Foundation for use at the Premises during the Term at no cost to the Foundation. The City and Foundation will update the inventory of City Equipment, prepared as of December 31, 2007, within forty-five (45) days of the Commencement Date. The Foundation will provide the appropriate insurance for such City Equipment in accordance with Article 8 (Insurance) below.
