Communication of Requests. 1. Requests for assistance under this Agreement shall be exchanged directly between the customs administrations of the Contracting Parties. 2. Requests for assistance shall be made in English in writing or electronically, and shall be accompanied by any information deemed useful for the purpose of complying with such requests. The requested administration may require written confirmation of electronic requests. Where the circumstances so require, requests may be made verbally. Such requests shall be confirmed as soon as possible either in writing, or, if acceptable to both customs administrations, by electronic means. 3. Requests made pursuant to paragraph 1 of this Article, shall include the following details: (a) the name of the requesting administration; (b) the name of the requested administration; (c) reference to this Agreement; (d) the matter at issue, type of assistance requested, and reasons for the request; (e) a brief description of the case under review and the legal and administrative provisions that apply; and (f) the names and addresses of the persons to whom the request relates, if known. 4. Where the requesting administration requests that a certain procedure or methodology be followed, the requested administration shall comply with such a request subject to the domestic law in force in its country and administrative provisions. 5. The information referred to in this Agreement shall be communicated to officials who are specially designated for this purpose by the customs administrations of the Contracting Parties. A list of officials so designated shall be supplied to the customs administration of the other Contracting Party.

Each Customs administration shall designate a contact point for this purpose and communicate the details of the contact point to the other Customs administrations. 2. Requests for assistance shall be made in writing or electronically, and shall be accompanied by any information deemed useful to comply with the request. The requested administration may require written confirmation of electronic requests. Where the circumstances so require, requests may be made orally. Such requests shall be confirmed as soon as possible either in writing or, if acceptable to both Customs administrations, by electronic means. Requests shall be made in the Portuguese or Spanish languages to MERCOSUR and in the English language to SACU. 3. Requests made pursuant to paragraph 2, shall include the following details: (a) the name of the requesting administration and the name of the national point of contact; (b) the subject matter, the type of assistance requested and reasons for the request; (c) a brief description of the subject matter and applicable legal and administrative provisions that apply; (d) the names and addresses of the persons involved in the request if known; and (e) other available information to enable the requested administration to effectively comply with the request.

When required because of the urgency of the situation, oral requests may also be accepted, but shall be promptly confirmed in writing. 2. Requests pursuant to paragraph 1 of this Article shall include the following details: - the authority making the request; - the nature of the proceedings; - the object of and the reasons for the request; - indications as exact and comprehensive as possible on the natural or legal persons involved in the investigations; - a brief description of the matter under consideration and the legal elements involved; and - the connection between the assistance sought and the matter to which it relates. 3. Assistance shall be carried out by direct communication between the central Customs Authorities or via liaison officers. 4. In case the Customs Authority of the requested Contracting Party is not the appropriate authority to comply with a request, it shall, after appropriate consultation, either promptly transmit the request to the appropriate authority, who shall act upon the request according to its powers under the law, or advise the requesting authority of the appropriate procedure to be followed regarding such a request.

The information referred to in the Agreement shall be communicated to designated officials within the central co-ordination units of each customs administration. A list of officials so designated shall be furnished to the customs administration of the other Party.

A list of officials so designated shall be furnished to the customs administration of the other Party.

The ordering of precautionary measures need not be affected thereby. Assistance shall be carried out by direct communication between the respective Customs Authorities.

For the purposes of this Agreement, the Customs Administrations shall designate the officials responsible for communication and shall exchange the lists of the contact details of the officials so designated between the Customs Administrations. Any changes to the lists shall be communicated between the Customs Administrations without delay.

Where the requesting administration requests that a certain procedure or methodology be followed, the requested administration shall comply with such a request, subject to its domestic law and administrative provisions.
