COSTS OF IMPROVEMENTS. In the event the Tenant/Buyer exercises the option to purchase set forth in paragraph (4), above, and through no fault of the Tenant/Buyer, the Landlord/Seller fails to convey said property to Tenant/Buyer In accordance with the terms of this Lease/Option, the Tenant/Buyer, in addition to any other rights which Tenant/Buyer may have in law or equity for the enforcement of Tenant/Buyer's option to purchase, shall be entitled to reimbursement for the cost of all repairs, maintenance and improvements.

COSTS OF IMPROVEMENTS. If the Landlord shall at any time during the Term effect any structural alterations or any alterations or additions to the water, gas, electrical, plumbing or fire equipment or other services or appurtenances to the Premises which may be required by reason of any future statute, regulation, ordinance or by-law of the Authorities arising from or relating to the Tenant's use or requirements, then the cost of such improvements with interest to be calculated at the time payments are due shall be paid by the Tenant to the Landlord, Provided that the Tenant is duly informed of the aforesaid works and the costs in respect thereof before the Landlord commences any such works.

COSTS OF IMPROVEMENTS. All required improvements shall be made by the applicant at his expense. Any provisions for reimbursement by the governing body or any utility agency shall be stipulated clearly in the provisions of any surety instruments and shall be supported by certified resolution or ordinance of such governing body or agency.
COSTS OF IMPROVEMENTS a. Licensee shall pay all costs and expenses required for the installation of bus shelters pursuant to this Agreement, including, but not limited to the following: i. The design, construction, maintenance, and removal of the shelters; ii. The restoration to the proper condition, as defined by the City, of sidewalks, curbs, or streets which may be disturbed during the construction, maintenance, or removal of the shelters; and iii. Electrical energy supplied to the shelters.
COSTS OF IMPROVEMENTS. Team has been alerted to the requirements of California Labor Code section 1770, et seq., which require the payment of prevailing wage rates and the performance of other requirements if it is determined that improvements made to the Property related to this Agreement constitute public works. It shall be the sole responsibility of team to determine whether to pay prevailing wages for any or all work required by this Agreement. As a material part of this Agreement, team agree to assume all risk of liability arising from any decision not to pay prevailing wages for work related to this Agreement.
COSTS OF IMPROVEMENTS. An itemized estimate of the costs of the Facilities which have been approved by the City Engineer is attached hereto as Exhibit D. Within one hundred twenty (120) days of the completion of the Facilities, the Owner must submit the total cost of the Facilities to the City. This information must be used by the City as the basis for determining reimbursement by future users who benefit from the Facilities but who did not contribute to the original cost of the water or sewer facility. In the event that the reimbursement fees shall be recalculated by the City Engineer using actual cost figures an amended schedule of fees shall be recorded by the City without the necessity for further agreement by the Owner. Owner agrees that actual costs approved by the City shall not result in recalculation of the fees.

COSTS OF IMPROVEMENTS. An itemized estimate of the costs of improvements which has been approved by the Director of Public Works is attached hereto as Exhibit D. Owner shall provide to the Director of Public Works documentation of the actual total costs of construction no later than thirty (30) days after completion of the improvements. In the event that the actual costs are less than the estimated costs by 10% or more, the reimbursement fees shall be recalculated by the Director of Public Works using actual cost figures and an amended schedule of fees shall be recorded by the City without the necessity for further agreement by the Owner. Owner agrees that actual costs approved by the City shall not result in recalculation of the fees.
COSTS OF IMPROVEMENTS. The Parties anticipate that the total project cost of the Exit 3 Improvements is approximately $82,000,000.
COSTS OF IMPROVEMENTS. All costs in connection with any improvements to the Premises required by Licensee and approved by Licensor shall be borne by Licensee. Licensee may remove any such improvements at its cost and expense upon the expiration of the Term, provided it restores any damages to the Premises.
