Definition of Costs. 1. For the purpose of apportioning assessments by the District to the member towns, costs shall be divided into two categories: operating costs and capital costs.

As used herein, the term “Costs” shall mean all hard and soft costs incurred in connection with the design (including all engineering expenses), construction and installation of the Improvements, including, but not limited to, costs of labor, materials and suppliers, engineering, design and consultant fees and costs, blue printing services, construction staking, demolition, soil amendments or compaction, any processing, plan check or permit fees for the Improvements, engineering services required to obtain a permit for and complete the Improvements, costs of compliance with all applicable laws, costs of insurance required by this LDA, costs of any financial assurances, any corrections, changes or additions to work required by the Approving Authorities or necessitated by site conditions, municipal, state and county taxes imposed in connection with construction of the Improvements, any warranty work, and any other costs incurred in connection with the performance of the obligations of Developer or the Substitute Constructing Party (as applicable) hereunder to complete the Improvements.

For purposes of this Agreement, the cost of constructing a public street and any Related Improvements (as such term is defined in the next sentence) shall include those costs described in Ohio Revised Code Section 133.15(B) (“Cost” or "Costs"). (1) Capital costs, which shall consist of the costs of: acquiring land and constructing, reconstructing, adding to, and equipping a school building or buildings; remodeling and making extraordinary repairs to a school building or buildings; constructing sewerage systems and sewerage treatment and disposal facilities; purchasing or using such sewerage systems with municipalities; leasing, with an option to purchase, equipment for educational purposes; any other projects or acquisitions of a capital nature which the District is or may be authorized to finance by borrowing; and debt service on bonds and notes of the District issued to finance capital costs.
(2) Special operating costs, which shall include the cost of evening, graduate, and extension courses or any other types of courses, including vocational education programs but excluding summer school programs, that are offered by the District to persons other than pupils attending a regular District comprehensive school program in any of the grades kindergarten through twelve, inclusive.
Definition of Costs. “Costs” shall mean any and all claims, losses, damages, liabilities, penalties, interest and reasonable expenses, including without limitation any reasonable legal fees, expert witness fees or other expenses for investigating or defending any actions, suits, proceedings, demands, assessments, claims and judgments that may be awarded.

(3) Operating costs, which shall consist of all costs of the District other than capital costs and special operating costs. Operating costs shall consist of "instructional costs" and "non-instructional costs", and the categorization of all operating costs into these two sub-categories shall be determined by the Regional District School Committee in accordance with any definitions that may be promulgated from time to time by the Massachusetts Department of Education.
Definition of Costs. (1) The Carrier may charge a cost to the contract for a contract term if the cost is actual, allowable, allocable, and reasonable. In addition, the Carrier must:
(i) on request, document and make available accounting support for the cost to justify that the cost is actual, reasonable and necessary; and
(ii) determine the cost in accordance with: (A) the terms of this contract, and (B) Subpart 31.2 of the Federal Acquisition Regulation (FAR) and Subpart 1631.2 of the Federal Employees Health Benefits Program Acquisition Regulation (FEHBAR) applicable on the first day of the contract period.
(2) In the absence of specific contract terms to the contrary, the Carrier shall classify contract costs in accordance with the following criteria:
