Common use of Court Leaves Clause in Contracts

Court Leaves. 1. Leave of absence with pay shall normally be granted to any Member, other than a Member on leave of absence without pay, who is required to serve on a jury or to attend as a witness or an expert in a court of justice or before any legal or statutory body in Canada with power to compel the attendance of witnesses before it. 2. The Members shall notify their President in advance, in writing, and shall provide proof of their attendance, if so requested. 3. Members shall attempt to make arrangements to ensure that their duties are properly carried out during the period of their absence. 4. Leave with pay does not apply to Members serving a sentence or appearing as a witness on their own behalf. 5. When Members wish time off in order to pursue a civil action in court, the Members shall apply to the President for leave of absence without pay. (See Article 3.30). 6. If Members are required to absent themselves from their duties to appear in court as a result of legal action taken against them in regard to matters arising out of the performance of their duties at the University, they shall not be penalized for such absence. Such an absence shall be governed by paragraph 2 of this Article.
