Customer Supplied Parts. In the event the Customer supplies material to Plexus for use in the manufacturing of the product, Customer agrees to supply the material on time and in accordance with purchase orders placed by Plexus. Customer supplied material will be subject to normal incoming inspection, and the value of the incoming material will be included in the unit price. For purposes of payment relating to this section only, Plexus and Customer agree to develop a method for providing Customer with payment for such accepted customer supplied material such that Customer will not be charged twice for any individual customer supplied material. If material supplied by Customer is rejected or not delivered on time, therefore preventing Plexus from completing and shipping product, Plexus may invoice Customer for the full unit price as listed on Customer's purchase order.

Customer Supplied Parts. All suppliers that received customer supplied parts from MMI must sign a bailment agreement.
Customer Supplied Parts. 4.1 We may install Parts that you have supplied (Customer Supplied Parts). However, we reserve the right to decline any request to install Customer Supplied Parts in our absolute discretion. 4.2 We cannot guarantee the quality or performance of any Customer Supplied Parts or the labour to install them should the Customer Supplied Parts fail. To the maximum extent permitted by law and without limiting liability, TMWA excludes any and all liability to you in connection with any loss or damage you suffer or incur as a result of TMWA installing any loss or damage you suffer or incur as a result of TMWA installing Customer Supplied Parts.
Customer Supplied Parts. If requested by Seller, Buyer shall promptly furnish sufficient workpieces and production parts to permit Seller to design, develop, set up, debug, and test the operation of the product or equipment without any liability for damaged or scrapped workpieces and parts so tested; all workpieces and parts not scrapped will be returned to Buyer upon its written request. When requested by Seller, Buyer, at its own expense, shall promptly send a qualified representative to observe testing at Seller’s plant with authority to approve the results.
Customer Supplied Parts. 12.1 The Customer may request that the Contractor use any Customer supplies parts in any work. It is agreed: a. The Contractor does not offer any warranty for using Customer supplied parts in any work; b The Contractor will rely upon the information and detailed provided by the Customer in respect of the Customer supplied parts in its decision whether those parts are suitable to be installed or used in any work.
Customer Supplied Parts. The Customer may provide certain components required to build Customer's assemblies. The Customers inability to provide parts in a timely manner may effect Plexus' ability to meet its delivery schedule and may cause Plexus to incur extraordinary expenses to hold Plexus purchased material and/or labor in process. Under these circumstances, Plexus reserves the right to define a new Production Schedule for delivery based upon component availability information from the Customer and treat this as a Production Schedule change, with the Customer liability as defined under Section 2 (g) (ii)(iii) and (iv) above.

  • Customer Support If Customer is entitled to receive Customer Support as part of a separately purchased Service Plan, Sage warrants that while Customer’s Service Plan is in effect and if it has paid all required Service Plan fees, Sage will use qualified personnel to provide Customer Support in a professional manner consistent with industry standards. Customer’s sole remedy under this section 5.2 is limited to Sage’s re-performance of the Customer Support services giving rise to Customer’s claim.

Brokers and packagers are not regarded as manufacturers or regular dealers within the meaning of this section.   • Spare Parts 14.1 As specified, the supplier may be required to provide any or all of the following materials, notifications, and information pertaining to spare parts manufactured or distributed by the supplier: (a) such spare parts as the purchaser may elect to purchase from the supplier, provided that this election shall not relieve the supplier of any warranty obligations under the contract and; (b) In the event of termination of production of the spare parts: (i) advance notification to the purchaser of the pending termination, in sufficient time to permit the purchaser to procure needed requirements and; (ii) Following such termination, furnishing at no cost to the purchaser, the blueprints, drawings, and specifications of the spare parts, if requested.

  • All new supplies equipment and services shall include manufacturer's minimum standard warranty unless otherwise agreed to in writing. Vendor shall be legally permitted to sell all products offered for sale to TIPS Members. All goods proposed and sold shall be new unless clearly stated in writing. The Vendor shall provide timely and accurate customer support for orders to TIPS Members as agreed by the Parties. Vendors shall respond to such requests within a commercially reasonable time after receipt of the request. If support andƒor training is a line item sold or packaged with a sale, support shall be as agreed with the TIPS Member. Most TIPS Members are tax exempt and the related laws andƒor regulations of the controlling jurisdiction(s) of the TIPS Member shall apply. No assignment of Agreement may be made without the prior notification of TIPS. Written approval of TIPS shall not be unreasonably withheld. Payment for delivered goods and services can only be made to the awarded Vendor, Vendor designated reseller or vendor assigned company.

  • Shipment Dell will ship the APEX System to the Site when included as part of the APEX Service. The terms and process for shipment and delivery of the APEX System will be stated in the applicable Service Offering Description.
