DECISION LETTER. A. The deciding official will set forth findings with a response to each specification listed in the letter proposing the action. B. The decision letter will also address factual disputes, if any, raised in the employee’s reply by stating the reasons why each factual dispute was rejected. C. The decision letter will also: 1. Advise the employee of the right to appeal the final decision to the Merit Systems Protection Board or through the Negotiated Grievance Procedure, but not both; and 2. Indicate the effective date of the action.

DECISION LETTER a. The deciding official will be an official occupying a higher position (if one exists) than the official proposing the action. b. The deciding official shall prepare a decision letter, which shall include all of the following: (1) A determination of the final action; (2) Findings with response to each instance of unacceptable performance listed in the letter proposing the action; (3) Findings with response to each dispute, if any, raised by the employee's reply; (4) The effective date of the action. The effective date must be no earlier than thirty (30) calendar days after the date on which the employee received the proposed notice of adverse action; (5) Written concurrence of the action by an official occupying a higher position (if one exists) than the official proposing the action; (6) Notice to the employee that he or she has the option to appeal the action to the Merit Systems Protection Board (MSPB) or through the negotiated grievance procedure, but not both; and, (7) Notice to the employee that he or she will be deemed to have exercised his/her option to raise the matter under one procedure or the other at the time the employee timely files a written grievance or files a notice of appeal under the applicable MSPB procedure. c. If the employee is the subject of an action based on unacceptable performance related to a disability, and the employee is eligible and files for disability retirement, and the Agency recommends approval, the Agency may delay the action to allow a determination to be made concerning the disability retirement.

This obligation only applies to the extent that the dispute over facts in the employee’s reply are reasonably clear. 2. Specify the action to be taken and the effective date. 3. Notify the employee in writing of any appeal, grievance, or complaint rights.
DECISION LETTER. (a) The Employer shall make its final decision within thirty (30) calendar days after the expiration of the final notice or within thirty (30) calendar days of any extension provided for by Section 12 below. (c) The deciding official shall prepare a decision letter, which shall include all of the following: (1) a determination of the final action; (2) findings addressing each instance of unacceptable performance listed in the notice of proposed action; (3) a response to arguments raised during the employee’s reply; (4) the effective date of the action, if upheld; (5) notice to the employee that he or she has option to appeal the action to the Merit Systems Protection Board (MSPB) or to grieve under the negotiated grievance procedure provided for in Article 34, but not both; and (6) notice to the employee that he or she will be deemed to have elected his or her remedy at the time the employee timely files a grievance or files an appeal under the applicable MSPB procedure. (d) Any decision to remove an employee or to reduce their grade must be based only on instances of unacceptable performance occurring during the one year period commencing on the issue date of the advance notice of proposed adverse action.

  • Exclusion Letter If, at the conclusion of the 30 day period, Indivior fails to satisfy the requirements of Section X.D.3, OIG may exclude Indivior from participation in the Federal health care programs. OIG shall notify Indivior in writing of its determination to exclude Indivior (this letter shall be referred to hereinafter as the “Exclusion Letter”). Subject to the Dispute Resolution provisions in Section X.E, below, the exclusion shall go into effect 30 days after the date of Indivior’s receipt of the Exclusion Letter.   • Opinion Letter It shall be the Company's responsibility to take all necessary actions and to bear all such costs to issue the Common Stock as provided herein, including the responsibility and cost for delivery of an opinion letter to the transfer agent, if so required. (“Company”) and Continental Stock Transfer & Trust Company (“Trustee”), dated as of _________, 2011 (“Trust Agreement”), this is to advise you that the Company has entered into an agreement (“Business Agreement”) with __________________ (“Target Business”) to consummate a business combination with Target Business (“Business Combination”) on or about [insert date]. The Company shall notify you at least 48 hours in advance of the actual date of the consummation of the Business Combination (“Consummation Date”). In accordance with the terms of the Trust Agreement, we hereby authorize you to liquidate the Trust Account investments on __________ and to transfer the proceeds to the above-referenced account at XX Xxxxxx Chase Bank to the effect that, on the Consummation Date, all of funds held in the Trust Account will be immediately available for transfer to the account or accounts that the Company shall direct on the Consummation Date.   • Lodgement of Assessment Instrument (a) All assessment instruments under the conditions of this clause, including the appropriate percentage of the Australian Pay and Classification Scale to be paid to the employee, will be lodged by the Employer with the Registrar of the Australian Industrial Relations Commission.
