Display of Notice. Pursuant to the notice published by the Department of Housing and Urban Development (“HUD”) on July 30, 2004, the Agency will prominently display at each intake desk (or comparable location) the HMIS Baseline Privacy Policy provided by ICA that explains generally the reasons for collecting identified information in the HMIS and the Client rights associated with providing Agency staff with identified data. Agency will ensure Clients’ understanding of their rights. Additionally, if Agency maintains a public webpage, the current version of the HMIS Baseline Privacy Policy must be posted on the webpage. The current form of HMIS Baseline Privacy Policy, which may be modified from time to time at the HMIS Advisory Board’s discretion, is available from ICA on its website, xxx.xxxxxxxxxxx.xxx.
Display of Notice. Pursuant to the notice published by the Department of Housing and Urban Development (HUD) on July 30, 2004, Participant will prominently display the Notice to Clients of Uses & Disclosures (Privacy Notice to Clients) in its program offices where intake occurs and will take appropriate steps to ensure that all Clients whose information is entered into or accessed from CMIS/HMIS, read and understand the contents of the Notice. The Notice will be substantially in the form of the Notice to Clients of Uses & Disclosures, except that (a) where an Organization’s treatment of information is materially limited by other applicable laws or requirements, the Participant’s Notice must reflect the more stringent requirements, and (b) Participant will update its Notice whenever NWSSC CMIS/HMIS updates and distributes a new form of Notice to Clients of Uses & Disclosures. Participant will provide a written copy of the Participant’s Notice then in effect to any Client who requests it and will provide a copy of such Notice to all Clients who are asked to sign a Client Consent/Release of Information Form. Participant will maintain documentation of compliance with these notice requirements by, among other things, maintaining copies of all Notices it uses and the dates upon which they were first used.

The Organization will ensure clients’ understanding of their rights. Additionally, if the Organization maintains a public webpage, the current version of the AK CoCs Consumer Notice must be posted on the Organization’s webpage.

The Notice will be substantially in the form attached as Exhibit B, except that (a) where an Agency’s treatment of information is materially limited by other applicable laws or requir ements (such as HIPAA or 42 CFR Part 2), the Agency’s Notice must reflect the more stringent requirements; and (b) Agency will update its Notice whenever TCP updates and distributes a new form of Notice to Agency. Agency will provide a written copy of the Agency’s Notice then in effect to any Client who requests it. Agency will maintain documentation of compliance with these notice requirements by, among other things, maintaining copies of all Notices it uses and the dates when they were first used.
