Effect of Time Limits. If a grievance is not processed by the grievant at any step in accordance with the time limits of this Article, it shall be deemed withdrawn. If the District fails to respond to the grievance in a timely manner at any step, the running of its time limit shall be deemed a denial of the grievance and termination of the step in question, and the grievant may proceed to the next step. All time limits and grievance steps may be shortened, extended or waived, but only by mutual written agreement.
Effect of Time Limits. A. The time limits and other processes set forth in this Article will govern the discipline procedure to the exclusion of any other rule, practice or agreement to the contrary. Time limits may be extended by mutual agreement in writing.
Effect of Time Limits. The time limits specified herein are of the essence and may only be extended by mutual written agreement of the Town and the Union. Failure to process a Grievance within the time limits provided herein shall be deemed a waiver of such Grievance, and the Grievance shall be considered resolved in accordance with the position of the Town. Failure by the Town representatives to meet or respond to the Grievance within the time limits provided herein shall permit the Grievant or the Union, as appropriate, to process the Grievance to the next step provided they do so within the time limits set forth herein.

B. The failure on the part of any College representative to render a decision on the grievance within the time limits set forth in this Agreement shall operate as a denial of the grievance, and entitle the employee to proceed to the next step.

D. The parties agree it is important that grievances be processed as rapidly as possible. The number of days indicated at each level is to be considered the maximum and every effort shall be made to expedite the process before the deadlines are reached.
E. The day the grievant knew or should have known of the occurrence on which a grievance is based shall be counted as the first day. Actions or responses required shall be taken any time before the close of the grievant’s regular workday on the last day of any time limit or extension thereof.

The day following the day the grievant knew or should have known of the occurrence on which a grievance is based shall be counted as the first day for purposes of filing a grievance.

If BCCHS fails to respond to the grievance in a timely manner at any step, the running of its time limit shall be deemed a denial of the grievance and termination of the Level in question, and the grievant may proceed to the next Level. All time limits and grievance steps may be shortened, extended or waived, but only by mutual written agreement.
Effect of Time Limits. A grievance shall be considered withdrawn by the employee and/or Association unless such grievance is presented in writing to the University within the specified time limits as set forth in this Article.

However, if notification is given prior to the time limit expiring by the Union and/or grievant to the Grievance Administrator of a needed and reasonable extension of the time limit, the time limit shall be extended.
B. The failure of the grievance administrator to communicate the reply to the grievance at any step shall permit the grievant and/or Union to proceed to the next step in the process.
C. All time limits may be extended by mutual written agreement. All time limits herein shall consist of workdays unless otherwise specified. Workdays shall be defined as Monday through Friday, exclusive of recognized holidays.
D. The parties agree it is important that grievances be processed as rapidly as possible. The number of days indicated at each level is to be considered the maximum and every effort shall be made to expedite the process before the deadlines are reached.
E. In the event that a grievance is filed concerning an employee who works less than a twelve (12) month year, and that grievance is filed within the last two (2) weeks of the employee’s work year, the time limits contained herein shall be reduced to one half (1/2) for each party at each level.
F. The day after the grievant knew or should known of the occurrence on which a grievance is based shall be counted as the first day. Actions or responses required shall be taken any time before the close of the grievant’s regular workday on the last day of any time limit or extension thereof.
Effect of Time Limits. Any decision on any grievance not appealed by the grieving party within the designated time limits set forth in this Article shall be considered satisfactorily and completely settled on the basis of the last response and shall not be subject to further appeal. If the Employer fails to timely respond at any step of the grievance procedure, the Union may appeal the grievance to the next step.
Effect of Time Limits. By mutual agreement, the grievant and the Principal Administrator or the Association and the Principal Administrator, the Chancellor or the President may waive any step or extend any time limit established by this Section 800.000. However, if there is no waiver and if the grievant or the Association fails to adhere to a time limit established by this Section 800.000, the grievance shall be deemed resolved at the prior step. If the Principal Administrator, the Chancellor or the President fails to adhere to a time limit established by this Section 800.000, the Association may proceed to the next step.
