Emergency Orders. Emergency Orders may be placed occasionally. The Contractor is expected to make delivery within twenty-four (24) hours of notification. If the Contractor cannot provide the supplies within the emergency delivery period the District has the option to purchase those supplies from another source with no penalty to either party.
Emergency Orders. ABDC will use commercially reasonable efforts to meet a requested delivery time for emergency orders, which may be subject to an additional charge. If ABDC cannot do so, Customer may fill emergency orders outside the Program on such occasions using another provider notwithstanding minimum purchase commitments in this Agreement.
Emergency Orders. Vendor(s) shall provide 24 hour, 7 day a week emergency service to the County under the contract. During regular work hours (Monday through Friday, 8:00 A.M. to 5:00 P.M.), emergency service response time (defined as the time from acknowledged notification to arrival on-site) shall be within two (2) hours after notification by the County. During other than regular work hours, the emergency response time, as defined above, shall be within two (2) hours after notification by the County.
Emergency Orders. A above, during a Collaborative Process, a court may issue emergency orders to protect the health, safety, welfare, or interest of a party, child of a party, relative, domestic partner, or other person protected by the civil protection order statute, MD Family Law § 4-501 et seq., even though no notice of termination of the Collaborative Process has been given. The Collaborative Process terminates if a party seeks such an emergency order. Notwithstanding 2.C above, a Collaborative attorney is authorized to seek or defend an application for an emergency order described in 10.A despite the termination of the Collaborative Process for so long as a successor attorney is not immediately available and reasonable measures have not been taken to protect the health, safety, welfare, or interest of the person at risk.
Emergency Orders. LSI shall accept Emergency Orders from NCR seven (7) days a week, twenty-four (24) hours per day, three hundred sixty five (365) days per year for all Parts. LSI shall fill all Emergency Orders at an agreed to charge as specified in Exhibit B. LSI shall use best efforts, including taking material from production or from other customers' non-Emergency orders, to make the Part available for shipment within [*] following receipt of the Emergency Order. LSI shall provide waybill information to NCR no later than [*]. LSI's point(s) of contact for Emergency Orders and point(s) of contact for escalation of problems associated with Emergency Orders will be provided to NCR as soon as practicable, but not more than [*] following the signing of this Agreement.
Emergency Orders. Nothing herein shall prevent a Party from placing emergency orders for Products for delivery in less than ninety (90) days. The Supplying Party agrees to use reasonable efforts to deliver such Products on the requested schedule.
Emergency Orders. If HP deems it necessary, HP may order OEM Products by ---------------- facsimile on an emergency basis ("Emergency Order") subject to the availability of such OEM Products in Foundry's inventory Foundry shall use its best efforts to ship the Emergency Order to HP's stipulated destinations as quickly as reasonably possible after the receipt by Foundry. Any reprioritization of HP Orders will be as agreed by the parties. Subject to HP's approval, HP will pay any additional expenses related to such Emergency Orders.
Emergency Orders. A. The City reserves the right to surpass this Bid, if successful Bidder is unable to fill an order, and buy from another immediate source only in order to fulfill an emergency need.
Emergency Orders. SUPPLIER AGREES TO ACCEPT EMERGENCY ORDERS FOR PARTS AND SERVICES FROM NCR. SUPPLIER WILL USE COMMERCIALLY REASONABLE EFFORTS TO FILL ALL EMERGENCY ORDERS, PROVIDED THAT NCR WILL TAKE RESPONSIBILITY FOR ANY ADDITIONAL COSTS INCCURED HEREBY AND EXCESS STOCK INCURRED BY SUPPLIER TO SUPPORT SUCH EMERGENCY ORDERS. SUPPLIER WILL USE COMMERCIALLY REASONABLE EFFORTS, INCLUDING TAKING MATERIAL FROM PRODUCTION OR FROM OTHER NCR CUSTOMERS’ NON-EMERGENCY ORDERS, TO PERFORM THE SERVICES AND MAKE PARTS AND HARDWARE AVAILABLE FOR SHIPMENT. SUPPLIER WILL PROVIDE WAYBILL INFORMATION TO THE NCR EMERGENCY ORDER ORIGINATOR AS SOON AS POSSIBLE. SUPPLIER’S POINT(S) OF CONTACT FOR EMERGENCY ORDERS WILL BE PROVIDED TO NCR UPON SIGNING OF THE AGREEMENT OR THE EFFECTIVE DATE OF THIS SCHEDULE. SUPPLIER WILL SHIP PARTS OR HARDWARE ON AN “OVERNIGHT” BASIS, OR MAKE SUCH PARTS OR HARDWARE AVAILABLE FOR IMMEDIATE PICKUP, AT NCR’S DISCRETION.
Emergency Orders. HP or an Eligible Purchaser may issue Orders on an emergency basis (“Emergency Order”). Subject to availability of Product, Supplier will use reasonable commercial efforts to fill Emergency Orders upon acceptance thereof by Supplier.
