EMPLOYEE, MANAGEMENT. Subject to the provisions of Section I hereof and except as otherwise required by applicable law, Joint Venture shall supervise and manage the day-to-day duties of the Leased Employees and be liable for their actions in such capacity. Joint Venture hereby agrees to comply with all applicable laws and regulations and to follow APS personnel policies with respect to the Leased Employees. APS, in its sole discretion, shall make all hiring and termination decisions, establish and pay all wages, salaries and compensation, determine staffing levels, individual work hours, personnel policies and employee benefit programs for all of the Leased Employees, all consistent with APS's personnel policies. APS shall consult with Joint Venture on such matters, but all final decisions shall be those of APS, in its sole discretion.

EMPLOYEE, MANAGEMENT. Any employee having significant responsibilities for formulating and administering City policies and programs, including but not limited to the City Manager and department heads; and/or

EMPLOYEE, MANAGEMENT. During the period commencing on the date hereof and ending on a day which is three (3) months after the date on which HFS gives ARACS notice of its intent to terminate this Agreement (the "Management Period"), each HFS Managed Employee shall, unless otherwise directed by HFS, remain an employee of ARACS. During the Management Period, or until such earlier time as any such HFS Managed Employee ceases to be an employee of ARACS, such HFS Managed Employee shall be managed by, and under the direction of, HFS.

EMPLOYEE, MANAGEMENT. The UAO System must have the ability to perform the following: a. Allow APS to add, delete and place employees on hold thereby stopping all pending orders b. Permit authorized employees to place orders for a group of employees as identified by APS. For example, only the custodial building supervisor for a given building may order uniforms for employees under his or her supervision c. Define access to various employee records. For example, Plant Operations management would be able to view all custodial staff ordering records, but a custodial building supervisor would only be able view staff under his or her supervision

EMPLOYEE, MANAGEMENT. Any employee having significant responsibilities for formulating and administering City policies and programs, including but not limited to the City Manager and department heads; and/or Any employee having authority to exercise independent judgment to hire, transfer, suspend, lay- off, recall, promote, discharge, assign, reward or discipline other employees, or having the responsibility to direct them, or to adjust their grievances, or effectively to recommend such action if in connection with the foregoing, the exercise of such authority is not of a merely routine or clerical nature, but requires the use of independent judgment. (For illustrative purposes, "management employee" shall be interpreted to mean those classes above Police Sergeant).
