THE LANDSUPPORT CONSORTIUM AND ITS AFFILIATES MAKE NO REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY GUARANTEE OF COMMERCIABILITY OR ELIGIBILITY FOR A PARTICULAR PURPOSE OR A GUARANTEE THAT THE LANDSUPPORT* WEB PLATFORM WILL NOT INFRINGE PATENTS, COPYRIGHTS, TRADEMARKS OR OTHER THIRD-PARTY RIGHTS. THE USER ASSUMES ALL RESPONSIBILITY FOR AND RISK FROM SELECTION OF THE LANDSUPPORT WEB PLATFORM IN ORDER TO OBTAIN RESULTS DESIRED, AS WELL AS RESPONSIBILITY FOR AND RISK FROM THE USE OF RESULTS OBTAINED THROUGH USE OF THE LANDSUPPORT WEB PLATFORM.

END USER STATEMENT. 1. The exclusive use of the goods within the scope of this contract by the First Party is hereby certified. 2. The First Party will not re-export, sell, lend, give or by any other means transmit the goods within the scope of this contract, whether temporarily, partially or permanently, either within or outside Portuguese borders, or to a third party other than the Portuguese Navy, unless it is specifically authorized by prior written approval of the German Government and all other relevant Governments. 3. The First Party will also not use the goods within the scope of this contract for purposes related with chemical, biological or nuclear arms, as well as missiles able to contain such arms.
END USER STATEMENT. The Customer confirms hereby that the product and technology being delivered under this contract, as well as the direct product of this technology, are intended for civil industrial use only, and must not be used, directly or indirectly, for the production of chemical or biological weapons, or precursor chemicals for such weapons, or, directly or indirectly, for any kind of nuclear end-usage, respectively.

END USER STATEMENT. I have read all of the above “Terms and Conditions of Sale” for distributing CBF branded products and agree to accept these guidelines while conducting business with CBF. I understand that any issues that arise will be resolved by referring back to these written terms and conditions. Purchases will be reviewed annually to insure that commitment requirements are met. No phone orders will be submitted. All orders must be placed via fax EDI, EDT or email. Orders will not be deemed accepted until confirmed and approved by CBF customer service department. The minimum order value is $500.00 per order. Minimum order quantities by item will be adhered to where applicable. All caliper/brake assembly orders less than four (4) units per part number will incur a $250.00 set-up charge. When a price reduction is made, CBF will make every attempt to allow Distributors to purchase at their new reduced price for 90 days prior to announcing reduced list pricing. This will effectively eliminate any devaluation of on-hand inventory.

  • Use of Customer Statements The Contractor shall not use any statement attributable to the Customer or its employees for the Contractor’s promotions, press releases, publicity releases, marketing, corporate communications, or other similar communications, without first notifying the Customer’s Contract Manager and securing the Customer’s prior written consent.

  • COPIES OF REGULATORY REPORTS AND FILINGS Upon reasonable request, Competitive Supplier shall provide to the Town a copy of each public periodic or incident-related report or record relating to this ESA which it files with any Massachusetts or federal agency regulating rates, service, compliance with environmental laws, or compliance with affirmative action and equal opportunity requirements, unless the Competitive Supplier is required by law or regulation to keep such reports confidential. The Town shall treat any reports and/or filings received from Competitive Supplier as confidential information subject to the terms of Article 16. Competitive Supplier shall be reimbursed its reasonable costs of providing such copies.

  • FORMAT AND CONTENT FOR REGISTRY OPERATOR MONTHLY REPORTING Registry Operator shall provide one set of monthly reports per gTLD, using the API described in draft-­‐xxxxxx-­‐icann-­‐registry-­‐interfaces, see Specification 2, Part A, Section 9, reference 5, with the following content. ICANN may request in the future that the reports be delivered by other means and using other formats. ICANN will use reasonable commercial efforts to preserve the confidentiality of the information reported until three (3) months after the end of the month to which the reports relate. Unless set forth in this Specification 3, any reference to a specific time refers to Coordinated Universal Time (UTC). Monthly reports shall consist of data that reflects the state of the registry at the end of the month (UTC).

  • Proposed Policies and Procedures Regarding New Online Content and Functionality By October 31, 2017, the School will submit to OCR for its review and approval proposed policies and procedures (“the Plan for New Content”) to ensure that all new, newly-added, or modified online content and functionality will be accessible to people with disabilities as measured by conformance to the Benchmarks for Measuring Accessibility set forth above, except where doing so would impose a fundamental alteration or undue burden. a) When fundamental alteration or undue burden defenses apply, the Plan for New Content will require the School to provide equally effective alternative access. The Plan for New Content will require the School, in providing equally effective alternate access, to take any actions that do not result in a fundamental alteration or undue financial and administrative burdens, but nevertheless ensure that, to the maximum extent possible, individuals with disabilities receive the same benefits or services as their nondisabled peers. To provide equally effective alternate access, alternates are not required to produce the identical result or level of achievement for persons with and without disabilities, but must afford persons with disabilities equal opportunity to obtain the same result, to gain the same benefit, or to reach the same level of achievement, in the most integrated setting appropriate to the person’s needs. b) The Plan for New Content must include sufficient quality assurance procedures, backed by adequate personnel and financial resources, for full implementation. This provision also applies to the School’s online content and functionality developed by, maintained by, or offered through a third-party vendor or by using open sources. c) Within thirty (30) days of receiving OCR’s approval of the Plan for New Content, the School will officially adopt, and fully implement the amended policies and procedures.

  • HOT LIST PRICING At any time during this Contract, Supplier may offer a specific selection of Equipment, Products, or Services at discounts greater than those listed in the Contract. When Supplier determines it will offer Hot List Pricing, it must be submitted electronically to Sourcewell in a line-item format. Equipment, Products, or Services may be added or removed from the Hot List at any time through a Sourcewell Price and Product Change Form as defined in Article 4 below. Hot List program and pricing may also be used to discount and liquidate close-out and discontinued Equipment and Products as long as those close-out and discontinued items are clearly identified as such. Current ordering process and administrative fees apply. Hot List Pricing must be published and made available to all Participating Entities.

  • Submission of Grievance Information a. Upon appointment of the arbitrator, the appealing party shall, within five (5) days after notice of appointment, forward to the arbitrator, with a copy to the School Board, the submission of the grievance which shall include the following: 1.   • Bulk Registration Data Access to Icann Periodic Access to Thin Registration Data. In order to verify and ensure the operational stability of Registry Services as well as to facilitate compliance checks on accredited registrars, Registry Operator will provide ICANN on a weekly basis (the day to be designated by ICANN) with up-to-date Registration Data as specified below.   • Billing Statement The billing statement shall show the work authorization number for each work authorization included in the billing, the total amount earned to the date of submission, and the amount due and payable as of the date of the current billing statement for each work authorization. The billing statement shall indicate if the work has been completed or if the billing is for partial completion of the work. The fixed fee will be paid in proportion to the percentage of work completed per work authorizations.
