Establishment Period. Developer shall provide a two-year establishment period and maintain all landscape plantings for two years after the IFA’s initial approval of plantings and landscape Work for those areas outside of the O&M Limits. IFA shall provide its initial approval for plantings and landscape work only after all plant materials within a geographic warranty area approved by IFA have been planted, are true to species and minimum size and are in a healthy and thriving condition. In addition, each plant pit or bed shall be properly filled, mulched, pruned, and staked. Developer shall define geographic establishment areas and submit to IFA for approval with the Aesthetics and Enhancement Implementation Plan. No more than 10 geographic establishment areas shall be designated. The geographic establishment areas shall be contiguous and well defined by landmarks such as bridges, cross roads, etc. SWM facilities and riparian plantings shall be included in the areas proposed for initial approval. The replacement of any areas damaged after initial approval by IFA and prior to Final Acceptance shall be performed by Developer. During this two-year establishment period, Developer shall replace any plant materials that are not in a healthy and thriving condition, reflective of the species and in accordance with the Department’s Standard Specifications.

Establishment Period. 3.14.1 The acceptability of the plant material furnished and planted as specified will be determined at the end of the establishment period. The period of establishment shall begin as soon as all plants are planted and shall extend for 1 year or until the date of final acceptance, whichever date is later. During the period, the Contractor shall employ all possible means to preserve the plantings in a healthy condition including: watering, 3.14.2 An inspection will be made by the Contractor and the Engineer immediately prior to or early in the planting season following the original planting season to determine the condition of the plant material. Dead plants, diseased plants, plants lacking sufficient vigor, or plants showing evidence of sizable die-back will require replacements. Unacceptable plant material must be removed promptly from the project. 3.14.3 The Engineer may require that replacement plants that are not dormant or that are planted late in the planting season shall be sprayed as directed with an approved antidesiccant. 3.14.4 Except as provided in 2.1.1.5, all replacement plantings shall be of the same kind and size as originally specified. The use of more loam and more initial fertilizer may be waived by the Engineer; otherwise, replacement plantings shall be handled, planted and maintained in the same manner specified for the original plantings.

  • Development Period The Contractor may commence pre-construction activities like utility shifting, boundary wall construction or any other activity assigned to the Contractor by the Authority to enable construction of the Project Highway immediately after signing of the Agreement, to the extent that such work is ready for execution. The Parties agree that these works may be taken up and completed to the extent feasible by the Contractor, before declaration of the Appointed Date, but no claim against the Authority for delay shall survive during this period and that the undertaking of these works by the Contractor shall not count towards the Scheduled Construction Period of the project which starts counting only from the Appointed Date. No construction activity of the Project Highway shall be undertaken during the development period.

  • AGREEMENT PERIOD The terms of this Agreement and the performance of the parties hereto shall commence, or be deemed to have commenced, the 1st day of January 2020 and will continue through the 31st day of December 2020, both dates inclusive, unless sooner terminated or extended as provided for herein.

  • Meal Period Employees shall receive a meal period which shall commence no less than two (2) hours nor more than five (5) hours from the beginning of the employee's regular shift or when the employee is called in to work on their regular day off. The meal period shall be no less than one-half (½) hour nor more than one (1) hour in duration and shall be without compensation. Should an employee be required to work in excess of five (5) continuous hours from the commencement of their regular shift without being provided a meal period, the employee shall be compensated two (2) times the employee's straight-time hourly rate of pay for the time worked during their normal meal period and be afforded a meal period at the first available opportunity during working hours without compensation.

The “Controlled Accumulation Period Length” will mean a number of whole months such that the amount available for payment of principal on the Notes and the reduction of the Principal Overcollateralization Amount on the Expected Principal Payment Date is expected to equal or exceed the Note Principal Balance plus the Principal Overcollateralization Amount, assuming for this purpose that (1) the weighted average principal payment rate on the Receivables held by the Issuer will be no greater than the lowest weighted average monthly principal payment rate for the Receivables held by the Issuer for the prior twelve (12) Monthly Periods, (2) the total amount of Principal Receivables held by the Issuer in the Trust (and the principal amount on deposit in the Excess Funding Account, if any) remains constant at the level on such date of determination, (3) no Early Amortization Event with respect to any Series will subsequently occur and (4) no additional Series (other than any Series being issued on such date of determination) will be subsequently issued by the Issuer. Any notice by the Issuer modifying the commencement of the Controlled Accumulation Period pursuant to this Section 4.12 shall specify (i) the Controlled Accumulation Period Length and (ii) the commencement date of the Controlled Accumulation Period.

  • Open Enrollment Period Open Enrollment is a period of time each year when you and your eligible dependents, if family coverage is offered, may enroll for healthcare coverage or make changes to your existing healthcare coverage. The effective date will be on the first day of your employer’s plan year. A Special Enrollment Period is a time outside the yearly Open Enrollment Period when you can sign up for health coverage. You and your eligible dependents may enroll for coverage through a Special Enrollment Period by providing required enrollment information within thirty (30) days of the following events: • you get married, the coverage effective is the first day of the month following your marriage. • you have a child born to the family, the coverage effective date is the date of birth. • you have a child placed for adoption with your family, the coverage effective date is the date of placement. Special note about enrolling your newborn child: You must notify your employer of the birth of a newborn child and pay the required premium within thirty -one (31) days of the date of birth. Otherwise, the newborn will not be covered beyond the thirty -one (31) day period. This plan does not cover services for a newborn child who remains hospitalized after thirty-one (31) days and has not been enrolled in this plan. In addition, if you lose coverage from another plan, you may enroll or add your eligible dependents for coverage through a Special Enrollment Period by providing required enrollment information within thirty (30) days following the date you lost coverage.
