Establishment Period. Developer shall provide a two-year establishment period and maintain all landscape plantings for two years after the IFA’s initial approval of plantings and landscape Work for those areas outside of the O&M Limits. IFA shall provide its initial approval for plantings and landscape work only after all plant materials within a geographic warranty area approved by IFA have been planted, are true to species and minimum size and are in a healthy and thriving condition. In addition, each plant pit or bed shall be properly filled, mulched, pruned, and staked. Developer shall define geographic establishment areas and submit to IFA for approval with the Aesthetics and Enhancement Implementation Plan. No more than 10 geographic establishment areas shall be designated. The geographic establishment areas shall be contiguous and well defined by landmarks such as bridges, cross roads, etc. SWM facilities and riparian plantings shall be included in the areas proposed for initial approval. The replacement of any areas damaged after initial approval by IFA and prior to Final Acceptance shall be performed by Developer. During this two-year establishment period, Developer shall replace any plant materials that are not in a healthy and thriving condition, reflective of the species and in accordance with the Department’s Standard Specifications.

Establishment Period. C1.1 Notwithstanding clause 14.2, with prior approval from the ARC, the Administering Organisation may expend up to $100,000 from the Funding for ITTC or ITRH establishment purposes before all Participating Organisation agreements are executed (the Establishment Period).
Establishment Period. The establishment period is defined as the entire one year after installation of all plants and incidental landscaping. The establishment period will begin upon acceptance by the Engineer of the Establishment Plan and the complete installation of the landscaping. During the establishment period: Keep all plants watered, fertilized, mulched, pruned, and staked and guyed as necessary to assure specified minimum grade of Florida No. 1 throughout the duration of the project construction period and establishment period. Keep all plants pruned to maintain plant health, clear visibility of signs, traffic signals, safe sight distance at intersections and driveways, safe and operational horizontal and vertical clearance from roadways, sidewalks, utilities, light poles, traffic control signals and devices, toll equipment and facilities, mechanical equipment, fences, walls and drainage structures, and to provide unobstructed access. Pruning shall conform to ANSI A300 Part 1 Standards. Pruning shall be performed by an International Society of Arboriculture (ISA) Certified Arborist or person with documentation of equivalent or greater expertise. Prior to performing pruning activities provide proof of the individual’s active arborist certification or other credential to the Engineer for approval. Keep the landscape areas as defined in the plans, including individual plant locations and planting beds, free of litter, debris, excess material and undesirable vegetation. Keep landscape bed edges correctly located and trimmed, and the mulch groomed and replenished as specified in the Contract Documents. Operate and maintain all components of any irrigation system when installed as part of the Contract. Remove staking and guying from all fully established plants unless otherwise directed by the Engineer. Continue any mowing and litter pick up of the turf areas as depicted and specified in the Contract Documents.

Establishment Period. 3.14.1 The acceptability of the plant material furnished and planted as specified will be determined at the end of the establishment period. The period of establishment shall begin as soon as all plants are planted and shall extend for 1 year or until the date of final acceptance, whichever date is later. During the period, the Contractor shall employ all possible means to preserve the plantings in a healthy condition including: watering, weeding, pesticide application, pruning, repairing saucers and adding mulch, adjusting guys and stakes, replacement of unacceptable plants, together with such other work as may be ordered. Weeding shall be a minimum of 1 foot beyond the limit of the saucers. At the end of the establishment period, all guys, stakes, and hubs shall be removed, unless otherwise directed.

  • Funding Period The Funding Period, if any, shall not have terminated.

  • Payment Period Whenever a payment under this Agreement specifies a payment period with reference to a number of days (e.g., “payment shall be made within forty (40) days following the date of termination), the actual date of payment within the specified period shall be within the sole discretion of the Company.

  • Variable Accumulation Period The Controlled Accumulation Period is scheduled to commence on the Stated Controlled Accumulation Period Commencement Date; provided, however, that if the Controlled Accumulation Period Length (determined as described below) on any Determination Date is different from the Initial Scheduled Controlled Accumulation Period Length, the Servicer, at its option on any Determination Date prior to the commencement of the Controlled Accumulation Period, may elect to modify the date on which the Controlled Accumulation Period actually commences to the last Business Day of any Due Period that precedes the Due Period that is the number of Due Periods prior to the Expected Final Payment Date equal to the Controlled Accumulation Period Length. Such election will be set forth in the Monthly Servicer Certificate. If the Servicer elects to modify the date on which the Controlled Accumulation Period commences pursuant to this Section 19, then on each Determination Date thereafter until the date on which the Controlled Accumulation Period commences the Servicer will recalculate the Controlled Accumulation Period Length; provided, however, that (i) the length of the Controlled Accumulation Period will not be less than the Minimum Controlled Accumulation Period Length and (ii) notwithstanding any other provision of this Series Supplement to the contrary, no election to postpone the commencement of the Controlled Accumulation Period shall be made after a Rapid Amortization Event (as described herein or in the applicable Series Supplement) shall have occurred for so long as it is continuing with respect to any Series in the Group to which the Series established hereby belongs. On each Determination Date, the Servicer will determine the "Controlled Accumulation Period Length" that will equal the number of Due Periods such that the Class Controlled Accumulation Amount for the Due Period related to the Class Expected Final Payment Date, when aggregated with the Class Controlled Accumulation Amounts for each preceding Due Period, will equal or exceed the Series Initial Investor Interest. Any notice by the Servicer electing to modify the commencement of the Controlled Accumulation Period pursuant to this Section 19 shall specify the following as determined on such Determination Date: (i) the Controlled Accumulation Period Length; (ii) the commencement date of the Controlled Accumulation Period; and (iii) the Class Controlled Accumulation Amount with respect to each class of such Series with respect to each Due Period. If the Controlled Accumulation Period Length as recalculated on any such Determination Date exceeds the number of full Due Periods following such Determination Date and preceding the Class A Expected Final Payment Date, the commencement date of the Controlled Accumulation Period will be such Determination Date.

  • Contract Period “Contract Period” shall mean the period commencing the day immediately preceding a Change in Control and ending on the earlier of (i) the second anniversary of the Change in Control or (ii) the death of the Executive. For the purpose of this Agreement, a Change in Control shall be deemed to have occurred at the date specified in the definition of Change-in-Control.
