Functions of the Joint Commission. 1. The Joint Commission shall: (a) review and assess the implementation and operation of this Agreement; (b) supervise the work of all committees, working groups and other bodies established under this Agreement; and (c) consider any other matter that may affect the operation of this Agreement. 2. The Joint Commission may: (a) establish any ad hoc or standing committee, working group, or other body; (b) refer matters to, or consider matters raised by, any ad hoc or standing committee, working group, or other body established under this Agreement; (c) consider any proposals for amendments or modifications to the rights and obligations under this Agreement; (d) as appropriate, issue interpretations of the provisions of this Agreement; (e) further the implementation of this Agreement through implementing arrangements under the Agreement; (f) establish its own rules of procedure as appropriate; (g) explore ways to enhance further trade and investment between the Parties; (h) seek to resolve differences or disputes that may arise regarding the interpretation or application of this Agreement; (i) seek the advice of non-governmental persons or groups; and (j) take such other action in the exercise of its functions as the Parties may agree.

The Joint Commission shall: (a) monitor and review the implementation of this Agreement; (b) oversee the general functioning and further development of this Agreement; (c) undertake general reviews of this Agreement in accordance with Article 6.7 (General Review); (d) consider ways of promoting accessions to the Agreement, and approve the terms of accession; (e) consider any proposal by a Party or a subsidiary body to amend this Agreement; (f) supervise the work of subsidiary bodies established under this Agreement; and (g) consider any other matter that may affect the operation of this Agreement. 2. The Joint Commission may: (a) in accordance with the Agreement’s objectives, and subject to completion of any necessary legal requirements by each Party, adopt modifications to: (i) Annexes I to V, and VII to XI, including their Appendices;19 and 18 In the case of Costa Rica, Annex XI (Party-Specific Institutional Arrangements) shall apply.

The Joint Commission may: (a) establish and delegate responsibilities to ad hoc and standing committees or other bodies; (b) adopt rules of procedure; and (c) take such other action in the exercise of its functions as the Parties may agree.

The Joint Commission may: (a) establish additional committees and working groups, refer any matter to a committee or working group for advice, and consider any matter raised by a committee or working group established under this Agreement; (b) further the implementation of this Agreement's objectives through implementing arrangements; (c) further the implementation of this Agreement's objectives by approving any modifications of, inter alia, the lists of entities and thresholds in Annexes I and II to Chapter 12 (Government Procurement); (d) explore measures for the further expansion of trade and investment between the Parties; (e) seek to resolve differences or disputes that may arise regarding the interpretation or application of this Agreement; (f) seek the expert advice of non-governmental persons or groups on any matter falling within its functions where this would help the Joint Commission make an informed decision; and (g) take such other action in the exercise of its functions as the Parties may mutually determine.
