Equipment Replacement. The Employer shall not charge any employee for repair/replacement of any issued equipment if loss or damage occurred in the normal performance of the employee's assigned duty.
Equipment Replacement. The Employer shall not charge any full-time or regularly scheduled part-time employee for repair/replacement of any issued equipment if loss or damage occurred in the normal performance of the employee’s assigned duty.
Equipment Replacement. If the equipment is inoperable, Contractor, at its option, shall provide a suitable replacement with either new or reconditioned equipment.
Equipment Replacement. (a) The Company shall not require, as a condition of continued hourly employment, that an Employee purchase a truck, tractor and/or trailer, or other vehicular equipment, or that an Employee purchase or assume any proprietary interest or other obligation in the Company business other than where applicable within attached appendices (conversion to owner operator).
(b) Replacement of equipment for any reason will be guided by the principle that a Company operated unit will be replaced by a Company operated unit and Owner Operator unit may be replaced by another Owner Operator unit, or at the Company's option, with a Company unit.
Equipment Replacement. Section 30.1. Employees who damage or lose issued equipment or personal property in the line of duty should apply in writing to their immediate supervisor for reimbursement or replacement. The immediate supervisor will investigate the request and turn in an evaluation to the Chief. The Chief will then decide if a requisition or reimbursement shall be made. Each situation will be judged on a case-by-case basis, but replacement or reimbursement shall not be unreasonably denied. If the employee follows this procedure, the Chief will decide the matter and requisition a replacement of comparable value or repair (if the decision is favorable) as soon as possible but in no case later than thirty (30) days of the application. The Chiefs decision shall not be subject to the grievance procedure contained herein.
Equipment Replacement. If replacement of Seller-Provided Equipment is required for any reason, Seller may use refurbished Seller-Provided Equipment and will be replaced on an exchange basis only, and only when the defective equipment has been actually received by Seller.. Returned hardware that has been replaced by Seller will remain Seller property. The following apply with respect to end of life Seller-Provided Equipment:
(i) Seller may discontinue, or limit the scope of Support Services, for Seller-Provided Equipment that a third party manufacturer has declared "end of life," "end of service," "end of support," "manufacture discontinue" or similar designation ("End of Support") from time to time.
(ii) Seller may notify Buyer of any hardware and/or software application elements of the Service that become End of Support at any time during the Term. Upon notification, Seller will consult Buyer as to the impact to the Hosted PBX Service. Consultation may include upgrade, replacement, or deployment of a new technology and any applicable one-time or monthly service charges to continue the Service.
Equipment Replacement. Unless Lessee exercises its purchase option under this Lease, the Lease Schedule or the Charter, and except as otherwise provided in the Charter, if any part of the Equipment is lost, stolen, destroyed, seized by governmental action or, in Lessee's opinion or Lessor's opinion, damaged ("Event of Loss"), this Lease shall remain in full force and effect without abatement of Rent and Lessee shall promptly replace such Equipment at its sole expense with Equipment of equivalent value and utility, and similar kind and in substantially the same condition as the replaced Equipment immediately prior to the Event of Loss. Title to such replacement Equipment immediately shall vest and remain in Lessor, and such Equipment shall be deemed Equipment under this Lease and the applicable Lease Schedule. Lessor shall cause to be paid to Lessee or the vendor of the replacement Equipment any insurance proceeds actually received by Lessor as a result of the Event of Loss promptly upon receipt of such proceeds. Lessee shall promptly notify Lessor of any Event of Loss and shall provide Lessor with and shall enter into, execute and deliver such documentation, as Lessor shall reasonably request with respect to the replacement of any such Equipment. Notwithstanding the foregoing, if there occurs an Event of Loss which constitutes, in Lessee's opinion, an actual or constructive total loss of all or a substantial portion of the Equipment, then Lessee shall have the option, exercisable upon written notice to Lessor, to terminate this Lease and purchase the Equipment in accordance with Section 21.2; provided, however, that if Lessee opts to purchase the Equipment under Section 21.2, then any insurance proceeds actually received by Lessor as a result of such Event of Loss shall be used to offset the amount due from Lessee to Lessor under Section 21.2 and the excess, if any, shall be promptly paid to Lessee.
Equipment Replacement. PGC, or its duly authorized agent, will maintain a record of equipment in Issuing Agent’s possession by serial number. If Issuing Agent’s equipment malfunctions and must be replaced, PGC or its agent will supply a functional piece of replacement equipment and instructions. Issuing Agent shall follow the instructions furnished with respect to return of the malfunctioning piece of equipment and any peripheral items (cables, etc.). If Issuing Agent does not return a replaced piece of equipment within thirty (30) days of receipt of replacement equipment, Issuing Agent may be charged for the cost of the replacement equipment. PGC may collect equipment charges through EFT in an amount determined by PGC.
Equipment Replacement. 10.16.2.1 The Employer will replace Employer-provided equipment on a regular schedule as defined in Department or Division policy and procedure, or as determined by the Employer, as needed due to normal wear and tear in the course and scope of the employee's duties.
10.16.2.2 Reimbursement for employee personal equipment may be granted by the Department or Division if said equipment is damaged during the normal course and scope of duty.
10.16.2.3 Employees must submit a report detailing how the personal equipment was damaged to their Department or Division for approval or disapproval within three (3) working days of the date the incident occurred.
Equipment Replacement. If any equipment or machinery or component part thereof of either the FPSO or the Additional Equipment is damaged, defective or breaks at any time prior to the Delivery Date and such equipment, machinery or component part must be replaced, the capital costs of any replacement thereof shall be borne by (i) the Owner, if same is a part of the FPSO (excluding Additional Equipment), and (ii) by the Charterer, if same is a part of the Additional Equipment.
