Grant of Revocable License. Fairfax Water hereby approves the Landowner Application and grants the Landowners a revocable license to construct and, thereafter, to use and maintain the structure(s) depicted in the Landowner Application (such structure(s) sometimes referred to herein as the “Approved Facilities”) on the Property in strict accordance with the Landowner Application (including the plans and drawings set forth therein), the Applicable Laws and Regulations (as defined in Section B(3)), and subject to the terms and conditions set forth in this Agreement. The foregoing license (the “Facilities License”) relates solely to the Approved Facilities and does not authorize the Landowners to perform, install, or construct any further or additional improvements in the Flood Easement or on the adjacent property owned by Fairfax Water in fee simple (the “Fairfax Water Property”). The Parties acknowledge and agree that the Facilities License constitutes a revocable license with respect to the Approved Facilities and that nothing contained herein will effect, or will be deemed to effect, a conveyance or other transfer of any property rights held by Fairfax Water.
Grant of Revocable License. Subject to the terms of this Agreement, Licensor hereby grants to Licensee a revocable license for the Term of this Agreement to use that portion of Licensor’s Property shown on the Site Plan for the sole purpose of installing and maintaining a Scoreboard.
Grant of Revocable License. City hereby grants to Owner a revocable limited license to display the artwork described in Exhibit A attached hereto and hereby made a part of this Agreement (the “Art”) on/at the location described in Exhibit B attached and made a part of this Agreement (the “Display Site”). The placement of the Art shall be at the sole discretion of City.
Grant of Revocable License. The City hereby grants to the Licensee a revocable license for the occupation of the Licensed Premises for retail purposes and sale of goods and/or services to the public.
Grant of Revocable License. Licensor hereby grants Licensee a revocable license to use and access the Fiber Strands, without warranting title or interest and upon the terms and conditions set forth below. Any and all rights granted to Licensee under this Agreement shall be exercised at Licensee’s sole cost and expense, and shall be subject to the Licensor’s reserved right to use any and all parts of the Fiber Strands and Fiber Cables for Licensor’s public purposes. Notwithstanding any other provision contained herein to the contrary, nothing in this Agreement shall be deemed to grant, convey, create or vest in Licensee any real property interest in the Fiber Strands including any fee, leasehold, or easement interest.
Grant of Revocable License. 2.1. County hereby grants to City a revocable license for the limited, nonexclusive access and use of the Revocable License Area solely for the purposes of installing, operating, and maintaining the LES System, subject to the Conditions of Use and Special Technical Provisions, and taking other actions as may be required by this Agreement.
2.2. Other than for the purposes identified in this Agreement, City may not use the Revocable License Area for any other purpose whatsoever without written amendment of this Agreement executed with the same formalities as this Agreement. City may not permit the Revocable License Area to be used in any manner that will violate the terms of this Agreement or any laws, administrative rules, or regulations of any applicable governmental entity or agency.
2.3. County shall retain full and unrestricted access to the Revocable License Area at all times.
2.4. County reserves the right to lease and/or license other portions of the Revocable License Area to other parties for any purpose, including communications transmitting or receiving sites.
2.5. Throughout the term of this Agreement, and notwithstanding any other term or condition of this Agreement, County retains the right in its sole discretion to modify, reconfigure, improve, convey, or abandon the Revocable License Area, and to make any improvements thereon. Specifically, City acknowledges and agrees that the roadway, right-of-way area, and/or the Revocable License Area may be temporarily or permanently reconfigured, modified, or moved, without any liability to County. County will provide City with thirty (30) days’ written notice of any such modifications to the Revocable License Area to allow City to remove or relocate the LES System at City’s own expense.
2.6. This Agreement is merely a right to access and use and grants no estate in the Revocable License Area to City or any other party.
Grant of Revocable License. The City hereby grants to Licensee a non-exclusive and revocable authorization (the "License") to install and operate the Private Activities/Improvements in the part of the City ROW depicted on Exhibit A hereto, provided, however, that as conditions to the License, the Licensee shall:
(i) install and maintain the Private Activities/Improvements only within the boundaries of, and as and where depicted on Exhibit A; XXX.TWR.00673
(ii) operate the Private Activities/Improvements only in accordance with the operating conditions set forth in Exbibit B hereto, which Exhibit is hereby incorporated herein by reference;
(iii) maintain any furnishings or other improvements permitted by this License, including but not limited to benches, tables, chairs and railings, in good repair and attractive condition, and ensure that all such items are designed for outdoor use; and
(iv) ensure that the placement of any furnishings or other improvements permitted by this License, and that the operation of the activities permitted by this License, shall at all times maintain a minimum sidewalk width of 60 inches available for travel by the general public. The rights granted under this License are expressly subject to the rights of the public and any rights granted previously by the City to any person. The City may enforce this License either by seeking damages or by specific performance or through any other legal or equitable remedy available to the City.
Grant of Revocable License. The City hereby grants to Licensee a non-exclusive, temporary and revocable authorization (the "License") to install and operate the Private Activities/Improvements in the Licensed Premises provided, however, that as conditions to the License, the Licensee shall install and maintain the Private Activities/Improvements only within the boundaries of the area depicted on Exhibit A as being within the Licensed Premises (City Right-of-Way/Public Property/Public Place). The rights granted under this License are expressly subject to the rights of the public and any rights granted previously by the City to any person. The City may enforce this License either by seeking damages or by specific performance or through any other legal or equitable remedy available to the City.
Grant of Revocable License. PG&E hereby grants the Revocable -------------------------- License to XXX on the terms, covenants and conditions set forth in this Agreement to utilize the Right of Way for the design, engineering, construction, installation, inspection, testing, Maintenance, repair, replacement, operation, relocation and removal of the Cable, the Regeneration Facilities and the System Electronics. Until such time as the Revocable License is converted to the Irrevocable License (as provided in Section 2.3), ELI's rights to the Towers, the Substation Sites and the Right of Way shall consist only of a revocable right to use and shall be subject to all terms, covenants and conditions applicable to the Revocable License as contained in this Agreement.
Grant of Revocable License. This Agreement grants to IPN a Revocable License. Until such time as the Revocable License is converted to the Irrevocable License (as provided in Section 3.3), IPN’s rights to the IPN Fibers, Equipment Sites for Equipment Stations shall consist only of a revocable right to use and shall be subject to all terms, covenants and conditions applicable to the Revocable License as contained in this Agreement.
