Hazards and Hazardous Materials. 12.1 Disclosure of Hazards (Right to Know). Xxxxx & Xxxxxxx will take reasonable precautions for the health and safety of Xxxxx & Xxxxxxx'x employees while at the Site. Client will obtain from Site owner, and others as applicable, and xxxxxxx to Xxxxx & Xxxxxxx, prior to Xxxxx & Xxxxxxx beginning services under this Agreement, all available information concerning Site conditions, including, but not limited to: subsurface conditions, oil, hazardous material, toxic mold and biological conditions, radioactive or asbestos material in, on or near the Site. If such a material or condition is discovered that had not been disclosed to Xxxxx & Xxxxxxx, then, upon notification, Client and Xxxxx & Xxxxxxx shall seek an equitable adjustment to be made to this Agreement. By authorizing Xxxxx & Xxxxxxx to proceed with the services, Client confirms that Xxxxx & Xxxxxxx has not created nor contributed to the presence of any hazardous substances at or near the Site. Client agrees to assume all liability and shall indemnify, defend and hold Xxxxx & Xxxxxxx harmless from any claims, losses, liabilities or damages arising out of (1) personal injury or death resulting from such hazardous material or condition and/or (2) a release of hazardous substances except to the extent the release was caused by Xxxxx & Xxxxxxx’x xxxxx negligence or willful misconduct in the performance of the services.

Hazards and Hazardous Materials. 5 In general, these lands and shallow waters have the potential to contain 6 hazardous substances. A query of the California Department of Toxic 7 Substances Control’s (CDTSC’s) database reveals that there are no known 8 hazardous material sites within or immediately surrounding Prospect Island 9 (CDTSC 2013). Additionally, a visual examination of the State’s oil, gas, and 10 geothermal fields map (CDC 2001) and energy map (CDC 2000) reveals that 11 there are many natural gas fields and pipelines in the vicinity. There are six 12 plugged, exploratory natural gas xxxxx located on the island (see Section 4.3.7 13 above). 15 DWR’s site assessment staff reviewed the Prospect Island Phase I/II 16 Environmental Site Assessment report (Phase I/Phase II Environmental Site 18 Department of the Interior’s Bureau of Reclamation. Staff determined that the 19 report was sufficient to satisfy appropriate inquiry or due diligence under the 20 Federal Comprehensive Environmental Response, Compensation, and Liability 21 Act and that the report followed the Phase I process as outlined in the American 22 Society for Testing and Materials E1527-05 standards.
Hazards and Hazardous Materials. BASELINE will conduct an analysis and evaluate the potential hazards and hazardous materials environmental impacts associated with implementation of the proposed project, and will prepare the hazards and hazardous materials section of the EIR. Based on preliminary review of regulatory databases, the project is not located on or adjacent to any active hazardous materials release sites and would not be expected to pose an aviation hazard, wildland fire hazard, or emergence response hazard. Constructions activities that could result in the accidental discharge of pollutants, such as diesel fuel, to coastal waters would be subject to NPDES best management practices. These and other regulatory requirements for managing hazards and hazardous materials will be described. If significant hazards impacts are identified, feasible mitigation measures will be developed and/or standard conditions of approval will be applied to reduce the hazard and hazardous material impact to the extent practicable.

Consultant will use the Applicant prepared Phase 1 ESA to see if any identified potential recognized environmental conditions are located within the Project site or adjacent properties that could present material risk of harm to public health or to the environment. Review of DTSC Envirostor and SWRCB Geotracker databases will also be summarized in the Initial Study.
