Identification of Class Members. Within 14 days of the Preliminary Approval

Identification of Class Members. Plaintiffs shall reasonably endeavor to identify Class members whose identities are not set forth in Exhibits 1 through 136 in the Appendices to Plaintiffs’ Motion for Class Certification and shall make reasonable efforts to ascertain current addresses for those Class members who no longer reside at such addresses. Such efforts shall include, at a minimum, reviewing their pertinent records from discovery documents previously produced and utilizing an available national database. Defendants’ counsel agrees to make reasonable efforts to cooperate with Plaintiffs’ search for such additional Class members.
Identification of Class Members. 14.2.1 Within 21 calendar days of the entry of the Preliminary Approval Order, Defendant shall provide the Settlement Administrator with the following Class Data, to the extent that it possesses the information.
(1) the names, last known addresses, last known telephone numbers, and Social Security Number of each Class Member;
(2) dates of employment for each Class Member during the Class Period;
(3) the number of workweeks worked by each Class Member during the Class Period; and
(4) the number of workweeks worked by each PAGA Member during the PAGA Period.
(5) dministrator must maintain the Class Data in confidence, use the Class Data only for purposes of this Settlement and for no other purpose, and restrict access to the Class Data to Settlement Administrator employees who need access to the Class Data to effect and perform under this Agreement. Defendant has a continuing duty to immediately notify Class Counsel if it discovers that the Class Data omitted class member identifying information and to provide corrected or updated Class Data as soon as reasonably feasible. Without any extension of the deadline by which Defendant must send the Class Data to the Settlement Administrator, the Parties and their counsel will expeditiously use best efforts, in good faith, to reconstruct or otherwise resolve any issues related to missing or omitted Class Data.
14.2.2 Upon its receipt of the Class Data, the Settlement Administrator shall access the National Change of Address ( NCOA ) Database, and update the addresses.
14.2.3 No later than 10 calendar days after receipt of the Class Data, the Settlement Administrator shall notify Class Counsel that the list has been received and state the number of Class Members, PAGA Members, and workweeks in the Class Data.
14.2.4 The Settlement Administrator shall provide the Notice Packet by first class mail, forwarding requested, to the Class Members at the addresses identified through the process described above. This mailing shall occur no later than 35 calendar days after the entry of the Preliminary Approval Order. The first page of the Class Notice shall estimate the dollar amounts of any Class Member Payment and/or PAGA Member Payment payable to the Settlement Class Member, and the number of workweeks used to calculate these amounts.
14.2.5 As to any Notice Packets that are returned as undeliverable within 5 calendar days after the date of the initial mailing or where the NCOA Database indicates that the last known addres...
Identification of Class Members. The Defendants, with input from Class Counsel, shall complete an extensive review of their records and shall make reasonable efforts to compile a list of last known contact information for each Class Member, including last known mailing addresses, phone numbers, and email addresses (the “Class Member List”).
Identification of Class Members. 3.1 Exhibit A lists each MDL facility and identifies for each MDL facility all plaintiffs who the parties have determined filed valid and timely consent forms with the Court and work or worked in a position covered by this Agreement within their individual limitations period (“class members”). Class members who worked at multiple MDL facilities during his or her individual limitations period are listed at their most recent facility.
3.2 The motion for final approval will request that the claims of all class members be dismissed with prejudice and the alleged claims of any person who is not a class member, but has filed a consent form, be dismissed without prejudice. Persons who filed a consent form, but are not members of the class, will be listed on an attachment to the motion for approval of the settlement.
