In accordance with the monitoring and discovery provisions in the Treatment Plan, FC shall report to EPA and SHPO any newly discovered properties or any inadvertent effects on historic properties as described in the Archaeological Monitoring and Site Condition Assessments Section.

Intentional Excavation The Forest Service shall develop a NAGPRA Written Plan of Action [43 CFR 10.5(e)] or Comprehensive Plan [43 CFR 10.5(f)], in consultation with the appropriate Alaska Native Tribe(s) and Alaska Native Corporation(s), governing intentional recovery of human remains. If previously unrecorded and/or buried cultural resources are discovered during any portion of a project, or additional unexpected impacts to known resources, work within at least 100 feet will immediately cease, and an assessment will be made by a cultural resource specialist qualified in the applicable discipline in consultation with Parties. The CRNRA will notify SHPO and Tribes and work in that area will not resume until the resources can be identified and documented and an appropriate path forward or mitigation strategy developed and implemented in consultation with SHPO and, as appropriate, Tribes.

The MnDNR, in consultation with the MnSHPO and the Fond du Lac THPO, will design 299 a plan for avoiding, minimizing, or mitigating any further adverse effects prior to 300 resuming Project activities in the area of the discovery, if the discovery is determined to 301 be a historic property. 302 303 Treatment of Human Remains: If an inadvertent discovery contains human remains, the 304 City will immediately halt Project construction work in the area of discovery, will ensure 305 protection of the area of discovery, and will immediately notify local law enforcement 306 and the Office of the State Archaeologist (OSA), the lead state agency for authentication 307 of burial sites on non-federal lands. In accordance with Minn. Stat. § 307.08, the OSA 308 has the final authority in determining if the remains are human and to ensure appropriate 309 procedures are carried out in accordance with the statutes. Avoidance and preservation in 310 place is the preferred option for the treatment of human remains. In accordance with 311 Minn. Stat. § 307.08, subd. 3a, the OSA is required to coordinate with the Minnesota 312 Indian Affairs Council (MIAC) if the remains or associated burial items are thought to be 313 American Indian. The City and MnDNR shall work with the OSA and MIAC to develop 314 and implement a reburial plan if that is the approach preferred as determined in 315 accordance with Minn. Inadvertent Discoveries. If, during the course of this Lease, the Lessee observes items that may have historic or archeological value, Lessee shall immediately report its observations to the District so that it can determine what, if any, additional action is needed. Examples of historic, archeological and cultural resources include bones, remains, artifacts, shell, midden, charcoal or other deposits, rocks or coral, evidence of agricultural or other human activity, alignments, and constructed features. The Lessee shall cease all activities that may result in destroying these resources and shall prevent its employees from removing or otherwise damaging such resources. Through the course of routine landscaping activities, if a potentially historic property or human remains are identified, guidelines provided in this section shall be followed. USMMA shall ensure that the provisions in this Stipulation shall be included as a Stipulation of all USMMA operations and contracts involving ground disturbance. Basic procedures and contact information shall be provided to project managers and supervisory contractors for on-site reference.

Forward all documentation relevant to the dispute, including the Forest Service’s 560 proposed resolution, to the ACHP. The ACHP shall provide the Forest Service with its 561 advice on the resolution of the objection within 30 calendar days of receiving adequate 562 documentation. Prior to reaching a final decision on the dispute, the Forest Service shall 563 prepare a written response that takes into account any timely advice or comments 564 regarding the dispute from the Signatory Parties and provide them with a copy of such 565 written response. The Forest Service will then proceed according to its final decision.
