Inadvertent Discoveries. A. In accordance with the monitoring and discovery provisions in the Treatment Plan, FC shall report to EPA and SHPO any newly discovered properties or any inadvertent effects on historic properties as described in the Archaeological Monitoring and Site Condition Assessments Section.
B. EPA shall follow the post-review discovery requirements pursuant to 36 CFR § 800.13(b)(3) and (c) to resolve any such effects and to determine eligibility of newly discovered properties.
Inadvertent Discoveries. In the event that any human remains are encountered, work in the immediate vicinity of the discovery shall cease. Forest Service shall, as appropriate, comply with the most current State protocols for reporting discovery of human remains, which is available through the Office of History and Archaeology (OHA)/SHPO. If, after State protocols have been carried out, the potential for Alaska Native human remains is identified, the Forest Service shall follow NAGPRA procedures as outlined at 43 CFR 10, and ARPA procedures as outlined at 43 CFR 7. Intentional Excavation The Forest Service shall develop a NAGPRA Written Plan of Action [43 CFR 10.5(e)] or Comprehensive Plan [43 CFR 10.5(f)], in consultation with the appropriate Alaska Native Tribe(s) and Alaska Native Corporation(s), governing intentional recovery of human remains. The Forest Service shall notify the SHPO in advance of such an undertaking and provide an opportunity to comment. Emergency Undertakings
a. In the event of a declared emergency per 36 CFR 800.12 or in the case of an immediate threat to life or property as determined by the Forest Service, the Forest Service and its mutual aid partners will implement, to the extent prudent and feasible, any measures that could avoid or minimize harm to historic properties. The Forest Service may assume the eligibility of a cultural resource or group of resources for inclusion in the National Register without consultation with the SHPO and shall carry out preservation of damaged properties in a manner that will not adversely affect them.
b. The SHPO, the ACHP, Alaska Native Tribe(s), and Alaska Native Corporation(s) will be notified of the emergency. If circumstances allow, those notified shall have seven days to comment [36 CFR 800.12(b)].
Inadvertent Discoveries. 296 In the event that any human remains are encountered work in the immediate vicinity of 297 the discovery shall cease other than non-disturbing documentation and the FS shall 298 comply with the most current State protocols for reporting discovery of human remains 299 available through the Office of History and Archaeology (OHA)/SHPO. In addition, the FS 300 shall follow NAGPRA procedures as outlined at 43 CFR 10, and ARPA procedures 301 outlined at at 43 CFR 7.
Inadvertent Discoveries. A. If previously unidentified historic properties (including archaeological sites) or unanticipated effects to historic properties (including exceptionally significant finds) are discovered during Project activities, the Developer shall immediately halt all Project activities within a one hundred (100) foot radius of the discovery, notify HUD of the discovery and implement interim measures to protect the discovery from looting and vandalism.
B. Immediately upon receipt of the notification required in Stipulation III.A above, the Developer and HUD shall inspect the construction site to determine the extent of the discovery and ensure that construction activities have halted, clearly mark the area of discovery, implement additional measures, as appropriate, to protect the discovery from looting and vandalism, and notify the SMnHPO.
C. HUD, in consultation with SMnHPO, will design a plan for avoiding, minimizing, or mitigating any further adverse effects prior to resuming Project activities in the area of discovery.
Inadvertent Discoveries. During the term of this Agreement, in the event of the inadvertent discovery of human remains or funerary objects, the process described in Appendix 1 of the Alaska Region Cultural Resources Protection and Response Plan, Inadvertent Discovery of Human Remains Protocols, will be followed (available online at xxxxx://xxx.xx.xxxx.xxx/detail/r10/landmanagement/planning/?cid=fseprd994089).
Inadvertent Discoveries. In the event that cultural resources or historic properties are inadvertently encountered during an undertaking which has been considered under the terms of this PA, the respective park Superintendent will notify the Alaska SHPO and federally recognized Indian Tribe(s), as appropriate, within 48 hours, or as soon as reasonably possible. The Superintendent in consultation with the Section 106 Coordinator and the appropriate members of the CRM Team, will make reasonable efforts as needed to evaluate significance and, if necessary, to avoid, minimize, or mitigate adverse effects on any historic properties in consultation with the SHPO, federally recognized Indian tribes(s), ANCSA Corporations, and other interested parties, as appropriate. If human remains or other cultural material that may fall under the provisions of the Native American Xxxxxx Protection and Repatriation Act (NAGPRA) are present, the Superintendent will comply with NAGPRA and with the Archaeological Resources Protection Act (ARPA). The Superintendent will ensure that any human remains are always treated with dignity and respect, are left in situ, are not exposed, and remain protected while compliance with NAGPRA, ARPA, or other applicable federal, state, and/or local laws and procedures is undertaken.
Inadvertent Discoveries. If, during the course of this Lease, the Lessee observes items that may have historic or archeological value, Lessee shall immediately report its observations to the District so that it can determine what, if any, additional action is needed. Examples of historic, archeological and cultural resources include bones, remains, artifacts, shell, midden, charcoal or other deposits, rocks or coral, evidence of agricultural or other human activity, alignments, and constructed features. The Lessee shall cease all activities that may result in destroying these resources and shall prevent its employees from removing or otherwise damaging such resources.

Any aboveground cultural resources or archaeological deposits newly discovered during any undertaking will be treated as eligible until such time as they have been evaluated by an SOI- qualified individual for NRHP eligibility and will be avoided insofar as possible. In the event that an aboveground cultural resource or archaeological deposit is inadvertently discovered, work must cease, the Center CRM must be notified, and an SOI-qualified professional must be consulted. If the SOI-qualified professional recommends the resource as NRHP-eligible, the Center CRM will consult with the SHPO and Center Consulting Parties on the need for further investigation, such as archaeological testing and/or data recovery. If previously unidentified human remains are discovered during ground disturbing activities, NASA shall respond as directed in the Center ICRMP SOP and the ACHP Policy Statement on Burial Sites, Human Remains, and Funerary Objects (March 1, 2023).
Inadvertent Discoveries. In the event an historic property is inadvertently discovered during the construction phase, all work shall cease within a 15 meter radius of the historic property, and the SHPO notified immediately. Work may not continue within this buffer zone until a determination of the property’s NRHP eligibility is made. Work may continue outside of 15 meter buffer zone.
