THE FOREST SERVICE SHALL. Deposit payments received from the holder under this agreement into the Forest Service cooperative work fund.
THE FOREST SERVICE SHALL. 1. In cooperation with the Cooperator, develop an Annual Operating Plan (AOP) once the annual Xxxxxxx-Xxxx (G-T) Offset Agreement is completed which identifies projects to be completed by the Forest Service. The AOP will also provide a budget of expenses to be paid for by the Cooperator. The Forest Service will xxxx the Cooperator prior to commencement of work for deposits sufficient to cover the estimated costs. 2. Deposit all cash funds received under the terms of this Agreement to a Forest Service Cooperative Work Fund to be used for the purpose for which contributed, including related overhead expenses. 3. Rates for equipment and labor will be calculated annually through an analysis of the jobs to be performed and the amount of time required for each job. The time required to perform each job will be determined through past Forest Service experience. Rates for equipment and labor will be determined by actual personnel and equipment costs as updated yearly. See attached Annual Operating Plan for cost breakdowns. 4. Scheduling completion of specific projects will be determined exclusively by the individual Ranger District recreation staff where a project is located and will be timed in conjunction with other projects the Forest Service has in the vicinity of the specific campground(s). 5. If the Forest Service is unable to perform work identified in the Annual Operating Plan it will be Forest Service responsibility to get the work completed through use of other cooperators or by contract. The ability to secure other means for completion of identified work is predicated upon timely submission and receipt of billed amounts. 6. Credit the full amount submitted by the Cooperator toward their annual fees. 7. A final reconciliation will be completed annually in conjunction with the Year- End Performance Evaluation, and a Xxxx for Collection stating actual expenses for the year will be completed. Un-used funds at the end of each year will be submitted to the Federal Treasury.
THE FOREST SERVICE SHALL. Perform in accordance with the attached Scope of Work and Financial Plan. Complete all necessary NEPA requirements. Any decision required to be made under NEPA with respect to any authorized restoration services to be provided under this agreement on NFS lands shall not be delegated to the State. Inform the State of any changes in Good Neighbor Agreement policy, law, and regulations. Recognize the State's contribution, in a manner acceptable to both parties, in news releases, interpretive signs, photographs, or other media as appropriate.
THE FOREST SERVICE SHALL. 1. Respond within thirty (30) days to ODOT’s formal written requests for material source use. Responses should identify a Forest Service contact person; should specifically address Forest Service management concerns and environmental analysis, road use permit, and special use permit requirements; and should suggest potential dates for an on-site meeting. Responses should also address requests for assistance in site survey, investigation, and design. The Forest Service and ODOT shall jointly determine, on a case-by-case basis, who will complete and who will pay for these activities, based on projected uses of the material source over the life of the permit to be issued to ODOT and agree upon a timeline to complete the anticipated work. If no response is received within the 30 days, ODOT can contact the designated Forest Service Principal Contact for assistance. 2. Provide ODOT a free-use mineral materials permit (FS 2800-9, Exhibit Q) for single or multiple entries, for a period not to exceed 10 years (36CFR228.62 (b)) for the volume specified in the operating plan. At the time the operating plan is approved according to 36CFR228.56 and the permit is issued, the Forest Service shall designate a permit administrator and provide a statement as to their role, duties, and authority in the administration. A Special Use Permit (SUP) shall be issued for operations involving processing or uses of the material source beyond those needed for the first salable product, such as asphalt batch plants, storage and removal of materials after the permit period (See Exhibit A - 36CFR 228.43(a)(1) and (2)). 3. Notify ODOT of other permitted users or the Forest Service use of the subject materials source before the contract is issued, and require all users to follow all applicable permit conditions and the approved development and reclamation plan. Coordinate any other use of a Forest Service mineral material source with ODOT when ODOT has an active contract for removal of material from that source. This is to ensure that no significant user or safety conflicts arise and ODOT’s contract quantity is not compromised, and to ensure that the obligations ODOT has with their DOGAMI permit are maintained (Mine Land Reclamation Permit). 4. Issue a SUP for other uses of a site (non-mineral material development), such as the stockpiling and/or reuse of waste rock and earthen materials such as ditch cleanings, landslide debris, excess construction materials, or similar materials (see Exh...
THE FOREST SERVICE SHALL. A. Be responsible for the preparation and content of the EIS and make the XXXX final decision in accordance with the National Forest Management Act implementing regulations (36 CFR 219) and the Council for Environmental Quality’s Regulations for Implementing NEPA (40 CFR parts 1500-1508). B. Review, and incorporate into the EIS as appropriate, information provided by the Cooperator. C. Keep the Cooperator apprised of progress on the XXXX through regularly scheduled cooperating agency meetings to share information and collect feedback.
THE FOREST SERVICE SHALL. A. Identify available NEPA approved projects. Identify road work needs on those NEPA approved projects which may be undertaken in part by the State. Work with State to identify project areas & treatments which the State is able to undertake. Grant Access to or transfer stand specific data to the State. Provide relevant NEPA decision documents & crosswalks and identify project specific measures needed to comply with the Forest Plan and NEPA decision. Identify objectives and/or treatments for project areas. Generate maps for use by State, if needed. Identify transportation system (roads) conditions & needs relative to the identified projects. Determine road closure needs. Identify mitigations and design features required in NEPA. Provide any additional project or treatment specific information that is needed to ensure successful project implementation. B. Work collaboratively with State to prepare a Scope of Work (Appendix A), a financial plan (Appendix B), a list and maps of treatment activities (Appendix C), a timber removal plan (Appendix D), a GNA timber sale contract template (utilizing existing State DNR timber sale contract, Appendix E, and U.S. Forest Service Contract B & C provisions as necessary), and a plan of operations & quality control (Appendix F). Each of these shall be reviewed on an annual basis and updated as needed. Work with the State to include U.S. Forest Service policies addressed in GNA agreement, including Appendix E.

THE FOREST SERVICE SHALL. Assign Xx. Xxxxx Xxxxx as Authorized Departmental Officer’s Designated Representative (ADODR) for this agreement. Provide guidance, advice, consultation, and co-leadership essential to the satisfactory accomplishment for this agreement. Reimburse the Cooperator $200,000, in actual expenses towards project costs in accordance with the attached Financial Plan, within the project period from September 1, 2005 through June 30, 2006.

Enter into special use permits, specific agreements or contracts to accomplish agreed upon work projects. E. Provide information on completing Job Hazard Analyses and conducting safety training sessions for Florida Biodiversity Foundation, Inc. activities on National Forest System lands. F. Meet annually or as needed with representatives of the FLORIDA BIODIVERSITY FOUNDATION, INC. to develop collaborative strategic plans and discuss and reach agreement on guidelines for the project proposals to meet the purposes of this MOU.
