Joint Commissioning the establishment of one or more Pooled Funds in relation to Individual Schemes (the "Flexibilities")
Joint Commissioning. 6.1 Both Partners shall be responsible for compliance with and making payments of all sums due to a Provider pursuant to the terms of each Services Contract, where applicable. 6.2 Both Partners shall work in cooperation and endeavour to ensure that the relevant Services as set out in each Scheme Specification are commissioned within each Partners Financial Contribution in respect of that particular Service in each Financial Year. 6.3 The Partners shall comply with the arrangements in respect of the Joint (Aligned) Commissioning as set out in the relevant Scheme Specification. 6.4 Each Partner shall keep the other Partners and the Health and Wellbeing Programme Board and Joint Commissioning Forum regularly informed of the effectiveness of the arrangements including the Better Care Fund and any Overspend or Underspend in a Pooled Fund or Non Pooled Fund. 6.5 The Joint Commissioning Forum will report back to the Health and Wellbeing Board as required by its terms of reference as set out in Schedule 2. Appointment of a Lead Commissioner 6.6 Where there are Lead Commissioning Arrangements in respect of an Individual Scheme the Lead Commissioner shall: 6.6.1 exercise the NHS Functions in conjunction with the Health Related Functions as identified in the relevant Scheme Specification; 6.6.2 endeavour to ensure that the NHS Functions and the Health Related Functions are funded within the parameters of the Financial Contributions of each Partner in relation to each particular Service in each Financial Year. 6.6.3 commission Services for individuals who meet the eligibility criteria set out in the relevant Scheme Specification; 6.6.4 contract with Provider(s) for the provision of the Services on terms agreed with the other Partners; 6.6.5 comply with all relevant legal duties and guidance of both Partners in relation to the Services being commissioned; 6.6.6 where Services are commissioned using the NHS Standard Form Contract, perform the obligations of the “Commissioner” and “Co-ordinating Commissioner” with all due skill, care and attention and where Services are commissioned using any other form of contract to perform its obligations with all due skill and attention; 6.6.7 undertake performance management and contract monitoring of all Service Contracts; 6.6.8 ensure all 5 work streams as set out in Schedule 2 and in this Agreement are outcomes focussed; 6.6.9 make payment of all sums due to a Provider pursuant to the terms of any Services Contract. 6.6.10 keep t...

Joint Commissioning. The Authority shall cooperate with the Contractor to ensure that any Joint Commissioning is so far as reasonably practicable completed within the time for it shown in the Construction Programme.

Joint Commissioning. (where appropriate) 5.1 Joint commissioning under the direction of the relevant partnership board provides an opportunity to commission a range of services for the client group from a single point. The partners will specify what functions will be commissioned from the provider(s). 5.2 It is therefore important that the aims and measurable outputs and outcomes of the commissioning are clearly agreed by the partners, and that the agencies that have transferred their responsibility monitor their effectiveness through appropriate governance and management arrangements. 5.3 The Host Partner shall be responsible for negotiating service level agreements and NHS contracts with the service providers and shall not exceed the allocations without consent.
Joint Commissioning. Borough of ▇▇▇▇▇, Bournemouth Borough Council and the Bournemouth and Poole Primary Care Trust will co-ordinate their joint commissioning activity (based on the Joint Strategic Needs Assessment) through the Joint Commissioning Executive Group. This will inform the Children’s Trust of areas where the three organisations wish to jointly commission. Any joint commissioning activity concerning children will be based on Children and Young People’s Plan priorities and accountable and governed through the Children’s Trust arrangements. Partners in the Children’s Trust agree to having a joint commissioning framework to be developed in the light of the new Children’s Trust Governance arrangements put into place through this memorandum of agreement. The joint commissioning framework will need to include Practice Based Commissioning and Schools Commissioning.
