Judicial and Official Appearances. The District will grant a leave of absence to a Full-Time or Part-Time Faculty Member for a judicial or other official appearance in a proceeding in which the District is a party so long as the Full-Time or Part-Time Faculty Member's appearance in such proceeding is determined by the District to be in support of the District's position in that proceeding.

The amount of such leave shall be limited to the period of time for which the member is actually required to be present at the court as a witness or before the agency, board, commission, or tribunal, plus a reasonable amount of travel and waiting time. No leave shall be granted unless the member is required to appear by a subpoena or equivalent order and a copy submitted.

Leaves provided under this section shall be granted with pay for the employee up to the amount of the difference between the employee’s regular earnings for the period covered by the leave and any amount he/she receives for juror or witness fees.
