LACGC Duties. 4.1 LACGC will recruit MEMBERS and LEADERS. 4.2 LACGC will distribute to and collect signed copies of the Membership Participation Agreement from LEADERS whose duties will include obtaining signatures from all new MEMBERS. The Membership Participation Agreement outlines MEMBER duties and responsibilities. The Membership Participation Agreement is attached hereto as Exhibit 2. LACGC will work with LEADERS to resolve any issues that may arise and may remove MEMBERS who do not comply with any term of the Membership Participation Agreement and/or Burbank Community Garden Rules and Regulations, attached hereto as Exhibit 3. A current master list of MEMBERS will be maintained by LEADERS and provided to CITY upon request. 4.3 LEADERS will be selected in accordance with the Burbank Community Garden Rules and Regulations. 4.4 LACGC will work with LEADERS to organize regular MEMBER meetings regarding garden maintenance and management. 4.5 LACGC will maintain a copy of the Burbank Community Garden Rules in the garden. All MEMBERS and guests must abide and work with LEADERS to ensure all Burbank Community Garden Rules are followed. LACGC will work with LEADERS to enforce all Burbank Community Garden Rules and Regulations, up to and including suspending and/or revoking memberships, if necessary. 4.6 LACGC will work with LEADERS to plan garden design and to plan garden plot distribution amongst MEMBERS. 4.7 LACGC will work with LEADERS and MEMBERS to maintain any parkway, as defined in Burbank Municipal Code Section 7-4-101. Maintenance of any parkway shall be in conformance with any requirements set forth in Burbank Municipal Code Section 7-4-110 (b), specifically that it shall be unlawful to plant or maintain any shrubbery, ground cover, or other plants within the City’s parkways, whose growth is in excess of eight inches (8”) in height above the top of the nearest curb; and the LADWP LICENSE AGREEMENT Section 29, which requires landscaping and parkways between fences and public streets be kept in a neat and clean condition. LACGC SHALL NOT be responsible for maintaining any parkway trees. 4.8 LACGC will work with LEADERS to resolve any interpersonal conflict between MEMBERS or any violations of the rules and regulations. Should inter-personal conflict between or among MEMBERS become untenable beyond the capabilities of LACGC to resolve for a duration of six months, LACGC maintains the right to close the garden and terminate Membership Participation Agreements.
