Lease of Space. (a) Commencing on and as of the Effective Date, and continuing on a month-to-month basis thereafter for the duration of the Initial Term, BDSI shall sublease to BND (the "Intercompany Lease") a portion of the real estate leased by BDSI at 000 Xxxxx Xxxxxx Xxxxxx, Administrative Building No. 4, Xxxxxx, XX 00000 (the "BDSI Leased Space"). The portions of the BDSI Leased Space subject to the Intercompany Lease may, depending on the occupancy requirements of BND, fluctuate from time to time during the term of the Intercompany Lease. On not less than a quarterly basis commencing with the calendar quarter beginning Xxxxx 0, 0000, XXXX and BND shall determine in good faith the portion of the BDSI Leased Space then occupied by BND (the "BND Occupied Space") for purposes of the payment obligations of BND set forth in Section 3(b) below.
(b) The monthly rent payable by BND under the Intercompany Lease shall be equal to (i) BND's proportionate share, based on the then current BND Occupied Space, of the monthly out-of-pocket cost to BDSI for all utilities (other than telephone and telecom services), taxes and maintenance, cleaning, security and repair fees paid by BDSI with respect to the BDSI Leased Space and (ii) BND's proportionate share, based on usage, of the monthly out-of-pocket cost to BDSI for the provision of third party telephone and telecom services to BND
(c) The Intercompany Lease will continue on a month-to-month basis and shall terminate on April 1, 2004, unless earlier terminated by BDSI or BND on at least thirty (30) days prior written notice.
Lease of Space. Subject to the terms and conditions of this lease -------------- agreement (hereinafter referred to as "lease"), Lessor hereby leases and rents to Lessee and Lessee hereby rents and leases from Lessor a space containing approximately 645 square feet of floor space in the building occupied by the Store (hereinafter referred to as the "store building") which space hereinafter referred to as ("premises") is designated "Bank" and outlined in red on the diagram (floor plan) hereto attached, marked "Exhibit A" and made a part hereof by reference. Lessee shall be granted ingress to and egress from said Premises for Lessee, its officers, employees and customers, by and through the front entrance, vestibules and sales area of the building occupied by the Store, and Lessee shall have the right to install a night depository unit and an automated teller machine, the approximate locations of which are shown on said diagram (floor plan).

Lease of Space. RH / RCRH agrees to lease and does hereby let and demise to the BOR the shared use – for West River health care education purposes – of certain space on the first floor, basement, third floor or combination thereof of that property commonly called the “School of Nursing Building” located at 0000 00xx Xxxxxx, Xxxxx Xxxx, Xxxxx Xxxxxx described as, “Lots One (1) through Sixteen (16) Block Twenty-One (21), Boulevard Addition to the City of Rapid City, Xxxxxxxxxx County, South Dakota” and agrees that the BOR shall have the exclusive use of at least 28,000 gross square feet of such space. RH / RCRH further agrees that in the event such space becomes unavailable for any reason, they shall provide comparable space under substantially the same conditions provided hereunder for operation of the Rapid City based health care programs. Such comparable space shall be provided at no additional rental cost to the BOR. It is understood that RH / RCRH at all times – including the time when the BOR is granted exclusive use – reserve the right to use classrooms, the gymnasium, and what is currently referred to as the library at the “School of Nursing Building”, but agree that their use shall be secondary to that of the Rapid City based BOR health care programs, and that they shall arrange to reserve such space, if needed, well in advance of the date of use and subject to availability. The BOR understands that RH / RCRH will not permit alteration of the space, subject to reservation in a manner that will not permit RH / RCRH's use, unless otherwise agreed in writing and signed by both parties.
Lease of Space. ZoneCare currently leases space in a building located at the addresses set forth in Schedule 2.11(b). It is agreed that at Closing, the existing lease for this space and all subleases shall be terminated and ZoneCare shall enter into a new lease with Friesian Capital, Inc. and 000 X.X. 0 Xxxxxx Corp. in form and substance as set forth in Schedule 5.12.
Lease of Space. Landlord hereby leases to Tenant and Tenant hereby -------------- hires from Landlord Expansion Space A (defined below) upon and subject to all of the terms, covenants and conditions of the Lease except as expressly provided herein. "Expansion Space A" is the part of the building known as 000 Xxxxxxxxx Xxxxx, Xxxxxxx Xxxx, Xxxxxxxxxx, also known as Building 4 of Phase 1 of the Project known as Seaport Centre, which Expansion Space A is shown on Exhibit A to this Amendment. Landlord and Tenant hereby agree that Expansion Space A is conclusively presumed to be 16,714 square feet of Rentable Area.
Lease of Space. In consideration of the base rent and payment of the other amounts set forth in Section 3 below, Lessor hereby demises and leases to Lessee, and agrees to permit Lessee to peaceably and quietly have, hold and enjoy, the use of the Leased Space for the Term of this Agreement.

Lease of Space. Buyer agrees to lease Seller's current space on a month- to-month basis for up to three months immediately following the Closing Date. Buyer agrees to pay the monthly rent and all other amounts payable by Seller solely for the period during which Buyer occupies Seller's current space. Seller and XxXxxxxx covenant that they have provided Buyer with a true, complete and accurate copy of the Lease Agreement ("Lease") pursuant to which Seller leases the current space and that neither the lessor nor Seller is in default in any respect of the Lease.
