Lease Rights. Leases and rental agreements with tenants occupying space in the Improvements (the "LEASES"), and any guaranties or other security applicable thereto and all security deposits, advance rental, or like payments, if any, held by Seller in connection with the Leases.

Lease Rights. 29.1.1 For the purpose of this Agreement, the Concessionaire shall have rights to the use of the Site as sole lease-holder subject to and in accordance with this Agreement, and to this end; it may regulate the entry and use of the Project by third parties in accordance with and subject to the provisions of this Agreement.

All structures may be fenced by Pathnet, at its sole cost and expense, and may be multiple stories to the extent approved by BNSF, provided that the height and other dimensions of any such structure do not interfere with railroad operations or clearance, or create a safety hazard. Lease Rights. All of Transferors' right, title and interest in and to the Leases and any and all, guarantees of the Leases and all security deposits, advance rental or like payments, if any, held by Transferors in connection with the Leases.

Lease RightsPrior to receiving any notice of default under the Note referenced in paragraph 2.1(iii) of the Asset Purchase Agreement ("Note") from Assignee, Assignor shall continue to enjoy its rights under the Lease pursuant to its terms. In the event of a default under the Note, Assignee shall send notice of default setting forth the amount of the default (ignoring any right of acceleration contained in the Note) to Assignor by certified mail, return receipt requested. In the event the default is not cured by the Assignor within thirty (30) days as of the date of the aforementioned notice, Assignor's rights in the Lease shall terminate and revert to the Assignee. The Buyer shall not make any material modifications to or terminate the Lease without the prior, express written consent of the Seller. If a modification is made to the Lease, the modified Lease shall also be collaterally assigned pursuant to the terms of this Assignment herein. Failure of the Buyer to abide by the provisions of the paragraph shall constitute an Event of Default.
Lease Rights. Sublessor's rights under the Lease (excepting such rights as are personal to the Sublessor), may be enforced against the Landlord by Sublessee in its own name or in Sublessor's name, provided Sublessee advises Sublessor in writing at least seven (7) days before taking any action to enforce such rights. Sublessee agrees to reimburse Sublessor for any reasonable attorney fees or other expenses incurred by Sublessor as a result of any such action.

Any such structures may exceed 3,500 square feet only: (i) subject to space availability; (ii) following prior written approval of BNSF, not to be unreasonably withheld; and (iii) where such structures are not buildings where people regularly report to work. Pathnet's right to enter the Premises shall commence on the ___ day of ________________, 200__, and shall be for the sole purpose of allowing Pathnet, or any of its permitted assignees, sublessees of capacity, agents, contractors, strategic or co-development partners, customers or invitees, or any of their employees (collectively, "Pathnet Parties") to Construct and Operate Fiber Optic Facilities on the Premises, subject to BNSF's rights as set forth herein and all contract and/or property rights of others in the Premises. Pathnet, and any of the Pathnet Parties, also shall have the right to cross other property in which BNSF has a sufficient ownership interest as required to access the Premises, subject to BNSF's rights as set forth herein and all contract and/or property rights of others in the Premises, so long as such access shall not cross any active railroad track, or come within 25 feet of such track, without BNSF's prior written consent, which will not be unreasonably withheld or delayed.
